Hubbard, Harry H. Harvey, Henry H. Schlue~er, and Mayor A. Allen Hall. Cou~ucilman James Gilmore was absent. Following the Pledge of Allegiance to the Flag, the Invocation vas delivered by the Reverend Garland Lacey, Wilshire Presbyterian Church. APPROVAL OF MINUTES On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, the City Council approved as mailed the Minutes of the Regular Meeting of September 16, 1963. BID AWARD - WIDF~'IN~3 i?TH~ On mo%ion of Councilman Hubbard, BUSH TO SFu~RGEON seconded by CounciLman Schlueter and carried, Council received and ordered filed a report of bids received for the widening of 17th Sbree~ between Bush and Spurgeon Streets; approved award of contract to R. J. Noble Company in the amount of ~5,714.87 at unit prices; and rejected all other bids. BID AWARD - T~UCK On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council received and ordered filed a report of bids received for one truck, 19, O00 0.V.~.; approved award of contract to George Dunton Incorporated in the amount of $~,613.30; and rejected all other bids. BID AWARD - 16 TON On motion of Councilman Hubbard, WRECKEF~ & BODY seconded by Councilman Schlueter and carried, Council received and ordered filed a report of bids received for one 16 ton wrecker and body; approved award of contract to Co~ercial Truck Bodies in the amount of $2,~25.00; and rejected all other bids. HEARING Mayor Hall opened the hearing on Appeal APPEAL 9~ - Application 92 filed by John V. Sarinana SAEINANA from the Planning Commission's denial of Variance 1815 to construct a ~6 unit, two-story apartment development on R i property at 2020 W. 8th. The Clerk reported that notice of the hearing was given by the Planning Department as required by law, and that no written communications or objections had been received. The Clerk reported that the appellant, in his appeal application, had requested that the matter be referred back to the Planning Commission for consideration of 16 single-story units instead of the original 26 two-story units requested. There being no response to the Mayor's call for testimony, the hearing was closed. On motion of Councilman Nsbbard, seconded by Councilman Harvey and carried, Appeal Application 92 was refer~gd back to the Planning Co~nission for reconsideration. CITY COUNCIL - 212 - October 7, 1963 HEARING N~yor Hall opened the hearing on Appeal ~PPEAL 93 - Application 99 filed by Robert Politiski POLITISKI from the Planning Co~mission's denial of Variance 1825 to construct a lb unit, one and two story apartment complex in two buildings at 1803 W. Washington. The Clerk reported that notice of the hearing was given by the Planning Department as required by law, and that no written communications or objections had been received. There being no response to the Mayor's call for testimony, the hearing was closed. It was moved by Councilman Harvey, seconded by Councilman Hubbard and carried that the City Council uphold the action of the Planning Commission and instruct the City Attorney to prepare a resolution of findings and decision denying Varisnce Application 1825. HEARING ~4ayor Hall opened the hearing on Appeal APPEAL 94 - Application 9~ filed by Mathilda Kane from KANE the Planning Commission's denial of Conditional Use Permit 15~ to convert the garage of an existing residence into a nursery for five retarded crib-size children at 709 Mountain View Street. The Clerk reported that notice of the hearing was ~.ren by the Planning Department as required by law and that no written c~-,-~s~icatlons or objections had been received. The applicant stated in her appeal that the matter was not considered on the basis of establishing the nursery in the house instead of the garage. There being no further testimony, the hearing was closed. On motion of Councilman Harvey, seconded by Councilman Hubbard and carried, the City Council referred the appeal back to the Planning Commission for reconsideration under the new facts. HEARING Mayor Hall opened the hearingon Appeal APPEAL 95 - Application 95 filed by Clara Vose from ~OSE the Planning Commission's denial of Variance 1826 to construct a service station in the R 1 District at 12~8 Memory Lane. The Clerk reported that notice of the hearing was given by the Planning Department as required by law, and that a petition had been received, signed by approximately 27 property owaers~ protesting the application. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, the petition was received and ordered filed. Council heard Frank Pope, 1151 W. 17th Street, attorney for the applicant. Council heard Robert Conley, 2618 N. Louise, representing petitioners protesting, who objected to the application on the basis that developing the remainder of the applicant's property on a residential basis would be impractical and improbable, residential values would be depreciated, and a gas station within 200 or 300 feet of the homes would be a nuisance. Mr. Conley also stated that at the time a variance was granted for the station on the southwest corner the protestants were assured such a variance would not be granted for the R 1 property on the southeast corner. Ogden R. Connor, 12~0 W. Park Lane, stated that no action should be taken until a specific plan for the area is developed by the General Plan consultants. Bruce ~mrtin, 1085 Harbor Boulevard, Anaheim, representative for Shell 0il Company, displayed architect's sketch of the type of station to be installed~ drawing attention to its compatibility with the surroundings. The Planning Director pointed out that if a service station is built at this location, it will be difficult to develop the remaining area for residential use, and will probably bring commercial development on Bristol. CITY COUNCIL October 7, 1963 Joseph W. Trumpy~ 1121 Memory Lane, employee of Mrs. Vose, spoke in favor of the appeal, stating that a service station is the logical use of the land. There being no further testimony, the hearing was closed. On motion of Councilman Harvey, seconded by Councilman Schlueter, the City Council overruled the decision of the Planning Commission and instructed the City Attorney to prepare a resolution of findings and decision to grant Variance Application 1826o After discussion, an amendment to the motion was proposed by Councilman Hubbard to refer the matter back to the Planning Commission