SECOND AMENDMENT TO AGREEMENT
N-2002-124
THIS SECOND AMENDMENT TO ,CONSULTANT AGREEMENT "Amendment,"
made and entered into this I -'1~ day of <d~'n~002, by and between the City of Santa Ana,
a charter city and municipal corporation duly organized and existing under the Constitution and
the laws of the State of California ("City") and Santa Ana College ("Consultant").
WITNESSETH
Recitals:
A. City and Consultant entered into a Consultant Agreement, dated December 29,
2000, by which Consultant agreed to provide educational services to inmates housed in
the Santa Ana Jail (the "Agreement").
B. City and Consultant entered into an Amendment to Agreement, dated May 24,
2001, to extend the term and increase the amount of compensation ("First Amendment").
C. The parties now desire to enter into another amendment to extend the term and
increase the amount of compensation.
WHEREFORE, in consideration of their mutual and respective promises, and subject to
the terms and conditions of the Agreement as hereby amended, the parties hereby agree as
follows:
1. Section 2(a) of the Agreement is amended to read as follows:
"a. City agrees to pay, and Consultant agrees to accept as total payment for its services,
the rates and charges identified in Exhibit A. The total sam to be expended under this
Agreement, shall not exceed $ 6500.00 during the term of this Agreement."
2. Section 3 of the Agreement is amended to read as follows:
"This Agreement shall commence on the date first written above and terminate on June
30, 2003, unless terminated earlier in accordance with Section 12, below. The term of
this Agreement may be extended upon a writing executed by the Chief of Police and the
City Attorney."
3. Except as hereinabove modified, the terms and conditions of the Agreement and
the First Amendment remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to
Agreement the date and year first above written.
