The meeting was called to order at 7:30 p.m. in the Council Chambers~ 217 North
Main Street. Roll call was answered by Councilmen Harry H. Harvey, ~ames
Gilmore, Henry H. Schl~eter, and Vice Mayor Royal E. Hubbard. Mayor A. Allen
Hall was absent. Following the Pledge of Allegiance to the Flag, the Invocation
was delivered by the Reverend Daniel Rider, First Baptist Church.

seconded by Councilm-~ Schlueter and carried~ the letters were received and

Dale Hein]~v, 611 W. 8th Street, attorney representing the appellant, submitted
letters favorin~ the variance from Fred B. Woc~lworth, o~aer of property at 1241
Camden Place, 1243 and 1241 Glenwood Place, J. A. Sim% 1301 St. Anne Place,
and from W. C. Porter, 1237 C~en Place. On motic~ of Councilman Harvey,
seconded by Council-~- Schlueter and carried, Council received and ordered
filed the c~-,uications.
Mr. Heinly stated that substantial rights were being denied this property
owner, citing other applications approved in the area such as the tailor shop
and barber shop, and submitted pictures of the establishments and perking
required of them and of subject property. On motion of Couuc~lma~ Gilmore,
seconded by Council,m- Harvey ~ carried, Council received and ordered filed
the pictures.
Ralph Seedy, 1306 Glenwood Place and Mrs. Florence Forrest spoke in oppositien
to the gr~nting of the variance. The pl~,~ Director explained that the
pl~n~ing C.-~-.-ission felt there were no special hardships to the property, that
80% of the lot would be used for parking, noted it would be combined use of
residential and liquor store use, and that under the Municipal Code~ a sign
3~ feet high could be built. There being no further testimony, the hearing
was closed.
It was moved ~y Councilman Harvey, seconded by Councilman Schlueter, that the
City Council uphold the decision of the Pls~t~E C~,=aiasio~ and instruct the
City Attorney to prepere a resol'.,tion denying Variance 1851. On roll call

HEARING - APPEAL Vice Mayor Hubbard opened the hearing on

Applicatio~ 18~8 to construct three four-unit apartment buildings c~ R 2
proper~y on the north side of McFadden between Shelton and Baker.
The Clerk reported that notice of the hearing was given by the Planning Depart-
ment with evidence on file, and that no written c..--..~ications or objections
had been received.
Council heard James Rourke, ~00 N. ~ondway, attorney representing the
applicant, cite traffic on McFadden as inccmrpatible with residential usage;
and noted public facilities such as sewer and water ~es were larger than
for multi-f~m~y develol~aent within two blocks. A plan of the pro~ect sub-
mitted to the Council was received an~ ordered filed o~ motion of Ccyancilm~
Schlueter, seconded by Counc~ma~ Gilmore and carrie~.
E. W. Morrisc~, 1101 W. McFadden, L. C. Clark, 1116 W. McFadzlen, and J. S.
Stone, 1117 W. McFadden appeared in opposition to the variance. There be~
no further testimony, the hearing was closed.
On motion of Counc~-mn Harvey, seconded by Counci~-m~ Schlueter and carried,
Council upheld the decision of the Zoning Administrator and instructed the
City Attorney to prepare a resolutien denying Variance 18~8.

Application 1~5 to construct a 203 unit, one and two story apartment ccmplex on
A 1 property at 2827 N. Bristol. The Clerk reported that notice of the hearing
warn given by the Plsxming Department with evidence on file, and that letters of
protest had been received from the following: Arthur M. Bradley, 2321 North
Park Boulevard, Mrs. Russell J. Andersen, 928 Fairbrook TA-e, Mrs. Peter H.
Kauf~--~, 2937 Fallbrook Drive. The letters were received an~ ordered filed on
motion of Councilman Harvey, seconded by Counc~~=~ Schlueter and carried.
John Harvey, 1010 N. Main, attorney representing the appellant, describedI the
surrounding area, noted that opposition in C~ssion hearing was to the general
idea of apartments anywhere in the area citing such things as traffic, school
facilities, etc., ancl called attention to the intention of the developer to
protect the residential neighborhood by an R 1 buffer strip.
LeRoy Rose, 600 N. Euclid, Anaheim, architect, displayed drawings and ~esCrlbed
the project. Mrs. W. J. Richardson, B3~-A Halssworth, property owner in the
area, expressed approval of the application.
W. E. Van Riper, 2902 Fernwood Drive, acte~ as spokesman for about ~00 residents
requesting ~enial of the variance, stating the need to preserve the exclusiveness
of the area, the detriment of increased traffic and overlouded public facilities,
an~ the expenditure of city funds to install an~ maintain them. He also felt
that code requirements ha~ not been net for g~ating the variance.
Douglas Corrigan, 2828 North Flower, opposed the applicatiou, pointing out that
there ha~ been errors in the application and appeal; that the cards sent out called
the area A 1; an~ that the survey was ~naccurate. Janice Boer, 912 North Lowell,
asked if a d/vided highway on Bristol was a part of the Master Plan, noting that
s,,eh coustruction would necessitate more outlay of city money.
The Planning Director noted the Public Works Department ha~ repOrte~ existing
pu~lic service facilities to be adequate to handle this development and that the
driveway entrances ou Bristol woul~l be of same type as a local street. There
be~8 no further testimony, the hearing was closed.
On motiou of Councilman Gilmore, secouded by Counci]maan Schlueter and carried,
the City Council overruled the decision of the P]~-ing C~!ssion and instructed
the City Attorney to prepare a resolutiou approving Variance 18~5, but that the
applicetiou be referred to the Planning Department and Planning C~ssiou for
the appendage of rec~ended conditions.

