A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF
MISCELLANEOUS FEES FOR FISCAL YEAR 2002-2003
AND REPEALING IN PART RESOLUTION NO. 2001-074
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1: The City Council hereby, finds, determines and declares as follows:

Each year, for the convenience of the public the City Council gathers in a
single document a comprehensive listing of fees and service charges
imposed by the City upon that limited number of persons seeking services
of value from the City, For the public's convenience, various rates
charged for City commodities, such as the water rate, are also included in
this document.
This document is known as the "Miscellaneous Fee Schedule," and is
attached to this resolution and made a part hereof by this reference. Each
proposed charge, fee or service charge for Fiscal Year 2002-2003 is
identified under the column entitled "Proposed FY 02-03 Fee."
As part of approving the Miscellaneous Fee Schedule for Fiscal Year
2002-2003, the various agencies of the City have analyzed the cost to
administer the various programs, activities and applications for which the
City charges, fees or service charges.
In a few, limited circumstances, agencies have determined that the cost to
the City to process or undertake the services set forth in the
Miscellaneous Fee Schedule has increased over the prior fiscal year by
approximately 4% (or 5% for fees for services provided by the Police
Department and Fire Department), so that certain proposed fees for Fiscal
Year 2000-2001 have been increased by this percentage, or by this
amount rounded to the next five dollar ($5.00) amount. These
percentages refiect the salary increase for 2002-2003 negotiated between
the City and various bargaining units recognized under the Meyers-Millias-
Brown Act.
The Council finds that the cost of providing the services set forth in the
Miscellaneous Fee Schedule has risen by 4% (except for fees for services
provided by the Police Department and Fire Department, which the
Council finds have risen by 5%) and that this reflects the cost of

administering certain programs, activities or applications for which the City
levies charges, fees or service charges.

Similarly, in a few limited circumstances, new charges have been added
or existing charges raised beyond this 4% (or for the Police and Fire
Departments, 5%) cost of providing services. In each of these cases, the
Council further finds, determines and declares that such new or increased
charges, fees or service charges do not exceed the City's reasonable cost
to provide the pertinent service, process the specified application or
administer the certain program.
In order to have a single comprehensive document for Fiscal Year 2002-
2003, the majority of fees which are unchanged have simply been
reprinted in the Miscellaneous Fee Schedule. The Council expressly
states that it is not its intention to repeal previously adopted fees and
adopt new fees of exactly the same amount, but is simply repeating these
fees so that the Miscellaneous Fee Schedule can continue to be a
comprehensive source of City fees and service charges.
Based upon the testimony, reports and other evidence submitted on this
matter, this city council makes the above-specified findings.
Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2002-2003 is
hereby adopted. Each fee or service charge set forth under the column entitled
"Proposed FY 02-03 Fee" (except where the fees are set out by row in which case the
fee provided in the row shall prevail), shall be levied until further resolution of this
Council.
Section 3: To the extent that any fee or service charge established pursuant to
City Resolution No. 2001-074 is inconsistent with the fees or service charges
established pursuant to this Resolution, then said Resolution No. 2001-074 is hereby
repealed.
Section 4: If any charge, fee, service charge, section, subsection, sentence,
clause, phrase or word of this Resolution is for any reason held to be invalid by a court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Resolution. The City Council hereby declares that it would have passed
and adopted this Resolution, and each and all provisions hereof, irrespective of the fact
that one or more provisions may be declared invalid.
Section 5: That except as may be stated otherwise above, this Resolution shall
be operative from and after July 1, 2002.

Late Filing Fcc
The Fire Chief shall impose a late filing penalty based on addJfional administrative
costs incurred due to ~he late filing of any business plan, ce~ificafion, or inventory.
Thc amount of such penalty shall be 25% of the fe~ for such filing. Nonpayment
of the fee and penalty shall incur 10% interest on the amount of the billing s~arting
30 days after the date issued.

DEFINITION OF RESIDENT
For Group activities, those groups for which at least 51% of participants
either live or work in the City of Santa Aha, the resident rate shah be applied.
Claases, Leisure, and Instructional
From time to time, privately taught leisure and instructional classes will be
offered by various agency divisions. The announcement of same will be mede
by printed fliers or in the quarterly program booklet mailed to each residence
in the City. Programs so offered will be conducted in a 4-10 week format.
Charges for each cla~s will be established by the Executive Director of Parka,
Recreation & Community Services. The City of Santa Ana will receive 30%
of the total fees collected from each of these leisure or instructional classes.

GENERAL PROVISIONS
Unless otherwise provided, payment of fees and charges as
established herein shall be made to the Executive Director
of the Planning and Building Agency or his/her authorized
tvpresentative at the time of initial application or request for
the permit or service for which a fee is charged or imposed.
Exception: Waiver of Fee
No permit or plan check fees required by this resolution will
be charged for public improvement project~ performed by
with the City of Santa Ava or the Community Redevelopment
Agency of the City of Santa Aha nor for any work performed by
employees of the City in the course of their employment.
However, this fcc waiver does not exempt any party fi.om
obtaining a permit for such work nor exempt such party
conforming to t~ procedures established by the City nor from
compliance with all applicable City and State ordinances
regulating such work.

Any person desiring a grading permit ~quired by the Building
Code, shall, at the time of filing an application, pay a fee of $3.00
towards the State Mandated Training Program and pay a fee
equal to $20.50 plus thc sum of the fees for the work to be done
under the permit as set forth in the following schedule:
