RESOLUTION NO. 2004-033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF MISCELLANEOUS FEES FOR FISCAL YEAR 2004-2005 AND REPEALING IN PART RESOLUTION NO. 2003-050 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1: The City Council hereby, finds, determines and declares as follows: A. Each year, for the convenience of the public the City Council gathers in a single document a comprehensive listing of fees and service charges imposed by the City upon that limited number of persons seeking services of value from the City, For the public's convenience, various rates charged for City commodities, such as the water rate, are also included in this document. B. This document is known as the "Miscellaneous Fee Schedule" for Fiscal Year 2004-2005 and is attached to this resolution and made a part hereof by this reference. . C. As part of approving the Miscellaneous Fee Schedule for Fiscal Year 2004-2005, the various agencies of the City have analyzed the cost to administer the various programs, activities and applications for which the City charges, fees or service charges. D. In a few, limited circumstances, agencies have determined that the cost to the City to process or undertake the services set forth in the Miscellaneous Fee Schedule has increased over the prior fiscal year by approximately 3%, so that certain proposed fees for Fiscal Year 2003-2004 have been increased by this percentage, or by this amount rounded. These percentages reflect the change in the Consumers Price Index-Urban, All Services Component, for the Los Angeles-Riverside-Orange County area in a twelve month period. E. The Council finds that the cost of providing the services set forth in the Miscellaneous Fee Schedule has risen by 3% and that this reflects the cost of administering certain programs, activities or applications for which the City levies charges, fees or service charges. Such 3% increase does not exceed the City's estimated reasonable cost to provide the pertinent service, process the specified application or administer the certain program for which the charge, fee or service charge is imposed. . F. Similarly, in a few limited circumstances, new charges have been added or existing charges raised beyond this 3% cost of providing services. In each of these Resolution No. 2004-033 Page 1 of 60 cases, the Council further finds, determines and declares that such new or increased charges, fees or service charges do not exceed the City's estimated reasonable cost to provide the pertinent service, process the specified application or administer the certain program for which the charge, fee or service charge is imposed. G. In order to have a single comprehensive document for Fiscal Year 2004- 2005, the majority of fees which are unchanged have simply been reprinted in the Miscellaneous Fee Schedule. The Council expressly states that it is not its intention to repeal previously adopted fees and adopt new fees of exactly the same amount, but is simply repeating these fees so that the Miscellaneous Fee Schedule can continue to be a comprehensive source of City fees and service charges. H. As to the City's Park Acquisition and Development ("A&D") Fee, which is incorporated for the first time in this year's Miscellaneous Fee Schedule, the Council finds that as to this fee: 1. The fee is to be used to design and construct new park and recreation facilities to accommodate increased residential development in the City. 2. The public facilities to be constructed using this fee (plus additional funds, since the fee will not reimburse the city for all such costs) are identified in the report prepared by the City, a true and correct copy of which is on file with the Clerk of the Council. 3. There is a reasonable relationship between the use of the Park A&D Fee and the type of development on which the fee is imposed, in that the State Quimby Act acknowledges and the California Legislature has found that new residential development creates an impact on parks for which park fees of the sort charged by the City are an appropriate response. 4. There is a reasonable relationship between the new residential development the City anticipates in the next five years, and the type of residential development on which the fee is imposed because the fee is based upon the number of bedrooms developed (up to a maximum of five bedrooms) and the Council has found in adopting this fee that the more bedrooms in a residential development, the more impacts on park and recreation resources. 5. The City has been divided in four separate, designated areas, and the fees imposed and collected will be separated and designated for use in design and construction of public facilities in the area in which the residential project is located. The City will comply with Government Code § 66006. 6. The new Park A&D fee will take effect sixty (60) days from the date of adoption of this resolution. Resolution No. 2004-033 Page 2 of 60 . I. Based upon the testimony, reports and other evidence submitted on this matter, this city council makes the above-specified findings. Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2004-2005 is hereby adopted. Each fee or service charge set forth shall be levied until further resolution of this Council. Section 3: To the extent that any fee or service charge established pursuant to City Resolution No. 2003-050 is inconsistent with the fees or service charges established pursuant to this Resolution, then said Resolution No. 2003-050 is hereby repealed. Section 4: If any charge, fee, service charge, section, subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed and adopted this Resolution, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid. . Over the past several months the Firearms Unit has seen an increase in requests for evidence analysis from outside local, state, and federal agencies. These agencies rely upon various county (sheriffs department), state (Department of Justice), and federal (FBI) labs to complete these examinations. Unfortunately, the time from evidence submission to examination completion for theses labs ranges from months to years. Consequently, the Santa Ana PD Firearms Unit has offered its services and has assisted many of these agencies on a mutual aid basis, (including FBI, Oxnard PD, Hawthorne PD, Simi Valley PD, Orange PD, Tustin PD, and Ventura PD), completing thorough evidence exams in a more timely fashion. Due to the increase in requests and to recover personnel and other operational costs for this aid, the Firearms Unit proposes these fees be applied to outside agency requests. 9) Storage of Weapon Fee Proposed Fee(s): $100 Per Stored Weapon (when released pursuant to a Relinquishment Order for surrender of the firearm(s) per Family Code §6218) Department: Property&Evidence The Police Department accepts and stores surrendered firearms that are relinquished via a restraining order pursuant to Family Code §6218. This fee will recover a portion of the costs incurred by the Police Department for time spent and various other costs associated with the storage of each firearm.
