RESOLUTION NO. 2004-038
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA AMENDING THE GENERAL PLAN OF THE
CITY OF SANTA ANA FROM GENERAL COMMERCIAL
(GC) TO DISTRICT CENTER (DC) FOR THE PROPERTY
LOCATED AT 2032 NORTH MAIN STREET (GPA 2004-02)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:

A.
General Plan Amendment No. 2004-02 has been filed with the City of
Santa Ana to amend the General Plan Land Use Designation from
General Commercial (GC) to District Center (DC) for the property located
at 2032 North Main Street to allow for the expansion of the Bowers
Museum.
The Planning Commission of the City of Santa Ana held a duly noticed
public hearing on April 26, 2004, on General Plan Amendment No. 2004-
02 and determined by a unanimous vote to recommend that the City
Council adopt a resolution approving General Plan Amendment No. 2004-
02.

The Council finds that General Plan Amendment No. 2004-02 is consistent
with the General Plan, including but not limited to its policies and goals of:
1. Promote the balance of land uses to address basic community
needs. Land Use Element Goal 1.0.
D.
Encourage the development of commercial and nonprofit
recreational facilities and services. Land Use Element Policy 1.7.
Protect and enhance developments sites and districts which are
unique community assets that enhance the quality of life. Land Use
Element Goal 4.0.
Improve the physical appearance of the City through development
of districts that project a sense of place, positive community image,
and quality environment. Urban Design Element Goal 1.0
The Mitigated Negative Declaration as approved does not include the
parking structure identified therein. The City Council has determined that
any impact to parking because of the future expansion will be addressed
when the expansion project comes forward for subsequent approvals. At
that time, mitigation measures will be in place to reduce the project's
parking impacts. Mitigation options that could be considered to address

parking impacts include additional surface parking and/or parking
structures; satellite parking with shuttle; promotion of alternative
transportation; adjustment of event schedules. All references to a five-
story parking structure or the parking demands in the Mitigated Negative
Declaration are hereby removed.
Section 2. The City Council has reviewed and considered the information
contained in the initial study and the Mitigated Negative Declaration prepared with respect
to this Project. The City Council has, as a result of its consideration and the evidence
presented at the hearings on this matter, determined that, as required pursuant to the
California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, Mitigated
Negative Declaration and Mitigation Monitoring Program, Environmental Review No.
2004-12, adequately addresses the expected environmental impacts of this Project. On
the basis of this review, the City Council finds that there is no evidence from which it can
be fairly argued that the Project will have a significant adverse effect on the environment.
The City Council hereby certifies and approves the Mitigated Negative Declaration and
Mitigation Monitoring Program and directs that the Notice of Determination be prepared
and filed with the County Clerk of the County of Orange in the manner required by law.
Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the City
Council has determined that, after considering the record as a whole, there is no evidence
that the proposed project will have the potential for any adverse effect on wildlife resources
or the ecological habitat upon which wildlife resources depend. The proposed project
exists in an urban environment characterized by paved concrete, roadways, surrounding
buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and
Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not
required in conjunction with this project.
Section 3. The City Council hereby, approves General Plan Amendment No.
2004-02 to change the land use designation for the property located at 2032 North Main
Street from General Commercial (GC) to District Center (DC).
Section 4. This Resolution shall take effect immediately after its adoption by
the City Council, and the Clerk of the Council shall attest to and certify the vote adopting
this Resolution.
