HomeMy WebLinkAbout06-15-1970MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA June 15~ 1970 The meeting was called to order at 2:10 P, M., in the Council Chambers of the City Hall Annex, 500 West Sixth Street, with_ the following Councilmen present: Vernon S. Evans, Jerry M, Patterson, Harry K. Yamamoto, and Vice Mayor Wade Herrin, Councilmen J. Ogden Markel, Ray Villa and Mayor Lorin Griset were absent due to their attendance at the Conference of Mayors in Denver. Also present were City Manager Carl J. Thornton, City Attorney William L. Mock, Director of Public Works Ronald Wolford, Director of Planning Herbert Wieland, and Clerk of the Council Florence I. Malone. MINUTES On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, the Minutes of the Regular Meeting of June 1, 1970 and the Adjourned Regular Meeting of May 26, 1970 were approved as submitted. O~ANC, F~ COUNTY FAIR Cecil Marks, President, Orange County Fair and Jim Garvey, Feature Exhibit Supervisor, spoke to the Council in regard to the City's decision not to exhibit at the Fair this year. They explained that most cities, with contributions and help of manufacturers and merchants, put together a very attractive exhibit for as little as $50, 00 to $]50.00, and that they would very much like to have Santa Ana as an exhibitor since it is the County Seat. It was suggested that Mr, Marks and Mr, Garvey contact the Chamber of Commerce and pursue the matter through the Chamber, SPEC. 371-117 - PIPE AND FITTINGS On motion of Councilman Evans, seconded by Councilrnan Patterson and unanimously carried, award of contract for Spec. 371-]17, Asbestos Cement Pipe & Cast Iron Fittings for Asbestos Cement Pipe, was continued to the July 6 Council meeting~ SPEC. 63]-133 On motion of Councilman Evans, seconded DOMESTIC WATER METERS by Councilman Yamamoto and unanimously carried, Council ordered filed report of bids received for Spec~ 631-]33, Domestic Water Meters; awarded contract for the 3/4" x 1" me~ers, the 1 1/2" meters, and the 2" metersto Rockwell Manufacturing Company, the lowest and best bidder meeting the specifications; awarded contract for the 1" meters to ©amon-Calmet Company, the low bidder meeting the specifications; and rejected ali other bids. CITY COUNCIL -158- June 15, 1970 SPEC. 631-134 On motion of Councilman Patterson, seconded COMPOUND WATER METERS by.Councilman Evans and unanimously carried, Council ordered filed report of bids received for Spec. 631-134, Compound Water Meters; awarded contract to Rockwell Manufacturing Company, the lowest and best bidder meeting the specifications; and rejected all other bids. PROJECT 6018 - LA BOLSA PARK On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, Council ordered filed report of bids received for Project 6018, Construction of La Bolsa Park, Phase I - Site Development and Recreation Building; awarded contract for base bid only to ~e low bidder, GordonG. Montgomery Construction, Inc.~ and rejected all other b~2S. PROJECT 1324 On motion of Councilman Evans, seconded SANTA ANA BOULEVARD by Councilman Patterson and unanimously carried, Council ordered filed report of bids received for Project 1324, Construction of Santa Ana Boulevard from Santiago Street to Grand Avenue; awarded contract to the low bidder, Sully-Miller Contracting Company; and rejected all other bids. PROJECT 7014 - MUSEUM On motion of Councilman Patterson, SECURITY SYSTEM - FIRE seconded by Councilman Evans and DETECTION unanimously carried, the bid opening date for Project 7014, Furnish and Install Intrusion Security System and Fire Detection System in Charles W. Bowers Memorial Museum, was extended to June 26, 1970 in order to give the bidders additional time. BID CALLS On motion of Councilman Evans, seconded by Councilman Yamamoto and unanimously carried, Council approved plans and specifications and authorized advertising for bids for the following: Project 6033 - Construct Cougar Cage in Prentice Park and Concession Stand in Municipal Stadium, opening July 23 (to be encumbered in 1969-70 Budget)~ Project 4007A (D-68) - Construct C-5-F Storm Drain in Harbor B]vd, from