HomeMy WebLinkAbout04-20-1970MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA April 20, 1970 The meeting was called to order at 2:00 P.M., in the Council Chambers of the City Hall Annex, 500 West Sixth Street, with the following Councilmen present: Wade Herrin, Vernon S. Evans, J. Ogden MarkeL Jerry M. Patterson, Ray Villa, Harry K. Yamamoto, and Mayor Lorir Griset. Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Director of Planning Herbert Wieland, and Clerk of the Council Florence I. Malone. MINUTES It was moved by Councilman Herrin, seconded by Councilman Evans and unanimously carried, to approve the Minutes of the Regular Meeting of April 6, 1970, the Adjourned Regular Meeting of April 9, 1970~ and the Adjourned Regular Meeting of April 13, 1970, with a correction suggested by Councilman Villa in the April 6 Minutes regarding the Federal Rent Supplement Program, in the second sentence of the first paragraph on Page 86, to read as follows: "He read aloud a letter dated March 17, 1970, addressed to the Senior Planner, from Robert. Hirsch, which stated: 'iRe: 808 North Harbor Boulevard Harbor Park Apartments Dear' Mr. Zimmerman: I have just been informed about the action taken last evening in rescindiFg the earlier rent supplement r.~sotu~ion granted us for two locations within the City of Sanla Aha The facts of my presentation at an executive meeting of the City Council on January 19th seemed to have been grossly disloried by the citizen group last evening. For lhe record again, we asked for the rent supplement resolu- tion by the City for two specific locations we have in escrow since October. The passage on February 17ih allowed these two sites for participation in the Federal Rent Supplemeni Program. We could then accept as occupanls of apar~,ments lo be built at either site "qualified low income families who are elderly, handicapped, displaced, victims of natural disaster or occupants of substandard housing", The 17th and Fairview site was already zoned R-4 and we made application for an FHA insured mortgage under Section 221(d) (3} ~. ~ior citizen rent supplement. FHA has very little of these funds to place under this program and we were hopeful of obtaining FHA fc. uds by the summer. With respect to the Harbor and Hazard location which is presently zoned C-4, we were not even in a position to submit this until we knew apartments CITY COUNCIL -102- April. 20, 1970 MINUTES (continued) would be granted within this C-4 zone. Our plan consisted of a family type apartment project in which the smaller units (one and two bedrooms) would still be eligible under the Federal Rent Supplement Program for senior citizens. This development is not being designed expressly for senior citizens and now, as a result of last evenings unfortunate misstatements, which I did have a chance to rebut, we will not have rent supplement help available for senior citizens at this location either. With regard to the Harbor and Hazard property, we are still interested in pursuing this for a family type apartment project even without the rent supplement help for potential senior citizen tenants. Our request, therefore, at the April 13th hearing before the planning co~ission is a variance to allow a planned garden apartment complex in a C-4 zone. I personally regret the actions of some individuals before your City Council last night, and trust my comments have helped to clarify what our plans had been. I now will have to cancel the escrow at 17th and Fairview be- cause of the lack of rent supplement help for the 120 one bed- room apartments we proposed for that 4 plus acre site. EXECUTIVE SESSION At 2:10 P.M., the City Council adjourned to Executive Session for approximately one hour for consideration of appointments to the Civic Center Commission for replacement of Thomas F. Larsen, who has resigned, and R. H. Kopel, whose term has expired, and to consider appointments to the Numan Relations Comaission. The Council reconvened at 4:17 P.M., with all Council members present, and Mayor Griset stated that announcement of appointments for both the Civic Center Co~mission and the Human Relations Commission would be made at the May 4 Council meeting. SPEC. 641-186 - FIRE NOSE On motion of Councilman Nerrin, seconded by Councilman Evans and unanimously carried, Council ordered filed report of bids received for Spec. 641-186, Fire Hose, 250 ft. of 3", 9,000 ft. of 2 1/2", 5,000 ft. of 1 1/2"; awarded contract to the low bidder, Herbert D. Porter; and rejected all other bids. PROJECT 6024 - RESTROOM On motion of Councilman Nerrin, seconded CEntENNIAL PARK by Councilman Evans and unanimously