A RESOLUTION APPROVING THE SUMMARY VACATION
OF A PORTION OF AN ALLEY, 200 FEET LONG JUST
SOUTH OF THIRD STREET AND EAST OF MAIN STREET

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1, The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:
The City of Santa Ana intends to vacate a portion of an alley, 200 feet
long, just south of Third Street and east of Main Street, as evidenced in
Exhibit A attached hereto and incorporated herein by this reference as
though fully set forth, pursuant to and in accordance with the provisions of
Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the
State of California.
The vacation of the portion of an alley, 200 feet long, just south of Third
Street and east of Main Street is a summary vacation pursuant to Street
and Highway Code §8334 because the alley is an excess right-of-way of a
street or highway not required for street or highway purposes.
The 200 foot portion of the alley south of Third Street and east of Main
Street to be vacated is not necessary for traffic circulation.
Pursuant to the provisions of § 892 of the Streets and Highway Code of
the State of California, the 200 foot portion of the alley south of Third
Street and east of Main Street is not useful as a nonmotorized
transportation facility, as defined in section 887 of said Code.
The 200 foot portion of the alley south of Third Street and east of Main
Street to be vacated contains no existing overhead or underground
utilities.
All affected utility companies have been contacted and do not object to the
vacation.
It is unnecessary to reserve and easement for public services purposes or
for future street or alley purposes.
Section 2. The City Council of the City of Santa Ana hereby approves the
summary vacation of the 200 foot portion of the alley south of Third Street and east of
Main Street.

LEGAL DESCRIPTION FOR VACATION
OF A PUBLIC ALLEY
IN THE CITY OF SANTA ANA, COUNTY OF ORANGE, STATE OF CALIFORNIA
Being the vacation of that portion of the public alley as shown on a map of
the Resubdivision Of Block 7 Of The Town Of Santa Aha recorded in
Book 5, Page 46 of Miscellaneous Maps, records of said Orange County
described as follows:
That portion of said alley north of the north line of Lot 4 of said Block 7
and the westerly prolongation of said line
Reserving therefrom a No-Build easement in favor of the City of Santa
Ana over the northerly portion of said public alley bounded on the south
by the south line of the north half of Lot 7 in said Block 7 and the easterly
prolongation of said south line for the purpose of prohibiting construction
within said easement area of any buildings, as "building" is defined in
Section 203-B of the 1998 California Building Code
Reserving also therefrom a pedestrian egress easement in favor of the
City of Santa Ana over the westerly five feet of the northerly portion of
said public alley bounded on the south by the south line of the north half
of Lot 7 in said Block 7 and the easterly prolongation of said south line for
the purpose of emergency evacuation of an adjoining building
