HomeMy WebLinkAbout2003-102 - Amend Resolution No. 91-066RESOLUTION NO. 2003-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA TO AMEND RESOLUTION NO. 91-066 TO EFFECT TEMPORARY CHANGES IN THE SICK LEAVE BENEFIT AND PERFORMANCE EVALUATION PROCESS APPLICABLE TO UNREPRESENTED EXECUTIVE MANAGEMENT CLASSIFICATIONS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1: The City Council hereby finds, determines and declares as follows: Section 1004, Article X of the City Charter of the City of Santa Aha requires the City Manager to prepare, install and maintain a position classification and pay plan subject to civil service rules and regulations and the approval of the City Council. On July 1, 1991, the City Council passed and adopted Resolution No. 91- 066 re-establishing the Basic Classification and Compensation Plan for classes of employment designated as unrepresented Executive and Middle Management. The strong and consistent management of law enforcement activities is critical to the welfare of City residents. To facilitate continued retention of the current executive management of the Police Department, the Executive Director of Personnel Services proposes that the sick leave benefits and performance evaluation process as set forth in Sections 6.11 and 7.5, respectively, of Resolution No. 91-066 be amended to provide the City Manager with authority to grant a one-time exception to the employment termination requirement for the granting of payment for unused sick leave and to provide a temporary provision for semi-annual performance evaluations for the Chief of Police. Section 2: That Section 6.11 of Resolution 91-066, as amended, is hereby further amended by adding the following paragraph: "Notwithstanding the foregoing, the City Manager is authorized to grant to the Chief of Police a one-time exception to the employment termination requirement for the granting of payment for unused sick leave as set forth above. The authority conferred on the City Manager by virtue of this paragraph shall expire by its own volition on June 30, 2006." Resolution No. 2003-102 Page 1 of 3 Section 3: That Section 7.5 of Resolution No. 91-066 as amended, is hereby further amended by adding the following subsection: "G. Notwithstanding the above, for the period January 1, 2003 through June 30, 2006, inclusive, the City Manager is authorized to grant to the Chief of Police performance-based salary adjustments pursuant to the guidelines set forth in this Section on a semi-annual basis. The maximum allowable salary adjustment per each semi-annual performance evaluation shall be seven and one-half percent (7.5%) of annual salary." Section 4: That except as amended by this Resolution, all other provisions of Resolution No. 91-066, as amended, shall remain in full force and effect. Section 5: That except as stated otherwise above, this Resolution shall be operative from and after December 15, 2003. ADOPTED this 15th day of December, 2003. Mayor APPROVED AS TO FORM: Joseph W.