carried, Council order filed report of bids received for Project 6024, Construct Restroc~ Building in Centennial Park; awarded contract to the low bidder, Gentosi Bros.; and rejected all other bids. CITY COUNCIL -103- April 20, 1970 BID CALLS On motion of Councilman Herrin, seconded by Councilman Patterson and unanimously carried, Council approved plans and specifications and authorized advertising for bids for the following: Spec. 371-116, Cast Iron Pipe & Cast Iron Fittings, opening May 15; Spec. 631-131, Gate Valves, Iron Body, annual requirement, opening May 15; Project 6028, Concrete Sidewalk and Asphalt Sidewalk in Prentice Park, opening May 25; Project 6030, Sprinkler System in Centennial Park, opening May 25; Project 1324, Santa Ana Boulevard from Santiago to Grand, opening May 25; Project 6018, Construction of La Bolsa Park, Phase I - Site Development and Recreation Building, opening May 26. PROPOSED ANNEXATION After considering the Manager'S report RES. 70-40 on Proposed Annexation of Marine Corps Air Station, Santa Ana to City of Santa Ana, the City Council adopted RESOLUTION 70-40 REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO APPROVE THE ANNEXATION OF THE MARINE CORPS AIR STATION AREA TO THE CITY OF SANTA ANA, on motion Councilman Evans, seconded by Councilman Herrin and unanimously carried. SURPLUS BUILDING After considering Surplus Property Report SPR 70-7 70-7 regarding store building at 102 N. NS-1008 The City Council waived full MOBILE HOME PARKS reading and passed to second reading ORDINANCE NS-1008 AMENDING THE SANTA ANA MUNICIPAL CODE BY ADDING ARTICLE X TO CHAPTER 41 THEREOF TO ESTABLISH DEVELOPMENT STANDARDS FOR MOBILE HOME PARKS, on motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried. CHICAGO SEVEN Councilman Herrin requested that the Council go on record as support- ing a proposed resolution of the Board of Supervisors protesting the appearance of five members of the "Chicago Seven" at the University of California Irvine on Sunday, April 26. After some discussion, Councilman Herrin stated that he would bring a copy of the proposed Board of Supervisors' resolution to the evening meeting for further discussion at that time. BID CALL Acting upon the recommendation of the City Manager, it was moved by Councilman Evans, seconded by Councilman Patterson and unanimously carried, to extend the April 23 bid opening date for Specification 641-189, Fire Extinguishers, to May 15, 1970. RECESS At 5:10 P.M., the meeting was recessed to 7:30 P.M., at which time it was reconvened, with all Council members present. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by the Reverend Robert H. Scott of the First Nazarene Church. PUBLIC HEARING Hearing was opened on the proposed FII~ ZONES - ORD. NS-1012 changes in the Fire Zones of the City. There being no response to the call for testimony, the hearing was closed. CITY COUNCIL -108- April 20, 1970 ORDINANCE NS-1012 AMENDING THE SANTA ANA MUNICIPAL CODE BY REPEALING AND RE-ENACTING SECTIONS 8-40, 8-41 AND 8-49. THEREOF RELATING TO THE CREATION OF AND BOUNDARIES OF FIRE ZONES was passed to second reading, on motion of Councilman Herrin, seconded by Councilman Patterson, on the following roll call vote: AYES: NOES: ABSENT: Herrin, Evans, Markel, Patterson, Villa, Yamamoto, Griset None None PUBLIC HEARING Hearing was opened on establishment S. On motion of Councilman Evans, seconded by Councilman Yamamoto, the City Council approved the recommendation of the Planning Commission and instructed the City Attorney to prepare the amending ordinance, designating alignment of Alton Avenue from Main Street to Halladay Street, a distance of 2, 500 feet, as shown in S/P. S.A. On motion of Councilman Evans, seconded by Councilman Markel, Amendment Application No. 654 was approved and the City Attorney was instructed to prepare an ordinance to reclassify the property according to Exhibit A, on the following roll call vote: AYES: Herrin, Evans, Markel, Patterson, Villa, Yamamoto, Griset NOES: None ABSENT: None Due to a conflict of interest on the following two items, Mayor Griset left the Council Chambers. Grand, who read a letter written by bis father, of the same address, who is out of town, objecting to the amendment application, citing adjacent properties are zoned R 1, that Old Grand cannot handle increased traffic; that it would set a precedent for apartment zoning requests on the remainder of the surrounding undeveloped property, and that it is the only area left in the City for R-1 development. John Leahy, 2640 N. Linwood, who stated that the adjoining property owners had presented a petition