HomeMy WebLinkAbout2002-007 - John Wayne Airport Settlement Agreement RESOLUTION NO. 2002-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REQUESTING BOARD OF SUPERVISOR APPROVAL OF AN AMENDMENT OF THE JOHN WAYNE AIRPORT SETTLEMENT AGREEMENT CONSISTENT WITH SCENARIO 1 IN EIR 582 bk: 01/24/02 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A= The John Wayne Airport Settlement Agreement (Settlement Agreement) establishes limits on the number of passengers and noise regulated departures consistent with the limited physical facilities at John Wayne Airport (number of gates and the size of the terminal). The County of Orange - through the efforts of the Board of Supervisors ("Board"), Chief Executive Officer ("CEO"), Airport Director ("Director") and Special Counsel ("Counsel") - has strictly complied with the letter and the spirit of the Settlement Agreement. C= A substantial number of residents of the cities of Anaheim, Costa Mesa, Newport Beach, Orange, Santa Ana and Tustin (collectively referred to as the "Corridor Cities") are adversely impacted by noise, air pollution and/or traffic generated by commercial aircraft operations at John Wayne Airport. The County of Orange has, in cooperation with the City of Newport Beach, prepared EIR 582 which evaluates the potential impacts of five "scenarios" (Scenarios 1, 2, 3, 4, and 5) - each of which assumes some increase in the term of the Settlement Agreement, the number of noise regulated departures and the number of passengers. Exhibit A to this Resolution, which is incorporated herein by this reference as though fully set forth, describes Scenarios 1 - 5. E= The elected representatives of the Corridor Cities have determined that an amendment of the Settlement Agreement consistent with Scenario 1 would protect the quality of life and property values of their respective constituents and would comply with federal law. The elected representatives of the Corridor Cities request the Board approve a Settlement Agreement amendment consistent with Scenario 1. Resolution No. 2002-007 Page 1 of 2 Section 2. The City Councils of the Corridor Cities resolve to request that, on February 26, 2002, the Orange County board of supervisors certify EIR 582 and approve a Settlement Agreement amendment consistent with Scenario 1. Section 3. This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
