OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA, CALIFORNIA
October 4, 1965
The meeting was called to order at 2:00 p.m. in the Council Chamber, 217 N.
Main Street. Roll call was answered by Councilmen James Gilmore, Walter
Brooks, Davis Burk, J. Ogden Markel, Tom McMichael, and Mayor Harry H.
Harvey. Councilman Wade Herrin was absent.

carried, Council approved the Minutes of the Adjourned Regular Meeting
of September 30, 1965.
INVITATION
Municipal Stadium for presentation of
Fire Marshall Bachtelle extended an
invitation to Council to attend the
Fire Prevention Parade to be held
October 9th, which will end at the
awards by Council members.
PARKING DISTRICT It was moved by Councilman Brooks,
seconded by Councilman Burk and
carried, that, for the convenience
of the participants, the report on
formation of a parking district requested by the Parking Development
Committee, Santa Aha Downtown ~ssociation, be considered at this time.
The City Manager stated that valuable assistance could be given by the City
in helping the Santa Ana Downtown Association ronda parking district by
providing forms, data, and personnel services, for $500 to $1,000, but this
would not include circulating the petitions. He reviewed the history of
the northeast parking district.
Lorin Griset, Vice President of the Santa Ama Downtown Association, and
Chairman of the Parking Develoument Committee, stated that apparently the
19~3 law was the most practical means of forming a Parking District, and
the Co~ittee planned to follow this procedure. Mr. Griset described the
tentative boundaries for the proposed district as Flower, First, French,
and Eighth Streets excluding the Civic Center~ concluding that if 61% of
the property owners sign the petition, the committee will come to Council
with a definite proposal.
Joe Gilmaker, 308 W. 4th, submitted to Council a letter requesting his property
be excluded from the project. On motion of CounciLman GiLmore, seconded by
CounciLman Burk and carried, the letter was ordered filed.

Janice Boer, 912 N. Lowell, pointed out that Assembly Bill 103 passed in
May, 1965, provided a law other than the 194~ act, and its use would guard
against use of condemnation; that of the 77 proposed square blocks in the
proposed district, 28 are either used or proposed as civic buildings.
Mr. Griset defended eminent domain, remarking that many of the downtown
properties are held in trust and can only be acquired under eminent domain.
On motion of Councilman Brooks, seconded by Councilman Burk and carried,
Council authorized the Parking Development Committee to proceed in their
attempt to create a parking district, and authorized City to assist with staff
and information in an amount not to exceed $1,000.

five minute recess. The Council
reconvened at 3:35 p.m. with the
same Councilmen present.
PERSONNEL BOARD On motion of Councilman McMichael,

Messrs. Stauffer and Larsen on the Personnel Board~ whose terms expired July 1,

BUSINESS LICENSE TAX A written report of staff study
regarding the Chamber of Cc~merce
proposal to remove the City's business
license tax was not completed, but
the Manager stated it would recc~mend that the tax not be removed and cited
reasons therefor. Chamber of Commerce represent~tivem withheld comment pending
receipt of the written report, which the Manager said would be available in a few
days.
Councilman ~rkel read a statement
urging immediate consideration of a
new City Hall and asked the Clerk to
send copies to each Councilman.
FEE SCHEDULE Councilman Brooks questioned whether
or not the City's fees for variances
and conditional use permits were high
enough to cover costs and asked the
Manager to report on this to Council. The Manager felt the Building Department
fees would about cover operation of the department.

ECONOMIC OPPOR. ACT Dave Dowell~ 12261 Redhill Avenue~
asked for information concerning the
Economic Opportunity Act and the City's
participation in the program. The
Mayor replied that the Council had taken no action in the matter and had little
information on it, but noted that a Poverty Program was being initiated by the
Orange County Board of Supervisors.

The meeting was reconvened at 7:30 p.m. in the Council Chambers, with all
Councilmen present except Councilman Wade Herrin. Following the Pledge of
Allegiance to the Flag, the Invocation was delivered by the Reverend
Robert Shuler~ First Methodist Church.

Dr. John Holiday, 1223 River Lane, speaking for the protestants, requested
a new hearing, stating so many continuances had been granted in prior
proceedings that opponents were not aware a decision would be made on
September 20th.
It was moved by Counc~lmmn McMichaet, seconded by Councilman Gilmore for
discussion only~ that~ the action of September 20th be rescinded and the
matter be referred back to the Planning Co~nission for rehearing and a

Planning C~ission action, precedent factor, and legality of action, the motion
was lost on voice vote.
Inasmuch as the applicant's representative was not present, it was moved by
Councilman Gilmore, seconded by Councilman McMichael, that action on Ordinance
NS-830 be postponed to October 18th at which time arguments will be made solely
on the issue of setting a new hearing. Mayor Harvey noted Council would hear
one representative of the applicant for rebuttal of the opponents' statements.

