Roll call was answered by Councilmen Wade Herrin, Walter Brooks, Lorin Griset, J. Ogden Markel, Thomas W. Thurman and Mayor Tc~ McMichael~ Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Director of Planning Paul Van Stevens, and Clerk of the Council Doris M. Brown. APPROVAL OF MINUTES On motion of Councilman Brooks, seconded by Councilman Herrin and carried, Minutes of the Regular Meeting of Ma~ 1, 1967, were approved. EXECUTIVE SESSION At 2:05 P.M., the Council adjourned to Executive Session for approximately one hour. The Council reconvened at 3:00 P.M., with all Councilmen present. '~ The M~vor called for nominations for COUNCIL APPOIF~ME~T ~ ~ ~o the Council vacancy in Ward Five. Councilman Herrin placed the name of James Carlson in ncmimation. Councilman Markel placed the name of Waldo Haug in nomiuation. On motion of Counci~w~ Herrin, seconded by Councilman Griset and carried, the nominations were closed. GRAND AND DYER I~W CO~NER A letter was presented from Mobil Oil ANNEX - MOBIL OIL CORPo Corporation requesting annexation to the City er agreement with the City for annexation of their property at the northwest corner of Grand and Dyer° Mr. Harold McClard and Mr. Andy Hedblom spoke on behalf of the request. The City Manager explained Council's prier denial unless the request covered Holly Sugar. Company property and surrounding property. After some discussion, on motion of Councilman Griset, seconded by Councilman Brooks and carried~ the matter was deferred until the next Council meeting. Mayor McMichael appointed a co~nittee of Councilman Herrin, Councilman Griset and himself to study the request. TORT RET.EASE AND CML DEFENSE The Manager's report recommending that the Finance Director be authorized to sign tort releases and recommending that the Assistant City Manager be appointed Assistant Director of Civil Defense, to serve: without additional compensation, was approved as rec- co~m~ended on motion of Councilman Herrin, seconded by Councilman Griset and carried. STATE LEGISLATION On motion of Councilman seconded by Councilman Griset, C~uncil adopted resolutions opposing Senate Bills 10~4 and 413 regarding parking a~l business improvement areas, Assombly Bill 369 regarding apprenticeship training - municipal employees, and Assembly Bill 1419 regarding public buildings - handicapped persons. CIT~ COUNCIL -187- ~ay 15, 1967 HONORARY CITIZENS Mayor McMlchael presented the three students studying in Santa Aha under the American Field Service Program with proclamations declaring them honorary citizens. Giovanna Fattovieh from Italy, Grace Perrone from Argentina, and~ Aki Nanko from Japan were also presented with Keys te the City by the Mayor. CERTIFICATE~ OF APPHECIATION after sixteen years of service. Mayor McMichael presented a Certificate of Appreciation to Homer Sterling, Assistant to the City Manager, retiring S?JRPIJJS PROP~t~I'~' SALE The Mayor announced the sale of real property described in Report 30-66 consisting of an irregular area cou- taining 8,514 square feet at the southwest corner of Bristol and Eighth~ stating a minimum price of $B5,000.00 had been set on the property. The Assistant Clerk reported that no sealed bids had been received. The City Manager stated that an offer had been made through Warren Proctor, realtor, acting as agent for a buyer, in the amount of $35,000.00, and that a deposit of $4,000.00 was on file. The Mayor called for additional bids. After three calls with no response, the property was declared sold for $35,000.00 to W. A. Tedford. TAXI OPERATOR APPEAL Hearing was opened on an appeal filed by Clara Gryner from the Police Chief's denial of a permit to operate a taxi- cab. The Assistant Clerk reported that notices were mailed as required by the M~nicipal C(Eie. The applicant was not present. The City Manager rec- c~mmended denial of the pemit. There being no further testimony~ the hearing was closed. On motion of Councilman Thurman, seconded by Councilman Griset and carried, hhe appeal was denied. INSTAIJ~ATION OF JAMES Eo CARLSON Oath of 0ffi~e was administered by COUNCILMAN, WARD FIVE the Assistant Clerk of the Council to the newly appointed Councilmau from Ward Five, James E. Carlson. Counc~lm~n Carlson was welcomed to the Santa Ana City Council and took his seat at the Council table. DOOR-TO-DOOR SOLICITING ~ne Mayor explained that the Council is considering regulation of door-to- door soliciting with the possiblity of adopting an ordinance in regard to this. Answering a question from Council- man Brooks, the Attorney explained that unless solicitors are engaged in interstate commerce, a business license is required for solicitors if they have a place of business in the City. The following people spoke from the audience in opposition to an ordinance prohibiting door-to-door soliciting: Sol Herschon, 9042 W. 24th St., Les Angeles~ Legislative Representative for California Credit Merchants Association; Sam Norantello, Kirby Vacuum Dis- tributor in Santa Ana; Harold Rose, President, Wholesale Building Materials Company in Los Angeles. Mr. Fred Olson, 826 So Raitt, Apt. i and Mrs° Jan Brown, 902 S. Elliott, spoke in favor of adopting an ordinance to regulate soliciting. CITY COUNCIL -188- May 15, 1967 The City Manager suggested the p.essibility of having an ordinance which w~uld provide the opportunity for people who do net wish to have solicitors come to their door to have a sign stating this, making it a mis~-~anor for a solicitor to disregard the sign. The question of sales tax was discussed. The City Manager eXPlained that the amount of sales tax ~erived fr~a de,r-to-deer soliciting in Santa Ana is very large; the City receives sales tax o~ any item purchased in the City. Councilman Markel suggested that the hours of solicitatima could be restricted, soliciting not to he allowed between the h~urs of 9:00 P.M. a~ 8:00 A.M. Councilman Nerrin moved that the request to consider proposed regulation of door-to-door soliciting be denied; the motiau was secouded by C~%mc~u- Brooks.
