HomeMy WebLinkAbout11-04-1968MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA November 4, 1968 The meeting was called to order at 9.:00 P.M. in the Council Chambers, 9.17 North Main Street with the following Councilmen present: Wade Herrin, Walter Brooks, James E. Carlson, Lorin Griset, J. Ogden Markel, Thomas I%'. Thurrnan, and Mayor Tom McMichael. Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Director of Public ~'orks Ronald Wolford, Director of Planning Van Stevens, and Clerk of the Council Doris M. Brown. MINUTES On motion of Councilman Brooks, seconded by Councilman Griset and carried, the Minutes of the Regular Meeting of October 21, 1968~were approved as submitted. PROJECT 7001 Since all bids received for Project 7001 - construction of drafting tank and apparatus pad in connection with Fire Training Center and Engine company 9 were several thousand dollars over the Engineering estimate, it was moved by Councilman Herrin, seconded by Councilman Brooks and carried, to reject all the bids and cancel the purchase. TRACTOR LOADER Council received a staff report regarding award of contract on September 3, 1968, to International Harvester Company for Tractor Loader, Spec. 641 -134. The equipment received did not meet the ,specifications andthe company was unable to provide the equipment according to the specifications. On motion of Councilman Griset, seconded by Councilman Brooks and carried, it was directed that the equipment delivered by International Harvester Company not be accepted; that the contract be awarded to the next lowest biddermeeting the specifications, Milo Equipment Company; and that the difference in cost of $147.75 be Claimed from General Insurance Company of America, the bonding company for International Harvester Company. BID CALLS On motion of Councilman Griset, seconded by Councilman Herrin and carried, the City COuncil approved plans and specifications and authorized advertising for bids for the following: %%~ SPEC. 641-146 - One Service Type Truck Body to be mounted on 19, 500# %~G.V.W. 1/2 cab-over truck, opening 11/18~68;' z%~SPEC. 654-13 - SevenMokile Radios for Public Works, opening 11/i8; %%~SPEC. 654-}4 - Nine Mobile Radios for Police Dept., opening 11/18; CITY COUNCIL 46 November 4, 1968 PROJECT 6002 - Bail Diamond Lighting at E1 Salvador Park, opening It was moved by Councilman Brooks, seconded by Councilman Griset that Council approve plans and specifications and authorize advertising for bids for PROJECT 1318 - Construction of l?th (widening) from Baker to Olive and PROJECT 2014 - Lincoln Ave. Intersection with l?th St., opening 11/9.6. Councilman Markel stated opposition to widening 17th piecemeal and Moted "No.". Answering his question about medians, the Manager stated his understanding that staff is proceeding under instruction that raised medians are not to be developed in either First or Seventeenth except for major intersections with heavy left turn movements. The Public Works Director explained this portion of construction was requested at this time by abutting property owners. The motion to approve the bid call was adopted with Councilman Markel changing his vote to "Aye". READING WAIVED The full reading of ordinances and resolutions the titles of which appeared on the public agenda, was waived, on motion of Councilman Herrin, seconded by Councilman Griset and unanimously carried. ORD. NS-941 - A.A. 631 ORDINANCE NS-94} CHANGING DISTRICT CALLENS CLASSIFICATION ON AMENDMENT APPLICATION 631 FILED BY JOSEPH R. CALLENS AND AMENDING SECTIONAL DISTRICT MAP 36-5-10 (EXHIBIT AA 631B) (north side of Sunflower between Flov~ r and Bristol) was passed to second reading, on motion of Councilman Griset, seconded by Councilman Brooks and carried. ORD. NS-942 ~ ~w\ ORDINANCE NS-942 AMENDING THE FUTURE RIGHT OF WAY LINES SANTA ANA MUNICIPAL CODE BY DELETING SECTION 9271.15 FROM PART 7, CHAPTER 2, ARTICLE IX THEREOF RELATING TO FUTURE RIGHT OF WAY LINES ESTABLISHED ALONG WILLITS AND BISHOP STREETS was passed to second reading, on motion of Councilman Griset, seconded by Councilman Herrin and carried. TRANSPORTATION The Chamber of Commerce communication (COMMUNITY RELATIONS) containing statemer~ of policy of their Trans- portation Committee regarding public transpor- tation (requested by the Community Relations Report) was ordered filed, on motion of Councilman Griset, seconded by Councilman Markel and carried. BALLOT MEASURES Westminster Resolutions endorsing Proposition No. 7 and Proposition No. 1 A on the November 5th ballot were ordered filed, on motion of Councilman Brooks, seconded by Councilman Griset and carried. WEAPONS LEGISLATION ~ %~ The Westminster Resolution requesting State legislation to provide proper penalties to deter use of deadly weapons against peace officers in performance of their duties was ordered filed, on motion of Councilman Brooks, seconded by Councilman Griset and carried. AUDITOR'S REPORTS c~ ~ On motion of Councilman Herrin, seconded by Councilman Griset and carried, Auditor's Reports of all accounts (except Water Utility) and Water Utility Funds for the period ending June 30, 1968, were ordered filed, on motion of Councilman Herrin, seconded by Councilman Griset and