containing approximately 200 signatures to the Planning Commission objecting to the R 4 zoning; that the R 4 has saturated the area, and that it would create a traffic problem. Judith Zander, 2611 Linwood Avenue, who displayed maps of the area showing present use of the land and stated that the proposed rezoning would set a precedent of R-4 zoning for remaining parcels. Gary Woods, 1413 E Keegan Way, who stated that the area had reached the saturation point in apartments constructed or under cons}ruction. Jerry Kress, 1420 E. KeeganWay, who spoke on the overcrowd- ing of the scbools which R 4 would bring about. William Stillway, 1402 E. Keegan Way, who spoke on the traffic problem that would be created by R 4 zoning in the area In rebuttal~ Mr. Bueche stated that statistics show 3 (;hildren per mit per apartment per net acre composed to 1.2 in R-1 zoning; that ~he prezoning revolves only 8 acres which in no way commits the City ~o similar zoning of neighboring properties; snd that traffic: may be ~.~u]att:d by various methods that are available to the City when the development plans are submitted. After discussion by Council, on motion of Councilman Patterson, seconded by Councilman Markel, Amendment Application 655 was denied,' on the following roll call vote: AYES: NOES: A BSE NT: Herrin, Evans, Markel, Patterson, Yamamoto Villa Griset PUBLIC HEARING Hearing was opened on Amendment A.A. 656 - SCHILDMEYER Application No. 656, filed by Marie R. Schildmeyer, proposing amend- ment of Sectional District Map 6-5-9, to rezone from the A 1 District to the C 5 District property located on the east side of Glassetl Avenue between Santa Clara Avenue and Fairhaven Avenue. Frank Bueche, 1971 S. Ritchey Street, spoke in favor of the amendment application, No one spoke in opposition. The hearing was closed. On motion of Councilman Patterson, seconded by Councilman Markel, Amendment Application 656 was approved and the City Attorney was instruct- ed to prepare an ordinance to reclassify the property according to Exhibit A, on the following roll call vote: AYES: NOES: ABSENT: Herrin, Evans, Markel, None Griset Patterson, Villa, Yamamoto Mayor Griset returned to the Council table. RECESS present. At 9:30 P,M., a five minute recess was declared. The Council reconvened at 9:45 P.M., with all Council members PUBLIC HEARING - APPEAL 232 Hearing was opened on Appeal 232, filed CUP 70-2 - LIGHTFOOT by Oliver Peterson, appealing the Zoning Administrator's approval of CUP 70-2 filed by Jack L. Lightfoot. to construct and operate a riding stable with monthly horse shows in the A 1 District at 4726 1/2 West Fifth Street. The following persons spoke in favor of the appeal: Arthur J. Bilava, 1571 W. Katella, Anaheim, representing the appellant, who stated that if the conditional use permit were granted~ the horse shows would cause traffic problems, sanitation problems, dust, and noise; that it would be detrimental to the CITY COUNCIL -111- April 20, 1970 PUBLIC HEARING - APPEAL 232 CUP 70-2 - LIGHTFOOT (continued) Arthur J. Bilava (continued) health, safety and general welfare of the persons residing in the vicinity; that no use was specified in the Municipal Code for horse shows; and that the conditional use permit would adversely affect the General Plan since the area was designated for medium residential use; Mrs. Oliver Peterson, 4718 W. 5th Street, who stated that they were not opposing the animals, but that they could not open their doors, hang clothes, etc. because of the dust and that the dust was harmful to her heart and emphysema conditions; Wanda Goddard, 4714 W. 5th Street, who stated that the dust adversely affected the health of her granddaughter who lives with her and has asthma; Mr. Rose, 4626 W. 5th, who objected to the dust from the horse shows and from the unpaved parking lot; Oliver Peterson, 4718 W. 5th Street, the appellant, who objected to the dust and stated that two letters were on file with the Planning Commission objecting to the conditional use permit and they were not read at the Planning Commission meeting; at the Mayor's request, the Clerk of the Council read aloud the two letters on file from Albert Adams, 2301 S. Shelton and from Lorene 1Rickard, 4726 W. 5th Street, objecting to the flies and dust from the stable; Jim Scheuneman, who expressed the opinion that there should be no horses in the area, since they were being ridden on the streets; Albert Adams, 2301 S. Shelton, also spoke. The following persons spoke in opposition to the appeal: Wallace Cloud, 2721 N. Laird Street, who explained that one of the conditions in the use permit was that the dust factor be