RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA AFFIRMING MINIMUM CONTRACTUAL
STANDARDS FOR HISTORIC PROPERTY
PRESERVATION AGREEMENTS
WHEREAS, Section 30-29 of the Santa Aha Municipal Code states that
provisions of historic property preservation agreements shall include all provisions
required pursuant to Government Code Section 50281 and any additional provisions
required by City Council;
WHEREAS, on Apdl 6, 2000, the Histodc Resources Commission voted to
recommend that City Council adopt a resolution affirming minimum maintenance and
improvement provisions for historic property preservation agreements; and
WHEREAS, this Council desires to affirm minimum maintenance and
improvement criteria for historic property preservation agreements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SANTA ANA AS FOLLOWS:
Standards and conditions for historic property preservation agreements shall
include the minimum property maintenance provisions outlined below and as
further detailed in Exhibit A, attached hereto and incorporated herein by
reference:
Owners shall maintain the historic property in a good state of repair and
preserve and maintain the extedor appearance of the property and its
character defining features. When applicable, owners shall also be
required to restore or rehabilitate the property to maintain its specific
character defining features. In such instances, a list of the specific
improvements required and a time frame for completion shall be included
in the agreement.
All changes to the historic property shall comply with applicable City plans
and regulations and conform to all U.S. Secretary of the Interior's
Standards and Guidelines for Historic Preservation Projects.
The exterior of the historic property shall be documented and the owners
shall maintain the property in the same or better condition as documented.

A view corridor enabling the general public to see the historic property
from the public right-of-way shall be maintained during the term of the
agreement.

Demolition or destruction of the character defining features of the historic
property or site shall be prohibited during the term of the agreement.
Trees and other major vegetation may only be removed pursuant to an
approved rehabilitation plan approved by the Historic Resources
Commission and in conformance with the Secretary of Interior's
Standards. Additionally, deteriorating, dilapidated or unrepaired structures
and other unsightly decoration or structure which is unsightly because of
its height, condition or inappropriate location shall be prohibited.
Owners shall permit reasonable periodic examination of the interior and
extedor of the historic property, by prior appointment, to the County
Assessor, State Department of Parks and Recreation, State Board of
Equalization and the City of Santa Ana in order to determine owners'
compliance with the terms and provisions of the agreement.
The Historic Resources Commission shall evaluate the effectiveness of the
above provisions one year from the adoption of this resolution.

Exhibit A
Standards and Conditions for Historic Property
Dudng the term of this Agreement, the historic property shall be subject to the following
conditions, requirements and restrictions.
Owners shall maintain the historic property in a good state of repair and shall
preserve, maintain, and, where necessary, restore or rehabilitate the property
and its character-defining features, notably the general architectural form, style,
materials, design, scale, proportions, organization of windows, doors, and other
openings, textures, details, mass, roof line, porch and other aspects of the
appearance of the extedor to the satisfaction of the City. (Note: On a case by
case basis, staff will evaluate individual Mills Act applications to determine if
restoration/rehabilitation of the property is necessary to maintain specific
character defining features. In such instances, the contract will include a
provision identifying the specific improvement required and the time frame
required for completion).
All changes to the historic property shall comply with applicable City plans and
regulations, and conform to the roles and regulations of the Office of Historic
Preservation of the State of Department of Parks and Recreation, namely the
U.S. Secretary of the Interior's Standards and Guidelines for Historic
Preservation Projects. These guidelines are attached hereto, marked as Exhibit
A, and incorporated herein by this reference. The condition of the exterior of the
property, as of the effective date of this Agreement, is documented in
photographs attached hereto as Exhibit B and incorporated herein by reference.
Owners shall continually maintain the historic property in the same or better
condition as documented in Exhibit B.

A view corridor enabling the general public to see the historic property from the
public right-of-way shall be maintained, and Owners shall not be permitted to
block the view corridor to the property with any new structure, such as walls,
fences or shrubbery, so as to prevent the viewing of the histodc landmark by the
public.
The following are prohibited: Demolition of the historic property or destruction of
character-defining features of the building or site; removal of trees and other
major vegetation unless removal is approved by a rehabilitation plan approved by
the Historic Resources Commission, paving of yard surface; extedor alterations
or additions unless approved by the Historic Resources Commission and such
alternations are in keeping with the Secretary of Interior's Standards;
deteriorating, dilapidated or unrepaired structures such as fences, roofs, doors,
walls, and windows; storage of junk, trash, debris, discarded or unused objects

such as cars, appliances, or furniture; and other unsightly by decoration,
structure or vegetation which is unsightly by reason of its height, condition, or
inappropriate location.
Owners shall allow reasonable periodic examination, by prior appointment, of the
interior and exterior of the historic property by representatives of the County
Assessor, the State Department of Parks and Recreation, the State Board of
Equalization, and the City of Santa Ana as may be necessary to determine the
Owners' compliance with the terms and provisions of this Agreement.