carried. CITY COUNCIL 49 November 4, 1968 ALCOHOLIC BEVERAGE LICENSE APPLICATIONS The following Alcoholic Beverage License Applications were considered: The Black Derby, 320 S. It was moved by Councilman Brooks, seconded by Councilman Herrin and carried, that protests be filed on The Black Derby, 320 S. TRAFFIC Report of control devices removed or installed 10/3/68 through 10/23/68 was ordered filed, on motion of Councilman Griset, seconded by Councilman Brooks and carried. VARIANCE AND CONDITIONAL Decisions made by the Planning Commission USE PERMIT or the Zoning Administrator, where no appeal has been filed, were affirmed, on motion of Councilman Griset, seconded by Councilman Herrin and carried, for the following: VA 68-t0~ FELKNER - permit property improvements related to boarding and care of horses at 3122 W. Fifth in R 2 and C 2 Districts - APPROVED; VA 68-103, T. K.P. BUILDING CO. - utilize tandem parking for proposed office complex at southwest corner of Main and 17th, 1624 N. Main, in the R 3 HB, C 1 and C 2 Districts - APPROVED. NARCOTICS PROBLEM The City of Corona Resolution urging consideration of closing of United States - Mexican border to American minors uniess accompanied by parent or responsible adult was ordered filed, on motion of Councilman Herrin, seconded by Councilman Griset and carried. CITY COUNCIL 50 November 4, 1968 MUNICIPAL STADIUM USE Council considered the letter from Southern Christian Leadership Conference regarding plans for a Christmas Festival, December 21 and 9.2 at the Municipal Stadium. Reverend R. L. Nichols explained the program and asked if it would be possible for them to have a flat fee on rental of the stadium. The City Manager stated that Municipal Code Section 2622 sets out the basic rental rates for the stadium and states that they shall be levied even though the event is a charitable event. After some discussion, the matter was referred to staff to assist in aDy way possible within the framework of the Municipal Code, on motion of Councilman Thurman, seconded by Councilman Herrin and carried. BOND RELEASES cB ~ Acting on the Public Works Director's TRACT 6390 AND TRACT 6337 reports of satisfactory completion of improvements, on motion of Councilman Brooks, seconded by Councilman Griset and carried, bonds were released for the following: Tract 6390, Edinger and Kilson Drive North; Tract 6337, Edinger and Kilson Drive South. CITY NEWSLETTER ~,~ ~%g Council considered the report recommending preparation and publication of a monthly news- letter for distribution to all residents. Councilman Herrin and Councilman Markel were opposed to having a City news- letter at this time. On motion of Councilman Griset, seconded by Councilman Brooks, the staff was directed to commence preparation and publication of a newsletter (but not necessarily on a monthly basis) to all the residents of Santa Arm. On roll call vote: AYES: NOES: ABSENT: Brooks, Carlson, Griset, Thurman, McMichael Herrin, Markel None TRAFFIC REPORTS On motion of Councilman Griset, seconded by Councilman I-Ierrin and carried, the following reports were ordered filed: CB~%North Flower Parking - Report on proposal that parking be removed ~ from North Flower; c~%th and Ross Signal - Report on proposal for signal at 8th and RoSs; Fairview Speed - Report on speed limits established on Fairview. CITY CO UNCIL 51 November 4, 1968 BOWERS MUSEUM The Council Committee of Councilman Markel and Councilman Carlson, appointed after receipt of the Memorandum Opinion of Rimel, Harvey & Helsing, attorney% regarding Museum Board, reported to the Council that the members of the Museum Board need to be informed of their duties and responsibilities, which seems to be the problem. Council discussed a resolution adopted in 1967 delineating the powers and duties of the Museum Board, and opinions of the City Attorney written in response to questions from the Museum Board. After a lengthy discussion, it was moved by Councilman Brooks, seconded by Councilman Griset and carried, that the present committee of Councilmen Markel and Carlson be supplied with these documents, meet with the Museum Board to further pursue and Study on this basis and come back to Council with a report. RETIREMENT CONTRACT Councilman Markel requested that amendment of the Employees Retirement System Contract be placed before the Council for consideration now. This matter was before Council in the form of an ordinance in April, 1968 and again in May and June, 1968 and f~iled to receive the necessary two-thirds affirmative vote of the Council on both occasions. On motion of Councilman Brooks, seconded by Councilman Markel and carried, it was directed that the matter be placed on the Council Agenda for the November 18 meeting. Councilman Herrin voted "No". RECESS At 4:30 P.M. the meeting was recessed to 7:30 P.M., at which time it was reconvened with all Council members present. