Direct the City Attorney to prepare and authorize the City Manager and Clerk of the Council to execute an amendment to the Contribution Agreement for the purchase and development of Patricia Lane Park. . Approve an appropriation adjustment reducing the Select Street Construction revenue account (account no. 59-01-5342-5) and the Select Street Construction Improvements Other Than Buildings expenditure account (account no. 59-551-6631) by $94,000. DISCUSSION On March 25, 2003, the City approved a Contribution Agreement with the State of California for Transportation Enhancement Activities (TEA) Grant Funding in the amount of $533,000 for the purchase and development of Patricia Lane Park. An appraisal was performed by the Department of Transportation (CalTrans) and the properties were offered to the City at fair market value. The nine surplus parcels being acquired by the City were originally purchased with Federal, State and OCTA funds for the widening of the I-5 freeway and any revenue received from the sale of the property will be used to reimburse the respective agencies. Because the properties were originally purchased using Federal, State and OCTA funds, the Federal Highway Administration and California Department of Transportation have agreed to waive their portion of the acquisition costs, thereby reducing the required grant funding for this project from $533,000 to $439,000.