for reccm=aended conditions to be attached to the granting of the variance. Council- man Harvey and Schlueter agreed to the amendment and the amended motion was carried "to overrule the decision of the Planning Commission and refer the matter back to the Planning Commission for recommended conditions to be attached to the granting of Variance Application 1826". HEARING Mayor Hall opened the hearing on Appeal APPEAL 96 - Application 96 filed by Paul Quong QUONG from the Planning Commission's denial of Variance 1824 to construct two single story triplexes at 833 N. Baker, R i District. The Clerk reported that notice of the hearing was given by the Planning Department as required by law, and that no written communications or objections had been received. Robert F. Waldron, attorney for the applicant, cited exceptional circumstances and conditions of the property because of its size and shape, restricting its utilization in the R i zone over other properties in the neighborhood; that proposed development would enhance the neighborhood; and that other variances have been granted in the same zone in the same vicinity. Mr. Waldron presented photographs to support his statements. Ro G. Tremara, 832 Westwood, stated that neighbors would not object so strenuously if duplexes were proposed. Lewis B. Jones, 1143 W. 10th Street, objected to the proposal, noting it would create additional traffic congestion. There being no further testimony, the hearing was closed. On motion of Councilman Hubbard, seconded by Councilm~n Schlueter and carried, the City Council upheld the decision of the Planning Commission and instructed the City Attorney to prepare a resolution of findings and decision to deny Variance Application 1824 without prejudice. HEARING Mayor Hall opened the hearing on Appeal APPEAL 97 - Application 97 filed by Willowick Golf WILLOWICK GOLF C0)~RSE Course from the Planning Commission's approval of Variance 1822, Goeders and Mark Hospital, Inc. to construct a thirty bed, one story convalescent hospital for alcoholics at 3217 W. 5th Street. The Clerk reported that notice of the hearing was given by the Planning Department as required by law, and read a letter from Andrew R. Boersma, 3210 West 5th Street, stating that he owned property within 300 feet of the subject propertY, and that he had not been notified of the hearing held by the planning C~ission. The Deputy City Attorney advised that since proper notice was lacking, the proceedings should be declared null and void and the applicant should resubmit his application. On motion of Councilman Hubbard, seconded by Councilm~n Schlueter and carried, Council declared all proceedings null and void without prejudice to the applicant, and instructed the applicant to reapply. ~HEARING AMEND. APP. k70 - HORTON Mayor Hall opened the hearing on Amend- ment Application 470 filed by Dick Horton to reclassify from the R 2 to the CM District property on both sides ClT! COUNCIL - 214 - October 7, 1963 of Hathaway from 125 feet south of Fourth Street to 125 feet north of First Street. Planning Cnmmission Resolution No. 5651 recommended denial of applicant's proposal. The Clerk reported that notice of the hearing was published in The Register on September 21, 1963 end that no written communications or objections had been received. Dick Horton, 1523 N. Broadway, applicant, cited the m~ny signatures he had favoring the change to C 2, the plsnning Staff's rec ....... endation for CM zoning with which he concurred, and the Co~ission's subsequent denial. The Planntn~ Director explained that the PlanntB~ Commission felt that the area was proper for commercial zoning, but because of the residences still there, it would be advisable to delay rezoning and develop by variances. There being no further testimony, the hearing was closed. On motion of Councllmsn Harvey, seconded by Councilman Hubbard and carried, C~uncil approved thc reclassification and instructed the City Attorney to prepare an ordinance according to Exhibit AA 470 B. HEARING Mayor Nail opened the hearing on Amendment AMEND. APP. 472 - Application 472 filed by R. Perry Davis to DAVIS reclassify from the R 3 and P to the R 3 B end PB District property on the south side of l~th Street between Main and Broadway. Planning Comission Resolution 5650 recnmmended approval of Exhibit AA 472 A. The Clerk reported that notice of the hearing was published in The Register on September 21, 1963 end that no written communications or objections had been received. On motion of Councilman Hubbard, secouded by Councilman Schlueter and carried, the City Council approved the reclassification and instructed the City Attorney to prepare an amending ordinance according to Exhibit AA 472 A. HEARING - SECOND Mayor Hail opened the hearing on proposed STREET VACATION vacation of a portion of a street running north from First along the west line of the Southern California Railway Depot grounds and a portl~ of Second Street running from said west line easterly to the track of said railway ccmpany. The Clerk reported that notice of the hearing was published in The Register on September 14, 1963, and that no written ccamunications or objections had been received, but that the Public Works Department had requested the hearing be continued. It was moved by Councilman Hubbard, seconded by Councilmau Schlueter and carried, that the matter be continued to November 4, 1963 at 7:30 p.m. in the Council Chambers. TRAFFIC CONTROL - Council heard the City ~anager's McFADDEN AT BAITT reoort regarding a request for traffic control on ~cFadden at Raitt Streets. It was the staff's reccmmendation that neither signals nor a stop sign were warranted and that school children could cross at Center Street where a schoolboy patrol is in operation. Council received and ordered filed the ~anager's report and denied the request~ on motion of Councilman Hubbard, seconded by Councilman Schlueter and carried. WATER DEPOSIT REFUND Acting on a report heard from the City Manager regarding request of ~nderson Construction Co~osny for refund of $50.00 bulk water denosit, Council~ on motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, authorized the City Treasurer to refund the deposit. RECREATION C~'£~ Council considered a request filed by Harold W. McGuire and Albert Stanley to open a family recreation center at 1002 E. 17th ~treet.
