RESOLUTION NO. 2000-015
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA AUTHORIZING THE ESTABLISHMENT OF
THE WORKFORCE INVESTMENT BOARD, APPOINTING
MEMBERS THERETO, AND DISSOLVING THE PRIVATE
INDUSTRY COUNCIL
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1. The City Council hereby finds, determines and declares as follows:
On February 28, 1986, the City of Santa Ana was designated a Service
Delivery Area ("SDA") by the Governor for the purposes of carrying out the
provisions of the Job Training Partnership Act ("JTPA").
On February 23, 1987, the City entered into the controlling agreement with
the Private Industry Council ("PIC") that defined the roles and
responsibilities of each party with regard to the JTPA.
The Workforce Investment Act of 1998, Public Law 105-220 ("WlA"), which
will take effect on July 1, 2000, will replace the JTPA programs with WIA
programs. Under WIA, the Governor, in conjunction with the California
State Workforce Investment Board, designates the local workforce
investment areas. The City of Santa Ana received such designation at the
January 28th State Board meeting. The WIA states that there shall be a
local Workforce Investment Board ("WIB") established in each area that will
set workforce policy for that local area. Once the WIB is established, the
PIC shall be dissolved as the WIA replaces the JTPA.
The purpose of the WlB shall be to oversee a local cooperative relationship
with the City that will most effectively satisfy the labor demand needs of the
business community.
The WIA provides that individuals who serve on the Board are to be
appointed by the appropriate representative or representatives of the local
public agency, with categories of membership as prescribed by the WIA.
The WIA states that membership of each local board shall include the
following, with the majority of the individuals serving on the Board and the
Chair coming from the private sector:

Representatives of business in the local area;
Representatives of local educational entities;
Representatives of labor organizations;
Representatives of community-based organizations

organizations representing individuals with disabilities and veterans);
Representatives of economic development agencies;
Representatives on behalf of the mandated one-stop partners.
The pdvate sector members have been nominated by both the Chamber of
Commerce and the Southland Economic Development Corporation, and the
public sector nominations have been issued by the respective
organizations.
The Mayor and City Council have reviewed the nominating letters along with
the members' resumes in order to ratify the nominations.
The Executive Director of the Community Development Agency and City
Attorney shall prepare and serve proper notice upon the PIC to terminate
the above-referenced agreement of February 23, 1987, as required by
section 12 thereof, due to the fact that the City will no longer be an SDA
under the JTPA because the WIA shall take effect on July 1, 2000.
The establishment of the WIB is necessary in order to bring WIA funds into
the City of Santa Ana.
Section 2. The Workforce Investment Board is hereby established pursuant to the
Workforce Investment Act in order to insure the involvement of the business and
industrial community, including small businesses, minority business enterprises,
education, labor organizations, economic development agencies and one-stop delivery
system partners in workforce investment activities.
Section 3. The Mayor and City Council, after review of the private and public sector
nominations for membership, ratifies such nominations and establishes the initial
individuals to serve on the Board of the Workforce Investment Board. Hereafter, the
individuals who serve on the Board shall be appointed and may be removed and
vacancies may be filled by the Mayor and City Council by motion as provided by section
901 of the City Charter, to the extent that such Charter provisions do not conflict with the
WIA.
Se~ion 4. Pursuant to section 12 of the February 23, 1987 controlling agreement
between the City and the PIC, the Private Industry Council is hereby dissolved of all
duties and responsibilities, and the newly established WIB shall act on behalf of the PIC
until the WIA takes effect on July 1, 2000.
Section 5. If any section, subsection, sentence, clause, phrase or word of this
Resolution is for any reason held to be invalid by a court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this Resolution. The
City Council hereby declares that it would have passed and adopted this Resolution,
and each and all provisions hereof, irrespective of the fact that one or more provisions
may be declared invalid.
