A good faith offer was made to the property owner in the amount of $31,075, for the purchase of the property. To meet the project schedule, it was necessary to commence eminent domain proceedings. In February of 2003, the City deposited funds into the State Condemnation Fund for these proceedings. However, staff continued to negotiate with the property owner and was able to successfully complete escrow for this property. The eminent domain proceedings were ceased and the condemnation funds are being refunded to the City. In order to recognize these funds in the current fiscal year, an appropriation adjustment is necessary.
