Carlson, Lorin Griset, Jo Ogden Markel, Thomas W o Thurman, and Vice Mayor Wade Eerrin. Mayor Tcm McMichael was absent, but arrived later. In the absence of Mayor McMichael, Vice Mayor Herrin presided. AlsQ present were Assistant City Manager Bruce Spragg, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Planning Director Van Stevens, and Clerk of the Council Doris Mo Brown. City Manager Carl J. Thornton arrived later in the meeting. MINUTES 1968, were approved as submitted. On motion of Councilman Brooks, seconded by Councilman Griset and carried, the Minutes of the Regular Meeting of May 20, BRISTOL STR~'£ SEWER Bid award for Bristol Street Sewer, from Myrtle to Santa Clara, was continued to the June 17 meeting on motion of Council- man Markel· seconded by Councilman Thurm-~ and carried. ASBESTOS CE~ PIPE & FITTINGS On motion of Councilm~n Brooks, seconded by Councilm, n Markel and carried, the City Council ordered filed report of bids received for Spec. 371-109, Asbestos Cement Pipe and Cast Iron Fittings for A. C~ Pipe; awarded contract for Schedule I (Pipe) to Johns-Manville Sales Corporation, awarded contract for Schedule II (Fittings) to M~Qrden Utility Supply Corporation; and rejected all other bids. On motion of Councilman Griset, seconded by Councilman Brooks and carried, Council went on record as opposing S. Bo 393~ taxation of motion pictures, and any other exemption which makes no provision for replacement revenue. It was moved by Councilman Brooks, seconded by Councilman Griset and carried, to instruct the staff to present a report June 17th regarding Santa Ana's joining the California Peace Officers Association. It was moved by Councilman Brooks, seconded by Councilman Griset, that Council go on record as supporting A. B. 1331 regarding Joint Powers; Revenue Bonds; Parks. AGENDA O~DER On motion of Councilman Carlson, seconded by CouncilmR~ Griset and carried, Council agreed to consider numbered items on the Agenda out of their regular order so that people in the audience who were present for certain items could be heard. TENTATIVE TRACT MAP 6505 Tentative Tract Map 6505, filed by Covington Brothers Construction Company creating !10 lots between Fairview and Greenville and between Talbert and Sunflower was approved subject to conditions in Planning Director's Report dated May 24, 1968, on motion of Councilman Carlson, seconded by Councilman Griset and carried. T~TATIVETRACT MAP 6629 Fairhaven east of Glassell. Council considered Tentative Tract Map 6629 filed by. Martin Builders, Inc., creating 20 lots south of Harry Martin, of Nartin Builders, Inc., requested that Condition 13 in Planning Director's report dated May 29, 1968 be changed to limit 25-foot temporary construction easement to one year, indicati~ egress and ingress beyond the one year period would be granted if restoration made of any damage. On motion of Councilman Brooks, seconded by Councilman Carlson and carried, Tentative Tract Map 6629 was approved subject to conditions in Planning Director's report dated May 29, 1968, wi~h revisions in Condition 13 to set a time limit of one year on the 25-foot wide temporary construction easement; and alley requirement was waived. Councilman Thurman added that City will have the right of ingress and egress beyond the one year period in the 25-foot easement if the storm drain is not installed. CITY COUNCIL 451 June 3, 1968 Nayor ~4cNichael and City Nanager Thornton arrived at the Council meeting at 3. OPoM. FEDERAL BUILDING Mayor Mc~4ichael reported that he and the City Manager had attended the Civic Center Commission meeting and had made a formal presentation to the Ccmmission to release the 90~000 square feet for the Federal Building° He also stated that the Federal government will probably seek an additional 60,000 feet for parking, which would be an outright purchase by the Federal government outside the present Civic Center area. RETIRE~IENT CONTRACT Since Councilman Thurman could not be present at the evening session of the Council meeting when adoption of Ordinance NS-918 regarding amendment to the retirement contract was to be considered, which requires a two-thirds majority vote of Council for adoption, it was moved by Councilman Thurman, seconded by Councilm~n Brooks and carried, to consider Agenda Item 70 as the last item of business at the afternoon session~ PARCEL NAP 554 Clara, west of the Newport Freeway° Council considered Parcel Map 554, filed by John To Kimbrell, creating 4 parcels on the north side of Santa Norm~u Smedegaard, attorney representing Sherwood Home Owners Association; Clark Bonner, 4250 Long Beach Boulevard, Long Beach; and Charles Flanagan, 2304 East Buffalo, spoke, requesting Council not to approve the extension of Pasadena Street~ as set out in Condition h h in Planning Director's report dated May 28, 1968, but to have it terminate as a cul-de-saco On motion of Councilman Griset, seconded by Councilman Rerrin, Parcel Nap 554 was approved subject to conditions in Planning Director's report dated Nay 28, 1968, with modification of Condition 4 h to incorporate the second sentence as condition for this approval which would grant the establishment of a cul-de-sac for Pasadena Street, not to exceed 500 feet in length; and alley requirement waived° On roll