HomeMy WebLinkAbout2001-025 - Board's Test Pilot Program for Business License ReportingRESOLUTION NO. 2001-025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING THE CITY OF SANTA ANA TO ENTER INTO AGREEMENTS PROVIDING FOR PARTICIPATION IN THE CALIFORNIA FRANCHISE TAX BOARD'S TEST PILOT PROGRAM FOR BUSINESS LICENSE REPORTING BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby, finds, determines and declares as follows: California Revenue and Taxation Code § 19556 mandated that cities report certain business license information to the State in order to identify self-employed individuals who were not filing required income tax returns. City of Santa Aha ("City") employed the services of MBIA Muniservices to provide the required information to the Franchise Tax Board. The legislation was repealed effective July 1999. Following the repeal, California eliminated funding from the State Budget that went to cities for providing the business license information. The 2000/2001 California State budget appropriated funds for the Franchise Tax Board to conduct a pilot program to contract with cities to provide business license information to the State. The City of Santa Ana was selected to participate in the pilot program. Participation in the pilot program requires that the City provide the State with a copy of a resolution of the local governing body which by law has the authority to enter into the pilot program. City shall contract with MBIA Muniservices to provide business license information to the Franchise Tax Board on behalf of the City. Section 2. The City Manager, or his designee, is authorized to enter into agreements providing for the participation in the California Franchise Tax Board's Test Pilot Program for business tax reporting. Section 3. Appoint the City Manager, or his designee, as agent for the City of Santa Ana to conduct all negotiations, execute and submit all documents, including but not limited to applications, agreements, amendments and payment requests which may be necessary for the completion of the aforementioned agreement.
