HomeMy WebLinkAbout99-051 - Approving Conditional Use Permit No. 99-17RESOLUTION NO. 1999-051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 99-17 TO ALLOW A PROFESSIONAL TRADE SCHOOL USE LOCATED AT 3651 WEST SUNFLOWER AVENUE WHEREAS, the Planning Commission held a public hearing on July 26, 1999, on Conditional Use Permit Application No. 99-17, to allow a professional trade school use located at 3651 West Sunflower Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Council finds and determines as follows: Will the proposed use provide a service or facility, which will contribute to the general welfare of the neighborhood or community? The development of the art institute, as conditioned, will establish an educational facility, which provides needed instructional and cultural opportunities for the surrounding community. B o Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of the persons residing or working in the vicinity? The new art institute, as conditioned, is not anticipated to present any detrimental affects to the persons residing or working in the area. Parking concerns are addressed due to the unique nature of the use and through conditions imposed restricting the applicant to the use of the building to the floor plan submitted and approved in DP No. 99-40. Any anticipated impacts to health, safety or welfare are sufficiently mitigated through the conditions of approval imposed on this project. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area The proposed art institute development, as conditioned, is not anticipated to create any negative or detrimental impacts on the economic viability of the surrounding area. This unique development should provide a positive addition to the surrounding area, 3~6 which will complement and improve the economic viability of the area. Do Will the proposed use comply with the regulations and conditions specified in the chapter of the Santa Aha Municipal Code for such use? The apparent deficiencies in parking are addressed through the unique nature of the use and conditions imposed upon the applicant which severely restrict the floor plan. Due to the specialized use of the Art Institute, the floor plan includes customized art laboratories, lecture classrooms, computer labs, video studios, skills kitchens and administrative offices. Moreover, a condition of approval of the use restricts the applicant to the submitted floor plan. Due to these facts, the strict application of the Code as to parking would create an undue hardship on the applicant and is waived by this Council. Therefore, the proposed art institute, as conditioned, will comply with all regulations and conditions specified in the Santa Ana Municipal Code pertaining to such a development. E. Will the proposed use affect the General Plan of the City? The proposed art institute project will not pose any adverse affects on the General Plan designation of Professional and Administrative Office (PAO). The proposed trade school use is permitted in the district subject to approval of a conditional use permit. 2. The City Council hereby certifies and approves Mitigated Negative Declaration for Environmental Review No. 99-81. 3. This Council finds and determines that, pursuant to Santa Aha Municipal Code Section 41-650, the strict application and enforcement of the regulations in the Code related to the parking requirements will cause an undue hardship to the applicant. Further, this Council finds and determines that the unique nature and character of the proposed project requires modifications to the parking standards applicable for the specific use of the property as an Art Institute for the various reasons as stated in the aforementioned findings incorporated herein. 4. Conditional Use Permit No. 99-17 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. ADOPTED this ATTEST: 16th day of Auqust , 1999. an~e C. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all throughout the life of the conditional use permit. each and every condition may result in revocation permit. conditions listed below Failure to comply with of the conditional use Planning Division The applicant must comply with all conditions and requirements from the Development Review Committee for the development project (DP No. 99-40). A total of 375 parking spaces are provided on-site for the trade school use. The parking provided is based on the floorplan configuration approved for the development project (DP No. 99- require submittal of a parking analysis to the City of Santa Aha for review. A review of the terms and conditions of Conditional Use Permit No. 99-17 by the Planning Commission and City Council will be required. (Modified by the Planning Commission July 26, 1999). A lot line adjustment must be applied for and approved for the project. Conditional Use Permit No. 99-17 by the Planning Commission to conditions of approval. will be reviewed in 12 months, ensure compliance with the ATTACHMENT A
