RESOLUTION NO. 2000-040
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF
MISCELLANEOUS FEES FOR FISCAL YEAR 2000-2001
AND REPEALING IN PART RESOLUTION NO. 99-030
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOVVS:
Section 1: Findings. The City Council does hereby find, determine and declare
as follows:
Each year, for the convenience of the public the City Council gathers in a
single document a comprehensive listing of fees and service charges
imposed by the City upon that limited number of persons seeking services of
value from the City,
This document is known as the "Miscellaneous Fee Schedule," and is
attached to this resolution and made a part hereof by this reference. Each
current fee or service charge is identified under the column entitled "Current
Fees FY 99-00" and each fee or service charge for Fiscal Year 2000-2001 is
identified under the column entitled "Proposed Fees FY 00-01."
As part of approving the Miscellaneous Fee Schedule for Fiscal Year
2000-2001, the vadous agencies of the City have analyzed the cost to
administer the various programs, activities and applications for which the
City charges fees or service charges.
The Council finds that the Consumer Price Index for all items for all urban
consumers ("CPI-U") for cities in the United States has increased three
percent (3.0%) from April 1999 to April 2000. This CPI-U for this same April
to April one year period for the Los Angeles-Riverside-Orange County region
has increased 2.4%, but for the pertinent period of analysis from March 1999
to March 2000, this regional CPI-U has increased 3.4%.
In a few, limited circumstances, agencies have determined that the cost to
the City to process or undertake the services set forth in the Miscellaneous
Fee Schedule has increased over the prior fiscal year by approximately
2.7%, so that certain proposed fees for Fiscal Year 2000-2001 have been
increased by this amount, or by this amount rounded to the nearest five
dollars ($5.00).
Based upon these facts the Council finds that these proposed increased
fees or service charges represent fair and equitable fees or service

charges which are reasonably related to the City's cost in administering
these programs or providing these services.
In a few, limited circumstances, new fees have been proposed or existing
fees proposed to be increased beyond a 2.7% CPI adjustment. In these
circumstances, the new or increased fee does not exceed the cost of
providing the service or processing the pertinent application.
In order to have a single comprehensive document for Fiscal Year
2000-2001, the majority of fees which are unchanged have simply been
reprinted in the Miscellaneous Fee Schedule. The Council expressly
states that it is not its intention to repeal previously adopted fees and
adopt new fees of exactly the same amount, but is simply repeating these
fees so that the Miscellaneous Fee Schedule can continue to be a
comprehensive source of City fees and service charges.
Based upon the testimony, reports and other evidence submitted on this
matter, this city council makes the above-specified findings.
Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2000-2001 is
hereby adopted. Each fee or service charge set forth under the column entitled
"Proposed Fees FY 00-01," or row entitled "Proposed Fee(s)" or "Adjustment" shall be
levied until further resolution of this Council.
Section 3: To the extent that any fee or service charge established pursuant to
City Resolution No. 1999-030 is inconsistent with the fees or service charges
established pursuant to this Resolution, then said Resolution No. 1999-030 is hereby
repealed.
Section 4. If any fee, service charge, section, subsection, sentence, clause,
phrase or word of this Resolution is for any reason held to be invalid by a court of
competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Resolution. The City Council hereby declares that it would have passed
and adopted this Resolution, and each and all provisions hereof, irrespective of the fact
that one or more provisions may be declared invalid.

RANGE DETERMINATION
Each business in the City of Santa Ann which is required to submit a business plan and/or inventory pursuant to
Health & Safety Code, Chapter 6.95 of Division 20, shall be assigned a range consisting of a "range number"
and a "range letter" as follows:
Range Number~ shall be based on thc maximum quantity
of all hazardous materials present on the business premises at
any time in accordance with the following schedule:
Range Letters shall be based upon the total number
of hazardous substances or waste categories listed on the
inventory of the business submitted to the City as follows:

Each submission of a business plan (as defined in health and Safety Code Section 25501) and each
certification provided pursuant to Health and Safety Code Section 25505 (c) and each submission of an
annual inventory pursuant to Health and Safety Code Section 25505 (d) (other than inventories which arc
submitted as part ora business plan or certification) shall be accompanied by a fee based upon the "range"
of the subject business in aceordence with the following schedule:

