A RESOLUTION APPROVING THE SUMMARY VACATION
OF A 5.83 FEET WIDE BY 102.00 FEET LONG PARKWAY
STRIP OF BAKER STREET BE'rVVEEN RIVIERA DRIVE
AND SANTIAGO CREEK

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Aha hereby finds, determines
and declares as follows:
The City of Santa Ana intends to vacate a 5.83 feet wide by 102.00 feet
long parkway strip of Baker Street between Riviera Drive and Santiago
Creek (Exhibit A) pursuant to and in accordance with the provisions of
Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the
State of California.
The vacation of the 5.83 feet wide by 102.00 feet long parkway strip of
Baker Street between Riviera Drive and Santiago Creek is a summary
vacation because the parkway lies within property under one ownership
pursuant to the provisions of section 8334 of the Streets and Highway
Code of the State of California.
Mr. Wilkinson, the applicant, is currently remodeling his home's kitchen at
1151 Riviera Drive. He desires to build an exterior landscaped courtyard
next to the new kitchen bay window, which is adjacent to the property line.
The summary vacation is necessary in order to meet the five feet setback
requirement (Exhibit 1).
The parkway strip of Baker Street to be vacated is not necessary for traffic
circulation.
Pursuant to the provisions of section 892 of the Streets and Highway
Code of the State of California, the parkway strip of Baker Street is not
useful as a nonmotorized transportation facility, as defined in section 887
of said Code.
The parkway strip of Baker Street to be vacated contains no existing
overhead or underground utilities.
All affected utility companies have been contacted and do not object to the
vacation.

H. It is unnecessary to reserve and easement for public services purposes or _
for future street or alley purposes.
Section 2. The City Council of the City of Santa Ana hereby approves the
summary vacation of the 5.83 feet wide by 102.00 feet long parkway strip of Baker
Street between Riviera Drive and Santiago Creek.
