Jose Solorio Cc: Jill Arthur, Executive Director, External Affairs City of Santa Ana From: Christopher Townsend, President Chris Massey, Client Manager Date: May 27,2004 Subject: Memorandum Re: Proposal for Governmental Advocacy Services SCOPE OF WORK It is no longer enough to simply hire a lobbyist to monitor and advocate issues on behalf of a City. It is now more important than ever to maximize the City's opportunities to receive legislative support as well as state funding that can allow City General Fund dollars to be spent on increased public safety and local services to protect and support the citizens of Santa Ana and its visitors. Townsend Public Affairs, Inc. is the best choice for a government affairs specialist ideally prepared to create and ensure positive advocacy to protect local dollars and to target existing and potential capital funding opportunities for City libraries, parks, cultural centers, public works, and educational institutions,. Over the past few years, Townsend Public Affairs, Inc. has secured over $200 million in public funding for its clients and their projects, including over $5 million for the City of Santa Ana. Significant funding opportunities still remain in Propositions 40 and 50, as well as other sources, and Townsend Public Affairs, Inc. is ideally prepared to maximize these opportunities on behalf of the City of Santa Ana. These goals will require a comprehensive governmental advocacy strategy that will include the following: Advocacy Services with Local Legislative Delegation TPA will leverage its relationships with local Senate and Assembly offices to develop a significantly improved working partnership between the City and its representatives in the state legislature. This will include, but is not limited to, development of advocacy strategies, setting up briefings and encouraging bill sponsorship. TPA will also assist City staff in developing local positions that best suit the needs of the City while balancing political sensitivities in Sacramento. Enterprise Zones 85A-1 TPA will build on our previous efforts with the City of Santa Ana to protect the Enterprise Zone benefits that aid the city's economic development. We will help shape legislative proposals to extend the benefi' of the Enterprise Zone designation as well as promote other proposals through the legislature and thb Governor's Special Commission and Jobs and Economic Development State Funding Advocacy Our engagement with the City would focus on the City's priority projects and initiatives, which will include, but not be limited to, the following opportunities as previously identified in discussion with city management: Proposition 40: $128.4 Million Cultural and Historical Resources Fund Proposition 40 created a $267.5 million fund for the preservation of historical and cultural resources. $91.35 million was awarded in the Fall of 2002 as "opportunity grants". The remaining $128.4 million has been appropriated by the legislature to the recently created California Cultural and Historical Endowment (CCHE) within the Office of the State Library, which will be awarded this Fall via a competitive grant process that is being established this Spring. TPA would work on behalf of the City of Santa Ana to advocate for favorable guidelines and for subsequent grant funding from this source for its own project and/or a project in conjunction with another cultural, historic, or museum organization. Proposition 40: $50 Million 5B 359 Kevin Murray Fund: This funding, which is currently expected to be appropriated in the FY05 Budget, will be divided between the following two programs (and also be divided with roughly 60% going to the southern portion of the state, south of the Tehachapi Mountains, and 40% to the northern portion): 0 California Youth Soccer and Recreation Development Fund: (http://www.parks.ca .qov/default.asp?paqe id=22320) 0 State Urban Parks and Healthy Communities Fund: (http://www.parks.ca.qov/default.asp?paqe id=22321) How the fund will be divided between the Healthy Communities fund and the Soccer fund is entirely undecided at this point, and could be spent all on one program or half on each. Further, TPA can also help the City develop a competitive grant application for the $50 million remaining in the Murray SB 359 (Health Families and Youth Soccer Funds). This fund could assist programs such as the YMCA facility, as well as additional improvements at EI Salvador parks, which was partially funded in the past through our efforts. Proposition 50: $3.44 Billion Water Bond: Passed by the voters in November, 2002, Proposition 50 is in its implementation stage at this point. The portions of the bond that focus on water-related projects are being administered by three separate state agencies: the Department of Water Resources (DWR), the State Water Resources Control Board (SWRCB), and the Department of Health Services (DHS). Though some Proposition 50 funds will be awarded through existing programs, the proposition also called for the establishment of new criteria, and even the creation of entirely new programs. Townsend Public Affairs has been involved with the implementation of Proposition 50 since just after the bond passed and working groups began meeting to develop the implementing legislation. As existing programs have been modified, and new programs created, our participation in the working groups and our continuous involvement in the implementation process provide insight into the technical and political landscapes of those funding sources. 85A-2 8 8 8 Additional Services: While these sources represent some of the largest sources in the state, and hold a high degree of funding potential for the City of Santa Ana, they are by no means the only potential sources, nor do they represent the totality of our client service proposal. As a full-service government relations consulting firm, we will engage all our capabilities in service of the City, including: Sourcing of Additional Funding Programs Full engagement with the City and all of its departments will undoubtedly uncover projects, perhaps on a smaller scale, that are well-positioned for funding from sources that are often overlooked. TPA will work closely with staff to determine projects and funding sources. Federal Funding Requests In addition to our successful track record in seeking state funding, Townsend Public Affairs, Inc. has also secured funding from federal sources that have greatly benefited our clients. Relying on the support of local congressional champions, TPA has specifically targeted various earmarks in through the federal budget process. TPA will assist in identifying appropriate funding sources for City projects through federal channels. PROJECT ORGANIZA TION AND STAFFING Our Core Service Team: ~ Christopher Townsend, President ~ Chris Massey, Client Manager ~ Sean Fitzgerald, Client Manager ~ Isaac Kos-Read, Client Manager Our service team will work together to develop and implement a government funding and legislative advocacy strategy for the City of Santa Ana. Christopher Townsend's focus on this engagement will be continuing networking and advocacy with the various state and federal officials and agencies related to legislative and funding matters. Chris Massey will be your primary client contact and will ensure day-to-day delivery of service. He will be responsible for the working with your staff on items of interest as it relates to the City's immediate and long-term needs. Sean Fitzgerald and Isaac Kos-Read will provide support as secondary client managers, contributing their skills and experience in a wide range of areas. CONTRACT COST For full-service government and community-relations advocacy we generally charge public sector clients a fee that ranges from $5,000.00 to 7,500.00 per month. However, in recognition of the City's budget constraints and our reduced scope of work, we propose the following payment structure: $1,666.67 per month including expenses for a one-year period effective June 15, 2004 through June 15, 2005, for a total contract cost not to exceed $20,000.00. 85A-3 Although we generally structure all of our contracts over a 12-month period, be advised that the contra' would include a 30-day no-fault termination clause for either party to exercise in the event of changinb circumstances unforeseen at this time.