present.
HEARING - APPEAL 109 Vice Mayor Hubbard opened the hearing
WILLOWICK on Appeal Application 109 filed by
Willowick ~olf Course from the P~-~-ing
C ...... ~ssion' s approval of Variance
Application 18~0 (Goeders and Mark Hospital, Inc. ) to construct a thirty bed con-
valescent hospital for alcoholics at 3217 West ~th Street. The Clerk reported
that notice of the hear~ng was given by the P~-~ing Department with evidence on
file, and that a letter had been filed by Alexander Bowie, attorney for appel~--t,
including a transcript of the hearing before the Planning C~m,~ssiou.
AIexander Bowie, ~01 W. 8th Street, spoke on behalf of George E. Thc'~pson, 91~
E. Buffalo, stating that the facility would not be compatible with the surrounding
area, and that the application di~ not meet the four requirements of the Municipal
Co~e for granting a variance. Vice Ma~or Hubbard stated he had viewed the pr-m~ sss

and iuspected the property in the ~mmediate vicinity.
Eugene TA~$~auser, 131 W. Wilshire, Fullerton, representing the applicants,
stated that the plans had bee~ changed so that the build~n~ would be 35
feet more to the rear of the property, with most of the parking in the front.
He cited exceptional circumstances enjoyed in the vicinity~ hardship being
apparent in the 600 foot deep lot, 5th Street a main artery still to be
developed, frontage insufficient for C 5 development. Mr. Langhauser presented
a petitien signed by seven property owners in the area, stating their support
of the variance and a letter from Judge Morrison supporting such an institution
in the area. The signatures en the petition ware witnessed by Mr. Goeders
who was present and testified to witnessing the signatures. The communications
ware received and ordered filed on motio~ of Councilman Harvey, seconded by
Councilman Schlueter and carried.
Mr. Bowie commented that all lots were of the same depth, that owners in the
area were entitled to see if this proposal will be contrary to the General
Plan. There being no further testim~, the hearing was closed.
On motion of Councilman Harvey, seconded by Councilm-~ Schlueter and carried,
the City Council upheld the decision of the Planning Commissio~ and instructed
the City Attorney to prepare a resolution approv~8 Variance 1850.
HEARING - APPEAL Vice Mayor Hubbard opened the hearing on
110 - CO~.~. Appeal Application 110 filed by Walter W.
and Matryce H. Cole appealing the exclusion
of the service station by the Pl-~ning
C~ssien in its approval of Variance Application 1813 to construct a shopping
center and service station en R 1 property located en the south side of Fifth
Street between Newhope and Mountain View Streets. The Clerk reported that
notice of the hearing was given by the Plan~n_m Co, w,~ssion with evidence on
file, and that no written communications or objections had been received.
Walter Cole, 501 W. 19th Street, appeared in support of his application, dis-
playing architect's drawings and photos of property.
Dale Heluly, 6TM W. 8th Street, attorney speaking for home owners on Mountain
View and Newhope, in opposition, stated that the pla~ was disproportionate to
the size of the property.
J. B. Edsembauser, ~J~09 W. 5th Street, and Alice Waite, 117 N. Mountain View,
spoke in opposition to the appeal. There be~ no further testimony, the
hear~ was closed. It was moved by Councilman Harvey, secended by Council-
~a~ Gilmore and carried, that the City Council overrule the decision of the
Planning C~m.,~sien and instruct the City Attorney to prepare a resolutic~
approving the service station in Variance 1813, subject to applicable condi-
tions.

TRASH TRAI~FER Council heard the City Manager's report
regardin~ the trash transfer station in
Montgomery Park, in which he stated the
Orar~e County Health Department has
declared the facility does not at the time constitute a public nuisance but
they will keep close surveillance on it; that it is operated on a month to
month lease basis and the owner has plans to change the use.
J. T. Davis, 935 S. Laurel, Mrs. Martin Pauley, 361~ Roberts Drive, E~ith Wright,
3420 ~. Roberts Drive, Mrs. Davis, 935 S. Laurel, Martha Nelson, 939 S. Laurel,
and Mr. Davidson, 918 S. Jackson, described the unsatisfactory condition of the

a midblock crosswalk in front of Adams
School for the following reasons:

it would terminate at a sidewalk which is entirely protected by a wall; there
are already crosswalks at the intersection of St. Gertrude and Raitt end at
Warner and Raitt, one of which the children would have to pass to get to proposed
walk; the crosswalk would be a surprise to drivers; end the children woul~ have
a false sense of security.
