Roil call was answered by Councilmen Wade Herrin, Walter Brooks, James E. Carlson, Lorin Griset, J. Ogden Markel, Thomas W. Thurman, and Mayor Tom McMichael. Also present were Assistant City Manager Bruce Spragg, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Senior Planner Steve Lafer, and Clerk of the Council Doris M. Brown. APPROVAL OF NINUTES 1967, were approved. On motion of Councilman Markel, seconded by Councilman Herrin and carried, the Minutes of the Regular Meeting of July 3, ASPHALTIC SLU1LRY SEAL On motion of Councilman Herrin, seconded by Councilman Griset and carried~ Council ordered filed report of bids received for Spec. 271-102, Asphaltic Slurry Seal; awarded contract to the low bidder, Asphalt Coating Company at unit prices; and rejected all other bids. FIRE BOSE ~?~ ~' On motion of CounciLman Griset, seconded by Councilman Herrin and carried, Council ordered filed report of bids received for Spec. 6~1-116, Fire Bose; awarded ccmtract to the low bidder, Albro Fire Equipment Company at unit prices; and rejected all other bids. UNtFORM RE~TAL c~ ~ It was moved by Councilman Brooks, seconded by Councilman Herrin and carried, that the request from Boss Overall Supply Co. to assign the contract for uniform rental to Prudential Overall Supply be granted, and the assignment accepted. BROADWAY SEWER ~'/'' On motion of Councilman Brooks, seconded by Councilman Herrin and carried, Council approved plans and specifications and authorized advertising for bids for Project S-51 - Sewer in Broadway from 19th to Charlotte, opening August 15, 1967. Councilman Markel expressed his disapproval of Ordinance NS-886, stating that area has been designed in the Master Plan and accepted as such for R i zoning~ and he thought it should be maintained as R i zoning. Mayor NcMichael read a letter from the State Highway Division regarding freeway signs, and noted that we appeared to be making some progress. Hal Winter, of the Downtown Santa Ana Associati~, said that the devel~ent of the Civic Center is most important and should be recognized in the freeway signing and the Association ~ould like to have the Council support the Association in this respect by requesting this from the State.' He also stated that if Santa Ana is only allowed one sign that this recognition should be left at ~th Street;they believe that if this is moved, it shoul~ be move~ no farther south than McFadden; and that they want to ask for additional recognition at McFadden an~ not at Talbert leaving the sign at ~th also. Councilman Brooks pointed out that there are several problems regarding the subject and he th~ka there should be fu~her study on this. Noting that there should ~e a unified front, rather than having different organizations writing the Division of Highways, ~&yor McNichael suggested a c~ittee be appointed of representatives from the Downto~ Santa Ana Association, the Sou~h Main ~rovement Association, the Chamber of Cce0merce# and the City staff, for a detaile~ analysis and recommendation to the Oouncil. Adams for access rights ~n the north side of Warner Avenue east of Susan (Parcel Map 51~). The Public Works Director explained that this land ~as originally subdivided in 1~62 and it was determined that for the best land use the access streets wo~ld he fro~ the interior of this particular area. C~TY CO~C~L 2~1 July 17, 1~67 ABANDONED CARS Ceuncilmau Herrin said that he has had a request to ask for a discussion on the procedure that might be followed on the disposing of abandoned cars that are left on private property. The City Attorney stated he will check into it to see what procedures are available. SIGN APPLICATION The Assistant City Manager stated that MAIN ST~'.~:~' the Council adopted an ordinance on June 19th which doesn't become effective until Judy 19th regarding projection of signs on Main Street, and that an appli- cation had been received fr~ Mr. Agnew which would be in Violation of this ordinance and which the staff felt would be contrary to the intent that the Council had expressed, and on advice of the City Attorney, the application was denied. After sene discussion with Mr. Agnew, it was moved by Councilman Griset, seco~ed by Councilman Carlson and carried, to support the decision of the City Attorney and staff in denying the application; and the Planning Depart- ment was instructed to bring to the Council a recommended uniform sign ordinance. TRAk'tiC SIGNAL Mrs. Janice Boer stated that there is a problem regarding a traffic signal at the Freeway off-ramp amd 17th Street where there is