C-5-F Channel to 400 feet north and to include La Bolsa Park Lateral, opening July 23 (to be encumbered in 1970-71 Budget). Project 2021 - Construct: (1) West side of Grand from McFadden to 1500 feet north and McFadden from Grand to 250 feet west; (2) Northeast corner of Dyer Road and Main Street; /3) South side of First from Fairview to Sullivan; (4) East side of Westwood from 310 feet north of Memory Lane to Corrigan, south side of Corrigan from Westwood to Freeman, and west side of Freeman from Corrigan to 445 feet south; {5) South side of Dyer Road from 800 feet west of Main Street to Main Street and west side of Main Street from 250 feet south of Dyer Road to Dyer Road; opening July 24 (to be encumbered in 1970-71 Budget). CITY COUNCIL -159- June 15, 1970 READING WAIVED On motion of Councilman Evans, seconded by Councilman Patterson and unanimously carried, the fall reading of ordinances and resolutions~ the titles of which appeared on the public Agenda, was waived. ORD. NS-,1020 Council considered ORDINANCE NS-1020 ANIMAL CONTROL AMENDING THE SANTA ANA MUNICIPAL CODE BY REPEALING AND RE-ENACTING CHAPTER 5 THEREOF RELATING TO ANIMAL CONTROL, passed to second reading on June 1 with deletion of all reference to hobby ,kennels. After discussion, on motion of Councilman Evans, seconded by Councilman Yamamoto and unanimously carried, consideration of adoption of Ordinance NS-10g0 was continued to July 6 and the City Attorney was instructed to check out the problem of distances from pre-existing kennels (Section 5-13 (c)). NS-1021 ORDINANCE NS-1021 AMENDING THE SANTA MUSEUM BOARD ANA MUNICIPAL CODE BY AMENDING SECTION 2-551 OF DIVISION 5 OF ARTICLE IV, CHAPTER 2 THEREOF RELATING TO BOARD OF MUSEUM TRUSTEES was adopted, on motion of Councilman Evans, seconded by Councilman Patterson, on the following roll call vote: AYES: Evans, Patterson, Yamamoto, Herrin NOES: None ABSENT.'-' Markel, Villa, Griset ORD. NS-1022 - A.A. 658 ORDINANCE NS-1022 PREZONING AND ADAMS, GATES ESTABLISHING DISTRICT CLASSIi~CATION ON AMENDMENT APPLICATION 658 FILED BY JOHN C. ADAMS AND S.N. RES. 70-55 RESOL~JTION 70-55 OF THE CITY MICROFILM STORAGE COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING THE STORAGE OF MICRO- FILMED RECORDS IN THE VAULT OWNED BY THE COUNTY OF ORANGE AND LOCATED AT THE JOPLIN BOYS' RANCH was adopted, on motion of Councilman Patterson~ seconded by Councilman Evans and unanimously carried. RES. 70-56 RESOLUTION 70-56 OF THE CITY AHFP PROGRAM COUNCIL OF THE CITY OF SANTA ANA TO PROVIDE ANNUAL REQUALIFICATIONS FOR PARTICIPATION IN THE ARTERIAL HIGHWAY FINANCING PROGRAM was adopted, on motion of Councilman Patterson, seconded by Councilman Yamamot6 and unanimously csrried. CITY COUNCIL -]60- June 15, 1970 STADIUM CONCESSION On motion of Councilman Patterson, se'conded by Councilman Evans and unanimously carried, Council authorized execution of a two year extension of the Stadium Concession Agreement with Lauren Proctor. ENCROACHMENT On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, Council authorized execution of agreement with Transamerica Title Insurance Company and W. Bradford Hellis and Mary S. Hellis as Trustees for encroaching sign at 1702 North Main Street. CHANGE ORDERS the following Change Orders: On motion of Councilman Yamamoto, seconded by Councilman Evans and unanimously carried, Council approved No. 1 to contract with R.J. Noble, Project 2020, Omnibus Street Construction, increasing in the amount of $461.28. No. 1 to contract with Lorco Properties Incorporated, Project 7011, Minor Modifications in Police Building, increasing in the amount of $541. 