Approve an appropriation adjustment recognizing funds in the amount of
$31,075 in the Measure M Street Construction Fund (account no. 32-01-
621) and appropriating $31,075 to the Measure M Street Construction Fund
account no. 32-551-6631, project no. 1733) for the Main Street and
MacArthur Boulevard intersection project.
DISCUSSION
To accommodate the street widening at the intersection of Main Street and
MacArthur Boulevard, acquisition of a portion of the property at 100 West
MacArthur Boulevard was required. A good faith offer was made to the
property owner in the amount of $31,075, for the purchase of the
property.
To meet the project schedule, it was necessary to commence eminent domain
proceedings. In February of 2003, the City deposited funds into the
State Condemnation Fund for these proceedings. However, staff continued
to negotiate with the property owner and was able to successfully
complete escrow for this property. The eminent domain proceedings were
ceased and the condemnation funds are being refunded to the City. In
order to recognize these funds in the current fiscal year, an
appropriation adjustment is necessary.
ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the proposed
roject has been determined to be adequately evaluated in previously
)ared MacArthur Place Environmental Impact Report 87-01.

FISCAL IMPACT
The funds will be recognized in the Measure M Street Construction Fund
(account no. 32-01-5621) and appropriated to the Measure M Street
Construction Fund (account no. 32-551-6631, project no. 1733).