Late Filing Fee
The Fire Chief shall impose a late filing penalty based on additional administrative
costs incurred due to the late filing of any business plan, eerfification, or inventory.
The amount of such penalty shall be 25% of the fee for such filing. Nonpayment
of the fee and penalty shall incur 10% interest on the amount of the billing starting
30 days after the date issued,

ADMINISTRATIVE PENALTY FEE SCHEDULE
This fee schedule utilizes a base penalty for each of the listed offenses and
assesses a surcharge to that penalty expressed as a percentage of the base
penalty for those factors outlined in H&S Code section 25514.5(0 which
include but are not limited to the following considerations, but shall not
exceed $5,000 for each day the violation occurs:
a. Ext~nt of harm caused by thc violation - surcharge to 500 percent.
b. The nature and persistence of the violation - surcharge to 500 percent.
c. The length of time over which the violation occurs-surcharge to 100 percent.
d. The frequency of past violations - surcharge to 100 percent.
e. Action taken to mitigate the violation - surcharge to 100 percent.
f. Financial burden on the viola~r - will be considered.
The following base penalties shall be assessed for the below-listed violations:

Failure to notify real property owner that a business plan is

Classes, Leisure, and Instructional
From time to time, privately taught Icisure and instructional elates will be
offered by various agency divisions. The announcement of same will be mede
by printed fliers or in thc quarterly program booklet mailed to each residance
in the City. Programs so offered will be conducted in a 4-10 week format.
Charges for each class will be established by the Executive Director of Parks,
Recreation & Community Services. The City of Santa Ana will receive 30%
of thc total fees collected from each of these leisure or instructional classes.

the permit or service for which a fee is charged or imposed.
No permit shull be issued to any person, finn or coq)oration
unless ail fees therefor have been paid in full.
Exception: Waiver of Fee
No permit or plan check fees required by this resolution wili
be charged for public impwvement pwjects performed by
construction contractors and subcontractors pursuant to contract
with the City of Santa Aha or the Community Redevelopment
Agency of the City of Santa Aha nor for any work performed by
employees of the City in the course of their employment.
However, this fee waiver does not exempt any party from
obmlnlng a per. it for such work nor exempt such party from
conformln~ to the procedures e~tablished by the City nor from
compliance with all applicable City and State ordinances regulating
such work.
REFUNDS
Upon written request from the permittec, refunds of permit
fees may be made w the permhiee in an mount equal to 80%
of the permit fee, exclusive of thc plan cheek and issuance
fee; except that no permit fees shali be refunded undcr any
of the following circumstances:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF
MISCELLANEOUS FEES FOR FISCAL YEAR 2000-2001
AND REPEALING IN PART RESOLUTION NO. 99-030
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOVVS ·.
Section 1: Findings. The City Council does hereby find, determine and declare
as follows:
Each year, for the convenience of the public the City Council gathers in a
single document a comprehensive listing of fees and service charges
imposed by the City upon that limited number of persons seeking services of
value from the City,
This document is known as the "Miscellaneous Fee Schedule," and is
attached to this resolution and made a part hereof by this reference. Each
current fee or service charge is identified under the column entitled "Current
Fees FY 99-00" and each fee or service charge for Fiscal Year 2000-2001 is
identified under the column entitled "Proposed Fees FY 00-01 ."
As part of approving the Miscellaneous Fee Schedule for Fiscal Year
2000-2001, the vadous agencies of the City have analyzed the cost to
administer the various programs, activities and applications for which the
City charges fees or service charges.
The Council finds that the Consumer Pdce Index for all items for all urban
consumers ("CPI-U") for cities ~n the United States has increased three
percent (3.0%) from April 1999 to Apd12000. This CPI-U for this same Apdl
to Apdl one year pedod for the Los Angeles-Riverside-Orange County region
has increased 2.4%, but for the pertinent pedod of analysis from March 1999
to March 2000, this regional CPI-U has increased 3.4%.
In a few, limited circumstances, agencies have determined that the cost to
the City to process or undertake the services set forth in the Miscellaneous
Fee Schedule has increased over the prior fiscal year by approximately
2.7%, so that certain proposed fees for Fiscal Year 2000-2001 have been
increased by this amount, or by this amount rounded to the nearest five
dollars ($5.00).
Based upon these facts the Council finds that these proposed increased
fees or service charges represent fair and equitable fees or service