call vote: AYES: NOES: ABSENT: Herrin, Carlson, Griset, Narkel, Thurman, McNichael Brooks None CALIFORNIA WATER Henry D. Greene, Executive Manager, RESOURCES ASSOCIATION California Water Resources Association, presented an oral report, requesting City of Santa Ana to Join the Association° On motion of Councilman Brooks, seconded by Councilman Herrin and carried, the matter was referred to staff for study and report back on June 17th. CITY COUNCIL 452 June 3, 1968 RECESS At ~:45 PoN. a five minute recess was declared. The Council reconvened at ~:50 PoS. with all Council members present. WILD ANIMALS Council considered report from the City Attorney regarding the Wild An~-al Ordinance. The City Attorney read sections~oma copy of the Los Angeles County ordinance which enumerated exceptions, naming certain animals. Council discussed at length definitions in ordinances of other cities. It was moved by Councilman Griset, seconded by Councilman Thm and carried, to refer the matter back to the City Attorney and request that he report back at the June 17th meeting with suggested wording which incorporates the principle in the Los Angeles County ordinance° Councilman Thurman asked the Attorney to check with the city's insurance carrier on the question of liability. NECESS At 5:50 P.M., the meeting was recessed to 7:30 P.M., at which time it was reconvened with Councilmen Nerrin, Brooks, Carlson, Griset, Markel, and Mayor McMichael present. Councilman Thurman wes absent. Following the Pledge of Allegianc~ to,se Flag, the Invocation was delivered by Captain Tcm Cisar of The Salvation Army. Mayor McMichael and Vice Mayor Herrin disqualified themselves on the next item of business, and Mayor McMichael appointed Councilman Brooks as Chairman in their absence. Hearing was opened on the proposed establishment of future r~ght of way lines on Seventeenth Street Detween The Public Works Director presented the staff report~ recommending that the additional right of way all be acquired from the south side of the street because it would save an estimated $270,000, depth of lots lends itself better to proper~y develol~zent, and fewer parcels and buildings woul~ he disrupted. The Planning Director presented the recmmaendation of the Planning Ccemission cI~ COUSC~L 456 June 3, 1968 that 12 feet be taken fro~the nor%h side and 12 feet be taken from the south side. The Clerk of the Council reported two Communications received from Thomas M. Palmer and Martha Ann Cheney. On motion of Councilman Griset, seconded by Councilman Carlson and carried, the communications were ordered filed. Speaking in favor of an equal take from both sides were: Vic Silver, Robert Cr~elin, Traffic Engineering Consultant for William L. Tooley, Charles Linger, Merle Boyle, W. H. Rawlins, Mrs. Eugene Robinson, Kevin Leeg, Thomas A. Xilleen, Dr. Tirico, J. B. Price. A letter presented to Council by Robert Crc~melin, summarizing results of a study conducted by his firm, was ordered filed on motion of Councilman Carlson, seconded by Councilman Griset and carried. Speaking in opposition to an equal take were Harold Crai~and Alton Pamplin presented a proposal for building setbacks. The hearing was closed. After discussion bY Council, it was moved by Councilman Carlson, seconded by Councilman Griset, that the widening of 17th Street be implemented by taking 12 feet off the south side and 12 feetoff the north side, and the City Attorney was instructed to prepare an ordinance to amend the Municipal Code accordingly. BUSINESS PROMOTION DISTRICT Hearing was opened on the proposed establishment of a Business Promotion District within the City of Santa Aha. Burr Shafer, Vice President of the Downtown Association, presented a petition containing additional names of businessmen in favor of the proposed Business Promotion District, and stated that over 50% of the licensees in the proposed district were in favor of it. On motion of Councilman Carlson, seconded by Councilman Herrin and carried, the petition was ordered filed. A number of questions by Lee Hadley, owner of property at Third and French, were answered by Council and staff. There being no further testimony, the hearing was closed. Saunders, Sr. and Claire A. Saunders submitting an offer to buy the ten foot strip of land between their building at 108 N. Sycamore and the new north line of First Street. The City Manager explained the previous action regarding this property and recommended it be sold only at the price the City paid fOr i~ plus~ costs. The staff was authorized to continue negotiation with Mr. Saunders and to offer the property to him for no less than the price the City paid for it, plus costs, on motion of Councilman Griset, seconded by Councilman Herrin and carried. CLAIM FOR DAMAGES The City Attorney reported that the claim againstthe City filed by Protective Association of Governmental Employees is insufficient in marv instances. CITY COUNCIL June 3, 1968 BUDGE~ AMENDMENT On motion of Councilman t~rooks, seconded by Councilman Eerrin and carried, Council approved the request for authorization to transfer $1,650 frOm Fund ll-000 to 51-181 for the construction of tower on the Fire Station and procurement of certain b~oks, etc. to reactivate the communi- cations system for the Civil Defense program.