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Dr. H. L. Fickett, Sr., First Baptist Church of Tustin. AMENDMENT APPLICATION 834 Hearing was opened on Amendment R. V. RIGHTER Application 634, filed by R. V. Righter, to amend Sectional District Map 32-4-9 by prezoning property on the west side of Tustin between Fairhaven and the Garden Grove Freeway from the A 1 to the R 1 and C 5 Districts. Planning Commission recommended denial. Mike Immel, attorney representing applicant, explained to Council that applicant was requesting that the property fronting on Tustin Avenue for a depth of 190 feet be zoned C 5 (1 lot) and the rest of the 9 acres be zoned R 1 (34 lots), as applicant felt the highest and best use for the frontage along Tustin Avenue would be commercial zoning. Mr. Immell presented a list of conditions which his client would be Willing t0 bomplM with if attachedlto' T~ehtatiVe Tract Map~6530 approval and this would be the same as a variance procedure. The communication was ordered filed, on motion of Councilman Herrin, seconded by Councilman Griset and carried. Walter Righter and Ruth Righter also spoke, citing the increased cost of taxes in the past few years on agricultural zoned land. Speaking in opposition to the commercial portion of the proposed prezoning were CITY COUNCIL 52 November 4, 1968 Philip Simons, 12872 Woodbury Drive,~ Jo~n Jezowski; Carl Erickson, 16582 Nubian; A1 Corate, 12871 Woodbury Drive. The hearing was closed. The Planning Director explained that the Planning staff had recommended to the Planning Commission that the property be zoned all R 1, and that later the applicant could request a variance on the Tustin lot; however, the applicant asked for decision on the application as filed, so the Planning Commission denied the application. After discussion, it was moved by Councilman Brooks, seconded by Councilman Griset, to approve the reclassification and instruct the City Attorney to prepare an amending o'rdinance: according to EXhibit B, ~vhich 'would prezone all the property to R 1. The motion was adopted on roll call vote: AYES: NOES: ABSENT: Herrin, Brooks, Carlson, None None Griset, Markel, Thurman, McMichael TENTATIVE TRACT MAP 6530 Hearing was opened on Tentative Tract c~ ~' Map 6530, filed by Land Tech Development, creating 34 R i lots and one C 5 lot on the west side of Tustin south of the Garden Grove Freeway. Mike Immel spoke in favor of the tract map, and Philip Simons spoke opposing it and asked if developer would be able to use the C 5 lot on the tract map for commercial use. Mayor McMichael explained that by the previous action on Amendment Application 634, all lots would remain R 1, and if the developer wanted to develop the large lot on Tustin as anything but R 1, he would have to request a variance. The hearing was closed. On motion of Councilman Brooks, seconded by Councilman Carlson, Tentative Tract Map 6530 was approved subject to conditions in Planning Director'S report dated October 11, 1968, and alley requirement waived, on the following roll call vote: AYES: NOES: ABSENT: Herrin, Brooks, Carlson, Griset, Thurman, McMichael Markel None PUBLIC PROPERTY USE ~'~ Council considered the Application for Special License to Use Public Property by Diane Robles and Helen Valenzuela to preach the gospel. ·On October 2t, Council continued to this meeting so that applicants could be present to furnish more information to Council. Helen Valenzuela explained to Council that they would like to preach at the corner of 4th and French on Saturdays from 2:00 to 4:00 P. M. On motion of Councilman Griset, seconded by Councilman Brooks and carried, the Application was approved for the location of 4th and French for a 90 day period for Saturdays from 2:00 to 4:00 P. M. CITY COUNCIL 53 November 4, 1968 SOLICITATION APPLICATION The Solicitation Application of American Christian Crusade, Inc.· 11/15/68 - 1 / 1 § / 69 was approved, on motion of Councilman Herrin, seconded by Councilman Markel and carried. PARADE The Application for Special License to Use Public Property by the Santa Aha Jr. Chamber of Commerce, Christmas Parade, 5:00 to 9:00 P. M., December 7, 1968, was approved, on motion of Councilman Griset, seconded by Councilman Herrin and carried. BRISTOL CHANNELIZATION Council considered report on channelization of South Bristol Street from First to Myrtle. Ron Blackwell, property owner on the east side of Bristol, objected to the removal of the four parking spaces in front of his business on Bristol. The Public Works Director explained that some parking could be provided on V~alnut. On motion of Councilman Brooks, seconded by Councilman Herrin and carried, Council approved the recommendations in report and authorized no parking zones on Bristol Street on the west side from Walnut Street to 200 feet south of Chestnut Street and on the east side from 200 feet south of center line of First to 200 feet south of center line of Chestnut; and authorized two-hour time limit parking on the north side of Walnut Street from Bristol Street to 100 feet east. It was understood that if the two-hour limit on Walnut needed to be shortened after experience it would be. MAIN AND 17th SIGNAL Woody Johnson complained about the short space of time the green arrow for left turning is on at signal at 17th and Main. The matter was referred to staff for report. ADJOURNMENT At 9:25 P. M., there being nofurther business to come before the City Council, the meeting was adjourned, on motion of Councilman Herrin, seconded by Councilman Market and carried.