charges which are reasonably related to the City's cost in administering
these programs or providing these services.
In a few, limited circumstances, new fees have been proposed or existing
fees proposed to be increased beyond a 2.7% CPI adjustment. In these
circumstances, the new or increased fee does not exceed the cost of
providing the service or processing the pertinent application.
In order to have a single comprehensive document for Fiscal Year
2000-2001, the majority of fees which are unchanged have sirfiply been
reprinted in the Miscellaneous Fee Schedule. The Council expressly
states that it is not its intention to repeal previously adopted fees and
adopt new fees of exactly the same amount, but is simply repeating these
fees so that the Miscellaneous Fee Schedule can continue to be a
comprehensive source of City fees and service charges.
Based upon the testimony, reports and other evidence submitted on this
matter, this city council makes the above-specified findings.
Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2000-2001 is
hereby adopted. Each fee or service charge set forth under the column entitled
"Proposed Fees FY 00-01," or row entitled "Proposed Fee(s)" or "Adjustment" shall be
levied until further resolution of this Council.
Section 3: To the extent that any fee or service charge established pursuant to
City Resolution No. 1999-030 is inconsistent with the fees or service charges
established pursuant to this Resolution, then said Resolution No. 1999-030 is hereby
repealed.
Section 4. If any fee, service charge, section, subsection, sentence, clause,
phrase or word of this Resolution is for any reason held to be invalid by a court of
competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Resolution. The City Council hereby declares that it would have passed
and adopted this Resolution, and each and all provisions hereof, irrespective of the fact
that one or more provisions may be declared invalid.

NEW MISCELLANEOUS FEES
FiReen new miscellaneous fees are proposed for FY 00-01~--nine from the Fire Department, five from the
Planning & Building Agency, and one from Police. All of the Fire Department fee proposals relate to the
Fire Code permit.
1) Fire Code Permit Fee- Indoor Assembly A-1 & A-2
Proposed Fee(s): $200.00
Department: Fire Department
Fire Code permit fees for indoor assembly areas (e.g., auditorium) will be based on the size of the assembly
and the use of a stage. A-1 assembly areas have a capacity of 1,000 or more persons and A-2 assemblies
between 300 and 999 persons, in both instances with a stage (as defined by the Building Code).
2) Fire Code Permit Fee - Indoor Assembly A-2.1
Proposed Fee(s): $200.00
Department: Fire Department
A-2.1 refers to assembly areas with a capacity of 300 or more persons, with no stage.
3) Fire Code Permit Fee - Indoor Assembly A-3

A-3 refers to small assembly areas (e.g., bars and restaurants) with a capacity between 50 and 299 persons,
with or without a stage.
4) Fire Code Permit Fee- Above Ground Tanks

Above ground tanks typically contain substances such as liquid fuel, gas, wastes, or raw materials used in a
manufacturing process. The City inspects these tanks sinCe they involve safety and other standards subject to
the Fire Code. The proposed fee pays for the Fire Department annual inspection and the other costs of
processing the Fire Code permit application.
5) Fire Code Permit Fee- Spraying, or Diooino Operations
Proposed Fee(s): $150.00

Spraying and dipping operations (e.g., car painting shops) involve flammable liquids and other hazardous
materials subject to the Fire Code. The proposed fee will recoup the cost of inspection and other permit
processing costs.