curbed and that a process of oiling was being done at the present time that would take care of the dust problem when it was completed, He stated that a dairy was west of the subject property, directly to the south was a chicken ranch, another stable was southeast of the property, and to the east was Mr. Peterson's property; that Mr. Peterson kept horses and dogs on his property, creating dust; that only two horse shows had been held since July 1, 1969, and that the cars all parked in the arena area; and that the home owners on the north side of the street had no objection to this stable; Jack Lightfoot, 202 S. Newhope, the applicant for the conditional use permit and owner of the stable, explained that dumpsters came in three times a week to take away the manure so that was not a problem and that the dust problem was being taken care of by the oil processing. The Planning Director explained that the area is an agricultural zone and there have been no requests for changing the zoning; that with the conditional use permit, the riding stable is a permitted use. After discussion regarding pre-existing uses (before an area was annexed) and the policy not to allow expansion of pre-existing uses, it was moved by Councilman Villa, seconded by Councilman Herrin, to table the decision on the mat~er until the May 4 Council meeting for a staff report on legal and illegal uses in the A-1 zone; to explain the facts on what is permitted and what is not permitted there; and an explanation of the A 1 ~.one purpose. M., with all Council members WALKWAY CLOSING Council considered the petition REQUEST containing approximately 13 signatures of residents of the 2600 block of North Louise requesting permission to close the walkway at the end of the cul-de-sac with a six foot wall. On motion of Councilman Herrin, seconded by Councilman Markel and unanimously carried, Council approved the staff recommendation and authorized the closure at the property owners' expense of the pedestrian walk-way at the north end of the Louise Street cul-de-sac at Memory Lane. BUDGET TRANSFER On motion of Councilman Herrin, seconded by Councilman Yamamoto and unanimously carried, Council authorized Budget Transfer from Fund 51-231, Recreation and Parks, Administration, to Fund 51-267, Recreation and Parks Macco Tract Park No. 1, in the amount of $6,000.00. REIMBURSEMENT On motion of Councilman Herrin, seconded by Councilman Yamamoto and unanimously carried, Council authorized reimbursement to Cameo Homes for street improvements on the north side of Fairhaven, west of Tustin, in the amount of $2,490.45. CHICAGO SEVEN Councilman Herrin read portions of the proposed resolution of the Board of Supervisors to be considered at CITY COUNCIL -113- April 20, 1970 CHICAGO SEVEN (continued) their meeting of April 21, protesting the appearance of five members of the "Chicago Seven" at the University of California Irvine on April 26. After discussion, it was moved by Councilman Herrin, seconded by Councilman Markel and unanimously carried, that the Mayor be directed to send a letter to the Chancellor at the University of California Irvine, stating the City Council's position that it condemns any action which would give status and prestige to the five members of the "Chicago Seven" appear- ing there on April 26 or to any group which advocates the overthrow of the United States government or the wanton destruction of property or violation Of human rights. STATE BAR ASSOCIATION On motion of Councilman Herrin0 CONFERENCE seconded by Councilman Patterson and unanimously carried, City Attorney William L. Mock was authorized to attend the State Bar Association Conference in Los Angeles in September as an alternate delegate at City expense. JEROME PARK in and around Jerome Park. Councilman Villa stated that the Council had heard reports of gambling, sex, sex perversion and dope activity The City Manager responded that there had been fewer problems at Jerome Park than could have been anticipated and that he would defend its use on any occasion. Foll~)wing further discussion, the Council requested a staff report on the conditions at Jerome Park on motion of Councilman Evans, seconded by Councilman Patterson and unanimously carried. EARTH DAY PARADE Ernie Wallengren, Santa Ana High School student, representing the Santa Aha Ecology Club, requested permission of Council to hold a parade around the perimeter of the high school on Wednesday morning, Ap~l 22, at 8:00 A. M., in conjunction with "Earth Day". The request was granted, on motion of Councilman Herrin, seconded by Councilman Villa and unanimously carried. ADJOURNMENT At 11:35 P.
