HomeMy WebLinkAbout2002-063 - Approving Tentative Tract Map No. 16307RESOLUTION NO. 2002-063 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING TENTATIVE TRACT MAP NO. 16307 AS CONDITIONED FOR BROOKHOLLOW OFFICE PARK kdo/07/29/02 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: Tentative Tract Map No. 16307 came before the City Council of the City of Santa Ana for a public hearing July 8, 2002. Tentative Tract Map No. 16307 has been filed with the City of Santa Ana seeking to subdivide a lot into 18 developable parcels and five no-build lettered lots. The proposed project, as conditioned, and its design and improvements are consistent with the Professional Administrative Office (PAO) designation of the General Plan and are otherwise consistent with all other elements of the General Plan. The proposed project consists of a tract map to subdivide seven existing parcels into 18 separate parcels and five lettered lots. In addition, the Specific Development plan is being amended to eliminate the five-foot side yard landscape requirement for new subdivisions. There are no new buildings or new building square footage proposed as part of this project. Therefore, there is no change in land uses occurring on this site and the project remains consistent with the Professional Administrative Office (PAO) General Plan designation. Tentative Tract Map No. 16307 will have no adverse affect on the land uses as prescribed by the General Plan. The proposed project, as requirements of the zoning applicable City ordinances. conditioned, conforms to all applicable and subdivision codes as well as other Tentative Tract Map No. 16307 is in keeping with the previsions of Specific Development No. 8 (SD-8), which outlines the allowed uses and development standards for the site. The project has been reviewed by City staff that has found that the project is consistent Resolution No. 2002-063 Page 1 of 6 with SD-8, the Subdivision Map Act and Chapter 34 of the Santa ^na Municipal Code. These provisions pertain to the subdivision of land and development standards for the site. The project site is physically suitable for the type and density of the proposed project. The proposed project will not physically change the character of the existing office park because there are no new buildings or building square footage proposed as part of the project. The office park contains 25 buildings encompassing 399,516 square feet of office and commercial space. The project consists of the subdivision of land only and the amendment of a side yard landscape requirement for new subdivisions. The project will not result in changes to existing structures or intensities prescribed by the City's General Plan. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. The parcel map will not cause environmental damage nor injure fish or wildlife, as the site is currently occupied by commercial structures. In addition, no fish or wildlife was identified as residing on the project site during the environmental review of this project. The design or improvements of the proposed project will not cause serious public health problems. There are no new buildings or building square footage proposed as part of this project and, therefore, no alterations are proposed to the development project that would create public health problems. Approval of Tentative Tract Map 16307 will not affect the health or safety of persons residing in the vicinity since the project does not involve any new buildings on the project site. The project consists of the subdivision of land and waiver of a side yard setback requirement for an existing commemial development. The design or improvements of the proposed project will not conflict with the easements acquired by the public at large for access through or use of property within the proposed project. Approval of the tentative tract map will not create any conflicts with existing easements found on the site. As a condition of approval of the tract map, Conditions, Covenants and Restrictions (CC&R's) will be approved and will be recorded with the final map. These Resolution No. 2002-063 Page 2 of 6 CC&R's will ensure that the appropriate easements such as access, egress, drainage, utility and other necessary easements are maintained over the 34.7-acra project site. The Mitigated Negative Declaration and Monitoring Program for Environmental Review No. 01-131 was approved and adopted in the Ordinance for Zoning Ordinance Amendment No. 2002-02 adopted this same day. The Request For Council Action, The Mitigated Negative Declaration and Monitoring Program for Environmental Review No. 01-131 and all matters presented to the Council are incorporated herein by this reference as though fully set forth. Section 2. The City Council of the City of Santa Ana hereby, approves Tentative Tract Map No. 16307 as conditioned in Exhibit "A" attached hereto and incorporated herein. Date: Clerk of the Council City of Santa Ana Resolution No. 2002-063 Page 4 of 6 Conditions for Approval for Tentative Tract Mao No. 16307 Tentative Tract Map No. 16307 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the Califomia Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this tentative tract map. The applicant must remain in compliance with all conditions listed below throughout the life of the tentative tract map. Failure to comply with each and every condition may result in the revocation of the tentative tract map. A. Buildinu Division Building Permit #10134810 and 10134811 for the construction of fire rated walls due to the reconfiguration of property lines shall be obtained, and construction completed and finaled prior to the recordation of the final map. B. Planning Division Comply with Development Review Committee comments dated January 16, 2002 for Site Plan Review DP No. 01-54. Project landscaping, including irrigation systems, shall be maintained as one common area under control of the Association for the integrated development. Should any one parcel become vacant, it would be the responsibility of the association to ensure maintenance of that parcel. A separate plan that is fully dimensioned, showing all existing landscape areas for the entire Brookhollow Office Park, shall be approved and recorded as an exhibit of the map so that these landscape areas will remain with the project in perpetuity. All on-site improvements shall be completed and approved by the Planning Division including enhanced landscaping, paving and the planting of additional trees along the 55-freeway prior to final maP approval and recordation. The project shall continue to function as an integrated development. No fences will be permitted across drive aisles for the purpose of creating yard areas for individual parcels. Trees along Grand and Warner Avenues shall be added, per the approved landscape plan, to achieve the spacing required by City landscape codes (one 24-inch box tree for every 25 linear feet of. street frontage). Resolution No. 2002-063 Page 5 of 6 Conditions, Covenants and Restrictions (CC&R's) must be approved by the City pdor to final map approval. The CC&R's should address common area maintenance, drainage, architecture, landscaping, parking, access, circulation, etc., and shall be recorded with the map. o Two copies of the recorded final tract map and City approved CC&R's shall be submitted each to the Planning Division, Building Division and Public Works Agency within 10 days of recordation. The tentative map, final map and all improvements required to be made or installed by the subdivider shall be in accordance with the design standards and specifications of the City of Santa Ana and at the requirements of the State Subdivision Map Act. 10. All development within the area of the map is subject to development and other applicable fees, including permit fees in effect at the time of permit issuance. 11. All development within the area of the map is subject to all design and development standards in effect at the time of building permit issuance. 12. Project landscaping is to be maintained and include the minimum levels of plant material required on the approved landscape plan and installed at the time of final map approval. Mitigation Measures Landscaping on each parcel within the boundaries of the map shall be enhanced and missing shrubbery/plants replaced per an approved landscape plan. All pot holes, raised paving and broken curbs within the boundaries of the map shall be repaired, and parking areas slurry coated and restdped to City standards per the approved paving plan. A minimum of 30 new trees shall be provided in the landscape setback facing the 55-freeway. The trees shall be a combination of Canary Island Pines and Sweet Gum or other variety identified on the approved landscape plan. In addition, trees along Grand and Warner Avenues shall be added per the approved landscape plan to achieve the spacing required by the City's landscape codes. C. Police Brookhollow Drive addresses shall remain in place for those buildings whose primary vehicular access is off Breokhollow Drive. Resolution No. 2002-063 Page 6 of 6
