NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence, both oral and written, submitted at the public hearing held this date this Council finds and determines as follows: That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code; The granting of a variance, as conditioned, will allow the monument sign to exceed sign limits, while limiting any additional signs on-site. The limitations for signage are in harmony with the intent of the sign code to reduce sign clutter. B. That the granting of a variance is necessary for the preservation and enjoyment of 356 Resolution No. 1999-056 Page 2 of 3 one or more substantial property rights; Approval of the monument sign variation, as conditioned, would not prohibit the identification of the business in an aesthetically appealing manner. The conditions of approval help to offset the size of the monument sign by limiting the number of signs. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property; Granting a variance as conditioned will not be detrimental to the public and surrounding properties by allowing the proposed signage to exceed the size limits for monument signs. The approval requires the applicant to remove a number of secondary signs, including building identification signs and advertising signs, on the subject site. The conditions of approval, limiting additional signage will visually enhance the service station property and the surrounding visual environment. That the granting of a variance will not adversely affect the General Plan of the City; The granting of the variance as conditioned will not adversely affect the City's General Plan land use designation for the area because the approval requires the applicant to remove a number of secondary signs, including building identification signs and advertising signs, on the subject site. 2. Variance No. 99-05 is hereby approved, as conditioned in Exhibit A, attached hereto and incorporated herein by reference, and based upon the aforementioned fmdings. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this site plan review approval. The applicant must remain in compliance with all conditions listed below throughout the life of the development project. Failure to comply with each and every condition may result in the revocation of the site plan review approval. Conditions of A~provml A. Planninq Division No other signs or displays of any kind, including but not limited to additional price signs, Chevron logos and identification, banners, flags, pennants, streamers, window signs, sale signs, advertisements, spandrel (spanner) signs, advertising boxes on light standards, car wash or other vehicular directional signs, etc. will be permitted. Only those identified in a through e below are allowed: a) One monument sign (freestanding) sign which includes the "Chevron" logo, the words "Fast Pay", gasoline and diesel fuel pricing, and the address. The monument sign must not exceed 13 feet 2 ~ inch in overall height, 18 feet 10 ~ inches in lineal feet and 49 square feet of advertising area. b) One "Chevron" sign located on the south elevation of the canopy. c) One small "Chevron" logo located on the east elevation of the canopy. d) One "Food Mart" sign over the entrance to the building. e) Six "Self" signs located on the edge of the spandrels. Remove the existing freestanding signs as depicted in Exhibit 3 as sign type 1 and lA. 360 RESOLUTION NO. 99- SEPTEMBER 7, 1999 PAGE 2 OF 2 o Place the freestanding monument sign in a diagonal direction to allow advertising visibility from Grand Avenue and Fourth Street. Also, provide 4 feet of landscaping around the entire monument sign. Existing monument sign to be removed from property. Also, remove the Point of Sale (POS) Exhibit 3. service station signs as noted on Remove the unpermitted exterior telephones from the site or apply for an Exterior Telephone Land Use Certificate. Remove the unpermitted air/water unit from the site or provide a designated parking space for the air/water location. Extend the new planter in the southeast corner of the service station approximately 18 feet to the north maintaining 20 feet between the fueling island and the new planter area. Submit a landscape plan for approval by the Planning Division. Install and maintain the landscaping per the approved landscape plan. A Land Use Certificate is required for the roof mounted disi. antenna. Submit a Site Plan indicating the correct northerly direction of the subject site.