9) Fire Code Permit Fee - Additional Inspections

Fire Code Permit fees include a second inspection to verify that deficiencies found during the first inspection
have been corrected. Permit applicants who need a third or subsequent inspection because of uncorrected
deficiencies require the City to incur the extra costs of providing additional inspections beyond the normal
service level. The proposed fee will be assessed for each additional inspection after the second inspection to
defray the extra costs.
10) Conditional Use Permit (CUP) Condition Modification

Processing a conditional use permit (CUP) application typically requires a series of staffactions and follow-
up work with the applicant, culminating in a Public Hearing conducted by the City Council. At the hearing,
the Council solicits input from the public, the applicant(s), and City staff to evaluate the merits of the CUP
application. The Council then votes to approve or deny the CUP. A request to modify an existing CUP
triggers a similar chain of events. The proposed fee of $885.00, which is half of the CUP application fee of
$1,775.00, will recoup the costs of re-opening the process.

applicant, culminating in a Public Hearing conducted by the City Council. At the hearing, the Council
solicits input from the public, the applicant(s), and City staffto evaluate the merits of the variance
application. The Council then votes to approve or deny the variance application. A request to modify an
existing variance triggers a similar chain of events. The proposed fee of $885.00, which is half oftbe
Variance application fee of $1,775.00, will recoup the costs of re-opening the process.
12) Temporary. Certificate of Occupancy
ProposedFee(s): $300.00 per application
Department: Planning & Building Agency
The proposal is to use existing authority granted by Santa Ana Municipal Code Section 8-112 to set a fee that
would defray the cost of processing, monitoring, and maintaining records of temporary certificates of
occupancy--and incorporate the fee into the Miscellaneous Fees Schedule. (Note: A temporary certificate of
occupancy expires 30 days from date of issuance. The regular certificate of occupancy is issued at no charge
with payment of the Business License Tax.)
13) Landscape Plan Review
ProposedFee(s): $100 for Residential Projects
$250 for Non-residential Projects

Department: Planning & Building Agency
A project with structures goes through a site plan review that includes a landscape/hardscape plan review
and is assessed a single fee. A project with no structures (e.g., parking lots) goes through a landscape plan
review only. Currently, landscape plan reviews are provided at no charge but the volume of these reviews
has doubled from 12 to 25 reviews annually. The proposal is to set a Landscape Plan Review Fee of $100
for residential customers and $250 for non-residential customers. The fees include the cost of the initial
inspection and a second inspection to verify deficiencies have been corrected. A new Re-Inspection Fee of
$50 per visit will be levied for a third or subsequent inspection for uncorrected deficiencies.

14) Informational Literature on Technical Standards

Department: Planning & Building Agency
The Planning & Building Agency prepares informational literature (brochures and pamphlets) on various
Code standards and makes them available to customers at the public counter. Examples are Design &
Development Standards, Parking Standards, and On-Premise Sign Standards. The proposal is to recoup the
reproduction cost of these materials by charging customers actual cost.
15) Evidence Tape - Video or Audio Copies
ProposedFee(s): $30.00 per video or audio tape
Department: Police
The proposed fee will defray the materials and labor cost of preparing video or audio copies of evidentiary
tapes stored in the Police Department Property & Evidence Division.

PROPOSALS TO MODIFY EXISTING FEES
Proposed modifications to existing fees range from simple fee name changes to fee rate adjustments to
incorporating fees established by a past Council resolution or ordinance into the Miscellaneous Fees
Schedule. Incorporating established fees into the annual schedule helps ensure that the fees are reviewed
and updated, along with all the other City fees, on a regular basis.

The City is divided into six drainage assessment areas as provided for in the Santa Ana Municipal Code.
Drainage fees are collected from properties at the time of development on a per acreage basis to pay for the
repair and improvement of the area's drainage system. Fee rates are based on the cost of constructing the
area's drainage facilities. The proposal is to adjust the above area fees to reflect the 2.7% CPI increase and
incorporate them into the Miscellaneous Fees Schedule.
2) Negative Declaration with Studies & Mitigation - No Traffic Study Required
Existing Fee: $1,080.00 per application
Adjustment: Minimum nonrefundable deposit of $2,500 or 10% of consultant fees whichever is
greater, plus reimbursement to the City for other additional costs accrued.
Department: Planning & Building Agency
A Negative Declaration with Studies & Mitigation (a.k.a. "neg dec") may or may not require a traffic study.
Currently, the fee for a "neg dec" that requires a traffic study is a non-refundable deposit of $5,000 or 10%
of consultant fees whichever is greater, plus reimbursement to the City for other additional costs accrued. In
contrast, the current fee for a "neg dec" which requires no traffic study is a fiat fee of $1,080 per application.
The proposal is to replace this fiat fee with a fee structure similar to the first "neg dec" to improve the cost
recovery for providing the service. The proposed minimum nonrefundable deposit however would only be
$2,500 and not $5,000 since the latter "neg dec" would not require a traffic study.
Entertainment Conditional Use Permit (CUP) - Coffee Houses
Existing Fee: $150 per application

