Recitals: The parties entered into Agreement No A-2002-089, dated June 3, 2002, (hereinafter "said Agreement") by which Consultant has provided soil sampling and analyzing of underground tanks located at City fire stations. Upon performing services pursuant to said Agreement, it was discovered that additional samples and testing were necessary for the underground tanks located at fire stations 2 and 8. The parties now desire to amend said Agreement to increase the compensation to pay for additional services performed pursuant to said Agreement and to extend the term of said Agreement. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2 a., COMPENSATION, shall be amended to read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A. The total sum to be expended under this Agreement shall not exceed $22,901.25 during the term of this Agreement." 2. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on June 3, 2002 and terminate on June 30, 2003, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Fire Chief and the City Attorney." 3. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect. 1N WITNESS WHEREOF, the parties hereto have executed this First Amendment to Consultant Agreement on the date and year first written above.
