Main Street. Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Bill Weeda~ Camile Christian Church. APPROVAL OF MINUTES On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council approved as mailed the Minutes of the Regular Meeting of December 21, 196~. BID AWARD - On motion of Councilman Hubbard, WATER PIPE seconded by Councilman Schlueter and carried, Council ordered filed a report of bids received for 18" water transmission pipe for placement in Segerstrom, B~-istol to Flood Control Channel, Spec. 481-28; approved award of the contract to Southern Pipe and Casing Company at unit price; and rejected all other bids. BID AWARD - On motion of Councilmau Hubbard, WATER WELLS seconded by Councilm-~ Schlueter and carried, Council ordered filed a report of bids received for construction of Water Wells 23, 22 and 25 in the northwest area of the city, Spe¢o 64-2; approved award of the contract to Water Well Supply at unit price; and rejected all other bids. HEARING - A.A. 512 Mayor Hall opened the hearing TODD continued from November 2, 1962 on Amendment Application 512 filed by C. W. Todd to amend Sectional District Map 36-4-10 by reclassifying from A 1 to C ~ district property on the east side of Bristol between Memory Lane and Garden Grove Freeway. CITY COUNCIL - 136 - January ~, 1965 William Mo Todd, 1~87~ WoodBury Drive, Orange, on behalf of the applicant, requested that the rezoning be granted because Of hardship to applicant caused by 62~ higher taxes in 1964 o He stated that equitable prices had been offered hcme OWners for their property in order that they could Buy comparable property elsewhere; that it is difficult to get lessees without the evidence of proper zoning. He also described the advantages of the location in relation to the freeways, stating that the opposition majority is not located within the developmental pattern and would probably not be affected for another five or ten years o Mr. Todd expressed regret that he could not present a written financial commitment to Co~ucil, and introduced Earold Gereton, 1030 No Harbor, Fullerton, a real estate broker, who stated he ccasidered the proposed develop- ment ideally suited for the location, and a firm had been found to do the financing But o~ly an oral c~mmitment was available without the resorting. Ralph G. 0rum, 2733 N. Flower, speaking unofficially for residents living between ~ristol, Flower~ Memory Lane~ dud Orange Road, recalled the petition presented to Co~ucil at the last hearing with 100% signatures of that area~ and read the statement in the petition protesting encroachment into the residential area, increased traffic, loss of Business downtown, and overshadowing of the area by the high rise buildings, and the applicant's refusal to establish a buffer° He quoted from Mr. Tocld's literature, which described the possibility of a tall edifice which, when lighted at night, appeared to float in the sky and could Be seen for five miles; stating that this would affect the hames to the south. Mr° Crum stated that Mr. Todd had failed to follow the Cou~cil's instructions to contact people in the area. He concluded that the area is strictly residential for ten Blocks; that the response to the new Buffer homes in the area is very good; that the applicant was asking for a variance Before he has a zone change; that the ~evelopment would detract fr~a the attempt to Build up downtow~ Santa And an~ southern Santa Ama areas, that rezoning of the 9~ acres only is Being considered and on that amount of land there would be no room for such large buildings. W. W. Morningstar, 27~9 N. Flower, supported Mr. Crum's statement, adding the State had paid To~d $83;000 for access to the north and left him with 231 feet on Bristol. W. E. Van Riper, 2902 ~ernwood Drive, stated that on December 31, 1~6~ the Board of the Villa de Flores Homeowners Association~ of which he is Vice President, decided that since no effort ha~ been made by the applicant to explain his thinking and no indication of financial responsibility ha~ Been me~e, that the Backing of the group should not be given. A protest was circulate~ ~anuary 2, 1~6~, and 72% signed, requesting denial, and in the event of approval that Buffer ~e required and ~dscaping and cul-de-sac Be completed on Orange Road. Mr. Morningstar read the petition's statement, and on motion of Councilman HuBbar~ seconded by Councilman Schluetar and carried, the petition was ordered filed o Raymond Ball, 2755 N. Flower, unofficially speaking for Dr. Crum's