HomeMy WebLinkAbout99-031 - Approving Tentative Parcel Map No. 98-232195 GAS: 5/27/99 RESOLUTION NO. 99- 031 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE PARCEL MAP NO. 98-232, TO SUBDIVIDE A 62 ACRES INTO NINE PARCELS LOCATED AT MACARTHUR PLACE IN SPECIFIC DEVELOPMENT NO. 43 (TPM NO.' 98-232) WHEREAS, Tentative Parcel Map No. 98-232 has been filed to subdivide an existing 62 acre parcel into 9 lots, located at MacArthur Place in Specific Development No. 43 (the ~Project"); and WHEREAS, the design and improvement proposed for Tentative Parcel Map No. 98-232 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Aha General Plan; and WHEREAS, the Environmental Evaluator of the City Of Santa Ana has prepared a Negative Declaration for Environmental Review No. 98-175, pursuant to the California Environmental Quality Act, for the Project; and WHEREAS, the Planning Commission held a duly noticed public hearing, on May 10, 1999, on Tentative Parcel Map No. 98-232 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, the City Council finds and determines as follows: The proposed project, as conditioned, and it s design and improvements are consistent with the General Commercial land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed subdivision is consistent with the City's General Plan, Specific Development No. 43, and all elements thereof, and will have no adverse affect on the surrounding residential, industrial and commercial developments. The subdivision will create parcels that meet or exceed the minimum street frontage requirement within Specific Development No. 43 (MacArthur Place). The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes as well as other applicable City ordinances. The proposed subdivision conforms to the minimum street frontage requirement within Specific Development No. 43 (MacArthur Place), as well as meeting the intent of the State of California Subdivision Map Act provisions. 196 Co The project site is physically suitable for the type and density of the proposed project. Each proposed parcel site meets or exceeds the minimum required street frontage for development within Specific Development No. 43. The sizes of the proposed parcels permit for development within the allowable square footage intensity for MacArthur Place. There are no physical constraints on the parcels to preclude development. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish and wildlife or their habitat. No fish or wildlife will be affected by the approval of the map or by the design and improvements of the project. Environmental Review No. 98-175 has been prepared for the project, pursuant to Title XIV, California Code of Regulations § 735.5(c) (1), after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a) (3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. The design or improvements of the proposed project will not cause serious public health problems. The current and future development for this site will be in compliance with Specific Development No. 43 and the Santa Aha Municipal Code for such uses. The design or improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. There are no easements that would affect the use or development of these parcels. 2. Fletcher, Attorney ~~he~torney City 3 '199 o Conditions of ~DDroval Tentative Parcel.Map No. 98-232 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must remain in compliance with all conditions listed in Tentative Parcel Map No. 98-232 and those listed below throughout the life of the development project. Failure to comply with each and every condition may result in the revocation of the site plan review approval. A. Planning Division Comply with all conditions and requirements from the Development Review Committee (DRC) for the development project (DP No. 98- 109). Reciprocal access and drive aisles will be recorded to maintain the integrated development. Ail future development is subject to the fees in effect at the time of permit issuance. Ail future development proposals are subject to review through the City's review process. 5. Provide a copy of the recorded map within 10 days of recordation.