a railroad blinker in front of the traffic signal. The Public Works Director was instructed to look into the matter. Mayor McNichael expressed the Council's appreciation for their willingness to serve. CITY COUNCIL 242 July 17, 1967 SURPLUS PROPERTY SALE &% ~ The Mayor announced the sale of real property described in Report 14-67 consisting of one parcel 125 ft. x 48 ft. (6,000 square feet) at 412-~1~ Eastwood, at a minimum price of $15,000.00. The Clerk reported that no sealed bids had been received. The Mayor called for oral bids. Maurice O'Connor, Attorney representing Southern Service Company, submitted a bid of $15,000.00, with a letter stating the following conditions: (1) That the City grant a perm.-nent change of zone on the sub- Ject property from R 3 to C 2; (2) That the cc~pany have the right to inspect the covenants, conditions and restrictions of record against the property and the written approval of said encumbrances by the company shall be required as a condition of the sale; (3) That either the improvements on the property be removed by the City at City expense, or that said improvements be permitted to remain on the property for use by ~he Compauy. After some discuss/on regarding the conditions set out in Southern Service Company's proposal, and after a conference between Mr. O'Connor and the City Attorney, Mr. O'Connor stated that Southern Service Company would agree to removing the second and third conditions set out in their letter, and would be willing to purchase the property under the City's Conditions of Sale, subject to rezoning of the property to C 2. Mayor McMichael called for additional bids. After three calls with no response, the property was declared sold for $15,000.00 to Southern Service Company, subject to cb--ge of zone to C 2 and the requirements set out in "Information to Bidders". ~. Dale Heinly, Attorney representing Ralph Mitzel, explained to the Council his client had no objection to the requirement that Bewley Street be a cul- de-sac, they would dedicate all access rights t~ Bewley Street for they intended to use Harbor Boulevard for access; they were willing to have a strip on the southerly and easterly side zoned R 2 B which will limit the use of that property to parking protecting the property owners to the South and easts client would put in block wall fencing on south and on the east where there isn't any now; would put in. chath link fenCing on the ~north which adjoins N 1 proparty. '. After hearing report of Senior Planner, the bearing was closed, there being no f~r~her testimony. Council discussed the possibility of a variance rather than zone change which would lfmtt the use timewise, and wouldmake certain that propose~ conditions would be assured, but Mr. Heinly explained his client is in an escrow conditioned on zont~. It was moved by Councilman Carlson~ seconded by Councilman Herrin, to approve the reclassification to M 1 zoning except the southerly 50 feet and the east- erly 50 feet of boundaries, reclassifying them to R 2 B; and instruct the CITY CODNCIL 2~3 July 17, 1967 City Attorney to prepare the amending ordinance. Council received report of bids received indicating as low bidder, Sully- Miller Contracting Compamy. The Public Works Director reported on proposed work and reasons for necessity of improvement. He recommended that Mr. Stroud's protest be overruled, so that the whole block could be completed. Joseph G. Burns, 361~ W. Camille, stated that he was in:.favor of the project, but questioned the cost of com- bining the two areas. The Public Works Director explained savings in admin- istrative costs by combining. CITY PARKING STAT~M LEASE ~ On motion of Councilman Herrin, seconded AG~W~EI~TS by Councilman Brooks and carried, Council authorized lease agreements, for parking stalls in the City owned parking lot, with Mission Viego Lighting and with the Book Center, the rental rate on the parking stalls to be not less than the minimum monthly rate for private parking. ORANGE COU~ WATER DISTRICT Letter from Orange County Water District regarding their offer, at the District's expense, to defend anyone within the District who is served with a cross complaint in regard to the 1963 legal action agaimst all upstream parties who produce water frc~ the Santa Aha River system above Prado Dam, was presented. On motion of Councilman Brooks, seconded by Councilman Griset and carried, the Orange County Water District was authorized to act for the City of Santa Ana in the defense of cross ptaints~ if any filed, at District's expense.