This fee was originally established on December 15, 1997 by Council Resolution 97-059 to recover the cost
of processing a conditional use permit for an applicant who wishes to set a cover charge for entertainment at
a coffee house with no Alcoholic Beverage Control (liquor) license. The proposal is to incorporate this fee
into the Miscellaneous Fees Schedule.

4) Land Use Certificnte for Exterior Telephones (Pay Phones)

This is an existing fee established by Council Resolution 98-084 in November 1998. The fee partially offsets
the City's cost of processing an application for a permit to operate an exterior telephone (i.e., pay phone)
within the City. The fee rate is based on the typical stafftime needed to research and review the plans,
process the permit, and enforce the requirements set. The proposal is to incorporate this fee into the
Miscellaneous Fees Schedule.
Categorical Exemption/Environmental Determination

This is an existing fee for the environmental review required for each development project. The proposal is

commissions to prepare and maintain meeting agendas and minutes. The proposal is to set standard
subscription fees for City agendas and minutes and incorporate them into the Miscellaneous Fees Schedule.
The fees are based on the cost of producing copies of agendas and minutes, including labor and postage.
City Council agendas and minutes have higher subscription rates because they typically contain more pages
as they cover a broader range of issues compared to the more specialized focus of boards and commissions.

This is an existing fee that pays for connection to the public sewer system. The fee defrays the cost of sewer
replacement and repair to meet the added demands to the sewer system generated by redevelopment and new
development. The fee rate is based on the cost per plumbing fixture unit in the proposed development and is
paid at the time of application for a sewer connection permit. The proposal is to adjust the fee by $1.61 to
reflect the 2.7% CPI increase in service cost and incorporate it into the Miscellaneous Fees Schedule.
8) Metered Water Rates

Per hundred cubic feet
The City owns and operates the local water utility and charges customers for water usage. One unit is equal to a
hundred cubic feet or 758 gallons, and Santa Aha households average less than 44 units of bi-monthly water
usage. A bi-monthly cycle is used because water bills are mailed out and due every two months. The base rate is
charged to a customer whose bi-monthly usage is 44 units or less. A customer whose bi-monthly usage exceeds
44 units pays the tail block rate. The water rate adjustment has two parts. The first part is the $0.011 commodity
adjustment for each rate, which requires no Council action as this is already authorized by Resolution 92-043.
This 1992 resolution gives the City continuing authority to recoup the cost of pumping ground water from City
wells and buying water from outside sources. The second part of the rate adjustment, and which requires Council
action, consists of the 2.7% CPI cost increase of providing metered water service, the federally-mandated
increases in the City's cost share of the National Pollution Discharge Elimination System, and capital outlay
funding requirements. The proposal therefore is to adjust the base rate by $0.052 or 5% and the tail block rate by
$0.066 or 5% which would mean a $2.78 increase on a typical bi-monthly water bill of 44 units. The adjusted
rates are also proposed to be incorporated into the Miscellaneous Fees Schedule.
9) Research Fee
Existing Fee: $15.00 per newspaper article
Adjustment: $15.00 per use
Department: Library
The proposal is to change the name of the existing fee from %lewspaper Search Fee" to "Research Fee." The
current name does not reflect other research requests the Library responds to in addition to newspaper
searches. These other requests include online and database searches, use of "behind-the-desk" materials, and
personalized stuffassistanee. The fee remains the same.

10) Video Cassettes (Entertainment) - Rental

A rental fee is currently applied to all videos regardless of category: instructional, nonfiction, and
entertainment. The proposal is to eliminate the rental fee for instructional and nonfiction videos and charge
only for entertainment videos. Instructional and nonfiction videos are predominantly used by teachers and
students; a rental fee tends to discourage the use of these educational materials. Providing instructional and
nonfiction videos free of charge reinforces the City's goal of "Education First."
