Roll call was answered by Councilmen Royal E. Hubbard, Harry H. Harvey, James Gilmore, Henry H. Schlueter, and Mayor A. Allen Hall. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Ralph King, Johnson Chapel, Methodist Church. APPROVAL OF MINUTES On motion of Councilman Hubbard, seconded by Councilm-B Schlueter and carried, Council approved the Minutes of the Regular Meeting of March 15, 1965, and the Special Meeting of March 26, 1965. POLICE DEPARTMENT Councilman Harvey outlined a ten point INVESTIGATION program which had been negotiated by Councilmen Harvey and Gilmore and City Manager Thornton, designed to review, rehabilitate and reconcile differences in the Police Department, the highlights of which are: review of existing procedures and policies; new Police Department Manual, spirit of reconciliation with no retribution or further attempt to place blame; privileges of their rank for reinstated personnel; devotion of the Chief of Police to strengthening the department; a five-man Police Review Hoard; re-evaluation of in-service training; Manager to keep Council informed as to progress and success of the program. INTRODUCTIONS Mayor Hall introduced the wives of retiring Council members Hubbard, Schlueter and Hall. He then had all Candidates for Council present introduce themselves to the audience. BID AWARD - On motion of Councilman Hubbard, seconded WELL 16 by Councilman Schlueter and carried, Council ordered filed a report of bids received for construction of improvements to Well 16, Spec. 65-2; approved award of the contract to E. H. Applegate Company at unit prices; and rejected all other bids. BID AWARD - On motion of Couacilm-u Hubbard, seconded ALOHA PARK LIGHTING by Councilm-~ Schlueter and carried, Council ordered filed a report of bids received for installation of lighting facilities at Aloha Park Ball Field and letters of protest frmm Freda Hiner, and Wanda Nollaway; approved award of the contract to Allen Engineering Co. in the amount of $10,980; and rejected all other bids. BID AWARD - On motion of Councilman Hubbard, seconded CONCESSION STANDS by Councilman Harvey and carried, Council ordered filed a report of the bid received for construction of two concession stands at the Municipal Stadium, Spec. 691-20; approved award of the contract to J. Ogden Markel in the amount of $8,868.00; and rejected all other bids. ~rUI. 5, 1965 B~JIIDING CODES The continued hearing was opened on ORD. On motion of Co-~cilman GiLmore, seconded by Councilman Hubbard and carried, Council directed the Building Department to advise the various trades periodically of materials which are being considered as alternative materials for use in construction in Santa Ann. HEARING - APPEAL 156 (V~A. 2090) of Variance 2090 Hearing was opened on Appeal 156 filed by David N. Hartman, Francis M. Kinney and Bill Eo Perry protesting the Planning Commission's approval filed by Allison Honer Co~ to utilize property as an off-street parking lo~ at 1000 W. 18th~ i~e Clerk reported that notice of the hearing was mailed to adjacent property owners on March 25, 1965 as required by law~ that petitions signed by 47 persons and 24 persons, protesting granting of the variance had been received° On motion of CounciLman Hubbard~ seconded by CounciLman Schlueter and carried~ Council ordered the petitions filed. David Hartman~ 940 W. i9%h~ spokesman for protestants expressed concern over the interpretation of the zoning law, stating the applicant at the time of purchasing the property, was aware of the zoning~ and that no hardship existed. Richard Honer of Allison Honer Co~, stated that hardship existed because of the isolated location; that access was requested through an alley and not through the neighborhood. Bert Renes, 1013 Wo 18th, stated that the alley traffic was already a problem; that he could use only one half of his two car garage because of the congestion. There being no further testimony: the hearing was closed° On motion of Councilman Harvey, seconded by Councilman Hubbard and carried~ Council overruled the action of the Planuing Co~mission and instructed the City Attorney to prepare a resolution granting the appeal and denying Variance 2090° HEARING - Hearing was opened on Appeal 157 APPEAL 157 filed by Ila Eo Bryant appealing (V.A. 2087) Zoning Administrator's denial of Variance 2087 to construct two 4-plex dwelling units on two R 2 lots at ll04 West Third. i~ayor Hall stated that the Planning Commission had requested the matter be referred to them since the appeal was filed prior to their having opportunity to review Zoning Administrator's decision° CITY COU~'CIL - 204 ~ April 5, 1965 The Clerk reported that notice of the hearing was mailed to adjacent property owners as required by law on March 25~ 1965; that no communications other than from the Planning Commission had been received. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried, Council referred the matter to the Planning Commission. HEARING - Hearing was opened on Amendment Application AMEND~ APP~ 5~0 540 filed by Co W. Todd proposing the amendment of Sectional District Map ~6-4~10 by reclassifying from A i to the C 4 and LP districts, property on the east side of Bristol between Memory Lane and Garden Grove Freeway° Planning Commission Resolution 5725 recommended denial. The Clerk reported that notice of the hearing was published in The Register onMarch l~, 1965 and that no written communications had been filed. William Mo Todd, representing the applicant~ stated that the proposed plans were the only reasonable usage of the land; that because of the location near the freeways and frontage on Bristol~ it was undesirable as residential property. He reviewed a questionnaire he had sent to homeowners, 25 of which had been returned~ indicating that 21 were members of the Homeowners~ Association; that 77.~ of the 21 stated they had been unable to vote on the issue at an association meeting; 95% returning the forms favored commercial zoning on their own property; 8~% would sign petitions now for com~ercial zoning~ with only 5% indicating opposition to the requested zoning. Mr. Todd then recited to Council the questions he had asked. On motion of Councilman Hubbard, seconded by Councilman Schlueter and carried~ Council ordered filed Mr~ Todd~s report. Raymond Co Ball, 2755 N. Flower~ spokesman for residents in area bounded by Flower, Bristol, Memory Lane and Orange Road, reviewed the petitions in opposition already filed and past efforts he and Dr o Crum had made, noting that he was appearing for the fourth time. He expressed concern over the limited ingress and egress constituting a traffic hazard; urged opposition to commercial zoning and suggested an ad hoc committee headed by the Planning Director and representatives from both sides° Robert Gardner~ 1048 Fairbrook Lane, President of the Villa de Flores Home- oMners Assoco, stated that 95~ of the members favored C 4 development~ but wished to see it done on a sounder basis than that proposed, and suggested a feasibility study. Mr. Gardner then read the heading of a petition signed by 65 members indicating that 5~ disapproved and 12 approved granting of the rezon- ingo On motion of Councilman Hubbard~ seconded by Councilman Schlueter and carried~ Council ordered the petition filed. On motion of Councilman Hubbard, seconded by Councilman Harvey and carried, Council denied the reclassification.