ING - Hearing was opened on Appeal 166
APPEAL 166 - VA 2170 filed by Donald R. Rochambeau from
the Planning Commission's denial of
Variance Application 2170 to
construct a two story duplex with less than required front and rear yard setbacks
at 2210-2212 Valencia Street in the R 2 district. The Clerk reported that
notice of the hearing had been mailed to adjacent property owners as required
by law and evidence thereof was on file; that a letter favoring the variance
had been received from Hays, 501 E. Buffalo. On motion of Councilman GiLmore,
seconded by Council~n Brooks and carried, the letter was ordered filed.
Donald Rochambeau, 13742 Gilbert Lame, stated he was protesting the Planning
Commission's decision because of their indication that Valencia should be
extended on to his property to the cul de sac; that widening the street would
be costly to the City and more benefit would be derived from taxes on his
improved property. He also commented that adjacent property oWners favored the
Lmprovement. Harold Peck, 2243 N. Valencia, protested the hazard a half street
would cause if the application is approved and suggested purchase of the property
by the City for street widening. There being no Further testimomy, the hearing
was closed.
On motion of Councilman Mc~4ichael, seconded by Councilma~ B~ooks, and carried
by 4 - 2 vote, Council upheld the action of the Planning C~ission and
instructed the City Attorney to prepare a resolution denying Variance 2170.
HEARING - Hearing was opened on Appeal 167
APPEAL 167 - VA 2168 filed by Robert E. Decker from the
Planning Commission's denial of
Variance Application 2168 to
construct a duplex on the rear of an R 1 lot containing two existing dwellings
at 4406 Regent Drive. The Clerk reported that notice of the hearing had been
mailed to adjacent property owners as required by law and evidence thereof was
on file; and that no written communications had been received.
Fred Sawyer, 13111 Chirping Sparrow Way, Tustin, representing the applicant,
distributed plans of the project to Council, showing a change in the building's
position. He explained as a hardship to the owner the large lot which required
much yard care, and presented a petition with about 21 signatures of property
owners who favored the project. On motion of Councilman B~ooks, seconded by
Councilman Gilmore and carried, the petition was ordered filed.
Speaking La opposition, Del Michael, 917 S. Toland, President of the Southwest
Homeowners Association, favored retention of R l, pointing out many in area
wanted to keep horses; Madelyn Cenkar, 806 S. Flintridge Drive, noted other
oversize lots in area would press for duplexes or apartments.
In rebuttal, Mr. Sawyer stated that other owners would not be kept from having
animals, and that the matter should be considered from the standpoint of the
individual involved and not the group. There being no further testimony, the
hearing was closed.

It was moved by Councilman Burk and seconded by Councilman Brooks, that
Council overrule the action of the Planning Cc~mmission and grant Variance

It was moved by Councilman McMichael, seconded by Councilman Markel that
Council uphold the action of the Planning C~mmission and instruct the City
Attorney to prepare a resolution denying Variance 2168.

carried, that the matter be referred to the Planning Department staff for
recommendation as to the desirability of rezoning the area. The motion

HEARING - Hearing was opened on Appeal 168 filed
APPEAL 168 - VA 2166 by Sidney Levin from the conditions
imposed by the Pls~ning Co~ission in
its approval of Variance Application
2166 to permit parking, damaged vehicle storage, and side yard waiver for a
service building at 3712 Hazard in B 2 district. The Clerk reported that
notice of the hearing had been mailed to adjacent property owners as required
by law and evidence thereof was on file; and that no written communications
had been received.
Dale Heinly, 611 W. 8th, representing the applicant, stated the Planning
Commission had imposed conditions on adjacent property not a part of
application. He suggested that applicant was willing to dedicate Harbor
with no improvements, dedicate Hazard to Figueroa including spandrel~ and
dedicate Figueroa; and asked City to impose conditions of improvement only to
existing pavement. The Manager stated staff's acceptance of compromise. There
being no further testimony, the hearing was closed.
On motion of Councilman Brooks, seconded by Councilman GiLmore and carried,
Council instructed the City Attorney to prepare a resolution granting the
appeal amd modifying the conditions of Variance 2166 to require dedication
of all areas requested and all improvements up to existing streets.
RECESS
At 9:00 p.m. the Mayor declared a five
minute recess. The Council reconvened
at 9:08 p.m. with the same Councilmen
present.
TRAFFIC HAZARD The City Manager reported regarding a
communication and petition from Ed
Attenborough, 2121 N. Edna Drive, asking
improvements of south half of West
Edna Drive at Lewis; stating that a written request to the County Supervisors
for an easement to even out the width of the street would be submitted, and
if granted the street would be improved on a mini~l level to provide traffic
safety.

City Manager' s Surplus Property
Report 55-65 regarding irregular parcel south of McFadden, west of River,
declared the property surplus and of value only to adjacent owner because
shape precludes use as separate parcel, and authorized sale to adjacent
owner.
Del Michael, 917 S. Toland, asked that Council and staff notify Southwest
Homeowners Association of any surplus property in the area suitable for play-
ground purposes.

STREET CLOSINGS Councilman Markel discussed the
proposed closing of Talbert and
Alton Streets and the effect on
traffic from Huntington Beach.
The City Manager stated that an extensive report on the matter would be coming
to Council from the Planning Cnmmission.
HARBOR CLIPPINGS In response to a request from
Councilman Markel that the Mayor
instruct the Clerk to furnish him
with two copies of Harbor District
clippings and material, Mayor Harvey stated he was certain the Clerk would
furnish information on any subject for any Councilman upon request.
