Roll call was answered by Councilmen Wade Herrin, Walter Brooks, James E. Carlson, Lorin Griset, J. Ogden Markel, Thomas W. Thurman and Mayor Tom McMlchael. Also present were City Manager Carl J. Thornton, City Attorney William Mock, Director of Public Works Ronald Wolford, PlamuingDirector Van Stevens, and Clerk of the Council Doris M. Brown MINUTES Considering the Minutes of the Regular Meeting of August 21, 1967, Councilman M~rkel asked for an addition on Page 271 under POLICE SALARIES as follows: "Councilman Markel expressed appreci- ation for a fine presentation." The Minutes were approved with the addition requested on motion of Councilman Markel, seconded by Councilman Brooks and carried. W~WJM 26 AND 27 On motion of Councilman Brooks, seconded by Councilman Markel and carried, Council ordered filed report of bids received for construction of Wells 26 and 27 at East Res&rvoir and Pumping Station; awarded contract at unit prices to Beylik Drilling; and rejected all other bids. LIBRARY PERIODICALS Contract fo~ annual periodicals for _~ Library, Spec. 251-102, was awarded~ to Mayfair Subscription Agency, the only bidder~ on motion of Councilman Griset, seconded by Councilms~uMarkel and carried. MOBILE RADIOMNITS Authorization to advertise for bids for Spec. 654-11, 7 mobile radio units, solid state, for Police Department, opening 9/26/67, was granted on motion of Council~-u Herrin, seconded by Counc~lm~u Markel and carried. WAIVE READING On motion of Councilman Brooks, seconded by Councilman Herrin and unanimously carried,, the City Council waived the further reading of all resolutions and ordinances listed on the public agenda. In response to Mayor McNichael's question, the City Attorney stated that in order to initiate proceedings on this zone change again, it would be necessary for the applicant to file a new application. It was moved by Councilman seconded by Councilman Berrinand carried, that a protest on the FA~_giuele application be filed and that the other applications be ordered received end filed. MISCELLANEOUS SALES Considering the Manager's report on proposed fees for miscellaneous sales and service charges being performed by departments, it was moved by Councilman Brooks, seconded by Councilman Herrin and carried, that the proposed fees be approved and a resolution be prepared. PLANNING COMMISSION VOTING Council received a report reqUested August 21 on the possible effect of conflict of interest disqualifications on the decisions of the Plaguing Commission. The report reflected 48 meetings held, 191 decisions recorded on Variances, Conditional Use Permits, and Zone Changes; during 15 of the meetings on 18 items discussed, one or more Commissioners disqualified themselves, a combined total of 20 times; of the 18 decisions, in only three cases could a decision have been affected by breaking a tie (one time) or causing a tie (two times). It was moved by Councilman Griset, seconded by Councilman Carlson, that the report be ordered filed. Councilman Narkel expressed concern because a member of the Commission could not enter into important discussions because of his attorney affiliation. Councilman Carlson expressed satisfaction with the performance of the Co~maission and appreciation of their service. The motion to order the report filed was adopted with Councilman Markel voting "No". SALAHY RECOMMENDATIONS The Manager's report on recc~mendations for changes in wages and salaries was presented. Ralph DeSimone, representing the Santa Ana City Employees Association, commented that there was no discussion of fringe benefits in the report and there were approximately six classifications with which the Association did not agree; however, the Association recommended adoption of the Manager's reconm~endation as presented. Following a lengthy discussion of the report, the procedures for surveys, and certain areas that might need additional study, RESOLUTION 67-159 AMENDING SECTIONS B AND ~.l OF RESOLUTION NO. 58-281 was read by title. It was moved by Councilman Brooks, seconded by Councilman Griset, that the resolution be adopted, waiving further reading. The meeting was reconvened at 4:15 P.M. with all Councilmen present except for Mayor McMichael who arrived five minutes later. CATV .J~\~b, The City Manager presented a report on a staff study of co~unity antenna television franchises and recommended that the City Council set the matter for discussion at its next meeting after which he would request a probable 60 day period for development and presentation of forms and procedures for the actual granting of license. On motion of Councilman Thurman, seconded by Councilman Griset and carried, the City Council continued the matter to the next City Council meeting and ordered the report filed. Mayor McMichael arrived at 4:20 P.M. and was present throughout the remainder of the meeting. SALARY INCP~EASES ~ ~o On motion of Councilman Herrin, seconded by Councilman Griset and carried, the Manager's report dated 8/30/67 recommending increases for meritorious service was approved. COUNCIL COMMITTEEREPORTS Councilman Markel reported on his tour of Public Works projects under construc- tion, discussed with the City Manager and Public Works Director the appraisals and methods of acquisition of First Street; and requested an opinion frc~ the City Attorney of whether or not a building could be placed in Parton Street at Santa Aha High School. At the request of Councilman Herrin, the Public Works Director reported on problems involved in the construction of the Broadway sewer. CATS ~ ~ A recent complaint about cats was discussed and it was noted that the Municipal Code provisions limiting the keeping of more than tt~ree dogs as household pets did not apply to cats. It was moved by Councilman Griset, seconded by Councilmam Carlson ami carried, that the matter be referred to the staff for additional study and recommendation. WE~ ABATEMENT ~ '~ Noting that the recent weed abatement ordinance called for appointment of a committee to serve as hearing board for appeals, Mayor McMlchael appointed the Council as a c~ittee for hearfn~ appeals and directed that the appeals be held at regular Co~mcil meetings. CITY COUNCIL 279 September 5, 1967 MANAGER'S SALARY Noting that the City Manager's salary must be set by separate resolution, it was moved by Councilman Griset, seconded by Councilman Herrin ~nd carried, that action be deferred to t he next Council meeting. ORAL COMMUNICATIONS Janice Boer ststed that her comments at the last City Council meeting were not included in the Minutes of August 21, 1967, (City Council Minutes Page 271) and that a correction to the Minutes of August 7 made by the City Council on August 21 were not included in the Minutes (City Council Minutes Page 271). Janice Boer presented an unsigned statement from the Board of Directors of the Property Owners Protective Leauge, Inc., criticizing the City Council's decision on the alignment of First Street and methods of acquisition, On motion of Councilman Brooks, seconded by Councilman Herrin and carried, the communication was ordered filed. Mayor McMichael commented that Mrs. Boer had been heard at the various public hearings on First Street and it was not the intention of the City Council to reopen the hearing. Fraley, St. Luke's Methodist Church. CITATION Mr. Gene Cook, Volunteer Chairman of the Red Cross First Aid Committee of Orange County, presented to Fire Chief John Garthe a special citation for the First Aid Training Program within the Santa Aha Fire Department. Members of the Fire Department present were recognized. SURPLUS PROPERTY Mayor McMichael announced the sale of real property described in Surplus Property Report 41-63, consisting of one parcel on the east side of Santa Fe Street, south of Second Street, with a minimum bid of $9,500.00. The Clerk reported notice of the hearing pub- lished and mailed as required by the Municipal Code with evidence on file, and reported further that an offer of $9,500.00, accompanied by a Cashier's Check, had been submitted by H. D. Howell. In response to the Mayor's call for additional bids, the following oral bids were submitted: $9800.00, $9900.00, $10,000.00, $10,100.00, $10,300.00, $10,500.00, $10,900.00, $11,500.00.
