RESOLUTION NO. CRA 2003-11
A RESOLUTION OF THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF
SANTA ANA APPROVING AN AFFORDABLE
HOUSING PARTNERSHIP AGREEMENT
BETWEEN THE AGENCY AND HABITAT FOR
HUMANITY OF ORANGE COUNTY FOR
DEVELOPMENT OF THE PROPERTY LOCATED
AT 64'1 E. ADAMS STREET
BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE
CITY OF SANTA ANA, AS FOLLOWS:
SP. ctinn 1: The Board of the Community Redevelopment Agency of the City of
Santa Ana hereby finds, determines and declares as follows:
A. The Community Redevelopment Agency of the City of Santa Ana ("Agency")
has heretofore adopted the Redevelopment Plan for the Santa Ana South Main
Street Redevelopment Project Area on July 6, 1982 by Ordinance NS1639, as
amended (the "Project Area") which includes strengthening of public-private
partnerships to provide more affordable housing, and particularly to provide
decent, safe, sanitary, and affordable housing to the lower income citizens of the
City of Santa Ana.
B. Pursuant to Sections 33334.2(a) and 33334.6(c) of the California Community
Redevelopment Law (California Health and Safety Code Section 33000 et s. ecl.)
not less than 20 pement of all taxes which are allocated to the Agency are set
aside in a Low- Moderate- Income Housing Fund ("the Housing Funds") and
used by the Agency for the purpose of increasing, improving and preserving the
community's supply of Iow and moderate housing available at affordable housing
costs to persons and families of Iow- and moderate-income, including very-low-
income persons.
C. Pursuant to Section 33334.2(e) of the Community Redevelopment Law, the
Agency may exercise any and all of its powers to carry out this purpose.
D. Pursuant to Section 33334.6(a) of the Community Redevelopment Law, the
California State Legislature has found and declared that the provision of

affordable housing outside of redevelopment project areas can be of direct
benefit to those projects in assisting the accomplishment of project objectives.
E. Pursuant to Section 33334.2(g) of the Community Redevelopment Law, the
Agency may use Housing Funds to assist in the prevision of housing for Iow- or
moderate-income households outside the Redevelopment Project area if such
use will be of benefit to the Redevelopment Project, and the Legislature has
further found and declared that the provision of replacement housing pursuant to
Section 33413 is always of benefit to a project.
F. The Agency is using Housing Funds to assist Habitat for Humanity of Orange
County, a non-profit corporation ("Habitat"), in the purchase of certain real
property located at 641 E. Adams (the "Property"), which is located outside the
Redevelopment Project area.
G. In order to implement the Redevelopment Plan, the Agency has agreed,
subject to the approval of the City Council, to assist Habitat with the purchase of
the Property pursuant to the terms and provisions of an Affordable Housing
Partnership Agreement (hereinafter referred to as the "Agreement") between the
Agency and Habitat, which is on file in the office of the Executive Director of the
Agency, in which the Property is described.
H. The Agency has duly considered all of the terms and conditions of the
proposed sale, and believes that the proposed sale is in the best interests of the
City and the health, safety, morels and welfare of its residents, and in accord
with the public purposes and previsions of applicable state and local laws and
requirements; and
I. The Agreement contains all of the provisions, terms, conditions and obligations
required by the state and local laws, including long-term affordability covenants
benefiting the Agency.
J. Habitat for Humanity possesses the qualifications and financial resources
necessary to acquire and insure development of the Property as a single-family
home to be sold to qualified very-low income families in accordance with the
purpose and objectives of the Redevelopment Plan.
K. The Agency has held a public hearing on the proposed Project and the
Agreement as required for a small housing project by Section 33433(c) of the
Community Redevelopment Law, after having duly provided notice of such public
hearing in accordance with state law.

L. The Agency recognizes that it has received and heard all oral and written
objections to the proposed sale, and to other matters pertaining to this
transaction, and that any such oral and written objections are hereby overruled.
M. The proposed sale of the Properly is exempt from further review and in
accordance with the California Environmental Quality Act, categorical exemption
ER No. O3-180 will be filed for 641 E. Adams.
N. The Agency hereby finds and determines that the sale of the Property will
provide housing for very Iow-income persons.
O. The Agency hereby finds and determines that the information set forth herein
is true and correct.
P. The Agency hereby approves the sale of the Property.
~. The Agency finds and determines that the use of the Housing Funds
as authorized by this resolution will be of benefit to the Redevelopment Project Area.
~. The Affordable Housing Partnership Agreement is hereby approved,
and the Executive Director of the Agency is hereby authorized to execute the Agreement,
with such non-substantive changes as may be approved by Agency's General Counsel.
Se~i~n 4. The Executive Director of the Agency is hereby authorized to take all
steps, and to sign all documents and instruments necessary to implement and carry out
the Agreement on behalf of the Agency.