group, s,,-a-rized previous action and petitioue received, and mentioned the years of expense Borne by residents to build up their property, statiu~ that firm evidence of financial backing should have Been shown, with at least a letter. of intention. Richard Easter, 2720 Freeman Lane, protested that the Beautiful view of mountains would be destroyed by a high rise development. Burr Campbell, ~720 1~o Olive Lane, Realtor, also spoke in protest. ~n rebuttal, Mr. To~d stated that in the Master Plan the area was tentatively zoned retail commercial; that reference to sales in ~estwood Estates was unfounded as the property was recently sold in lieu of foreclosure; that a buffer zone would Be acceptable if development were not required ~mmediately~ and that there would be underground access and par~g entirely. There Being no l'~rther testimony, the hearing was closed. Upon question by Counci~=-~ Gilmore, Will Teeter, Assistant Planuer, stated that the access on Bristol was By easement owne~ By State and he did not know if it had been declared surplus. Mr. Todd stated he felt it would be on request by City. DIST. 221 Mayor Hall opened the hearing on proposal to include certain additiOnal territory in Assessment District 221 as proposed in.Resolution 6~-185 adopted December 7, 1~6~. The Clerk submitted Affidavit of Publication of Resolution 6~-185; Certificate of Nail!n~=, Resolution 6~-185; and Written Consent of contractor to the change. On' motion of Counci1,~ Gilmore, seconded by Council- man Hubbard and carried, Council ordered the documents filed. Franklin T. Hamilton, Special Counsel for the City, explained the purpose of the hearing and described two parcels proposed for inclusion at the northwest corner of McFadden and Newhope. The Public Works Director indicated Parcels 57 and 58 on the map, stating that there had been an existing sewer in McFadden into which Parcel 57 could be drained but that Parcel 58 could not be drained into the McFadden sewer. Mr. Hamilton therefore recommended that the Council adopt a resolution including the smaller parcel on Newhope and excluding the larger parcel at the latereection of McFadden and Newhope from Assessment District 221. Dale Eeinl~, 611 W. 8th, attorney representing Joseph Serna, ~wner of Parcel 57, agreed to its exclusion. The Clerk reported that no written protests had been filed. There being no further testimony, the hearing was closed. On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council instructed Mr. Hamilton to prepare a resolution authorizing payment of $~,256.06 for off site sewer, being a contribution against the project as a whole. NEARING - Mayor Hall opened the hearing on STREET VACATION Resolution of Intention 6~-195 to vacate a portion of Edinger Avenue at the southwest corner of Flower and Edinger. The City Attorney stated that notice of intention to realign the boundaries had been published as the only requirement, that there was no valid map until one was adopted by the Council, amd that it was his obligation to have the ordinance prepared for the Council even without their specific authorization since they havm the option of changing it or not adopting it. ABANDONMENT Dale Heinly, 611 Wo 8th, attorney represent- ing Wilshire Oil Compsu%y, spoke regarding the Company's request for abandonment of a portion of Chestnut Avenue at Grand, noting their problem of having to construct curb and gutter at a location which would not conform to the future alignment of the street. The City Manager stated the City did not wish to interfere with development of the property and suggested Council postpone action on the report rec~maending denial of~ the abandonment until the next meeting, during which time the staff would meet with Wilshire representatives to discuss the problem° 0~ motion of Counc~m-n Hubbard~ seconded by Councilman Schlueter and carried, Council postponed until the meeting of January 18, 1965, action on the request for abandonment of a portion of Chestnut Avenue at Grand. INAUGURAL BAND On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council ordered filed a request for a contribution by Band Boosters for the Dos Palos High School (Marced County) in order to make trip to represent California at the inauguration ceremonies on January 20, 1965. CROSSWALK On motion of Councilman Hubbard$ seconded by Councilmau Harvey and carried, Council referred to City Manager for investigation and report a request frnm Tax Audit Bureau, 727 S. Main, for crosswalk across Main at Richland.
