AMENDMENT No. 4 TO AGREEMENT
This AMENDMENT NO.4 TO AGREEMENT, entered into effective on.Se, ol~-otb~/$ 2003 is
between the STATE OF CALIFORNIA, acting by and through its Department of Transportation,
referred to herein as "STATE", and
CITY OF SANTA ANA, a body politic and
a municipal Corporation of the State of
California, referred to here in as "CITY"

RECITALS
The parties hereto entered into an Agreement (Document No. 13300) on November 6, 1995,
said Agreement defining the terms and conditions of a cooperative project to construct Alton
Avenue Overcrossing at State Route 55, referred to herein as PROJECT.
The parties hereto also entered into an Amendment No. 1 to Agreement (Document No.
13300) on December 11, 1996 to extend the termination date specified in the original
Agreement to December 31, 1998.
The parties hereto also entered into an Amendment No. 2 to Agreement (Document No.
13300) on November 16, 1998 to extend the termination date specified in the original
Agreement to December 31, 2000.
The parties hereto also entered into an Amendment No. 3 to Agreement (Document No.
13300) on March 15, 2001 to extend the termination date specified in the original Agreement
to December 31, 2002.
5. It has been determined that PROJECT REPORT will not be approved prior to the termination
date of said Agreement.
IT IS THEREFORE MUTUAl J .Y AGREED:
1. The termination date specified in Section Ill, Article 1 of the original Agreement shall now
be December 31, 2005 instead of December 31, 2002.
2. All other terms and conditions of said Agreement (Document No. 13300) shall remain in full
force and effect.
3. This Amendment to Agreement is h6reby deemed to be part of document No. 13300.