50. No. 1 to contract with Handley Construction Company, Project 6006A, Construction of Santa Clara Avenue and Grand Avenue, increasing in the amount of $186.30. VARIANCE APPLICATION 70-19 The Council considered affirmation of FAIRVIEW PROPERTIES Variance Application 70-19, filed by Fairview Properties, to construct a 233-unit garden apartment complex in the M 1 District at 3001 West Sunflower Avenue, approved by the Planning Commission on May 25, 1970, and recommended for denial by the. City Manager. The City Attorney explained that if Council did not wish to affirm the Planning Commission's approval, the matter should be set for a public hearing, according to the Municipal Code provisions. CITY COUNCIL -161- June 15, 1970 VARIANCE APPLICATION 70-19 - (Continqed) Mr. M. Douglas, the developer; Eugene Katnik, 1205 North Broadway, attorney representing the owners of the property; and Ed Riddle, 208 Victoria, Costa Mesa, realtor, were present and objected to the matter being set for a hearing since no appeal had been filed and there had been no opposition expressed by property owners in the area. Council discussed the matter at length. A motion was made by Councilman Evans, seconded by Councilman Yamamoto, to adopt the findings of fact, conclusion and decision of the Planning Commission as action of the City Council on Variance Application 70-19, which motion failed adoption on the following roll call vote: AYES: NOES: ABSENT: Evans, Yamamoto Patterson, Herrin Markel, Villa, Griset The City Manager explained that the General Plan zoned this area for industrial use; that a major street has been developed by the City at this location in conformance with the Master Plan, one of the major north-south streets in the City of Santa Aha, which had cost several million dollars to develop; that industrial lands are relatively small in proportion to the rest of the City; and that the General Plan Map is a master g~ide for the City, the fairest distribution for property owners and for balance in the community. He further stated that there has been an inversion in the values of properties, that an owner can greatly increase the value of his land if he can have his industrial property rezoned to apartment property; and he stated that this _was a direct and deliberate invasion of industrial use that has been set out by our General Plan. On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, Variance Application 70-19 was set for public hearing on July 6, 1970, at 7:30 P.M., in the Council Chambers, City Hall Annex, 500 West Sixth Street. RECESS members present. At 4:05 P.M., a five minute recess was declared. The Council reconvened at 4:12 P.M., with the same Council VARIANCE APPI~ICATION 70-23 Council considered a£firmation of NATIONAL LAND DEVELOPMENT Variance Application 70-23, filed by COMPANY National Land Development Company, to construct a 74-unit apartment- motel complex in the C 1 District at 2151 East First Street, approved by the Planning Commission on May 25, 1970. Councilman Patterson stated that there were several things he questioned in regard to the subject variance, such as limited amount of space, use of commercial zone for a residential purpose and only 8% open space.- - CITY COUNCIL -162- June 15, 1970 VARIANCE APPLICATION 70-23 - (Continued) The Planning Director explained the definitions of apartments and of motels as set out in the Code, stating that if this development were compared to apartment house standards, it would be deficient, and that staff recommended denial because the development seemed to be a sub-standard apartment in view of the number of kitchen units proposed; however, the Planning Commission had recommended approval. After discussion, on motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried, Variance Application 70-23 was set for public hearing on July 6, 1970, at 7:30 P.M., in the Council Chambers, City Hall Annex, 500 West Sixth Street. VARIANCE APPLICATION 70-25 On motion of Councilman Patterson, WARLEN COMPANY seconded by Councilman Evans and unanimously carried, Council adopted the findings of fact, conclusion and decision of the Planning Commission as action of the City Council on the following: VA 70-25, WARLEN COMPANY - construct 18 fourplexes on property in the R 2 District at 4001 W. McFadden - APPROVED. SOLICITATION APPLICATION On motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried, Council ratified the administrative approval of the Solicitation Application of the Girls Club of Santa Ana, sale of American Flags, June 13, 1970. TRAFFIC man Patterson, Report of control devices removed or installed May 20, 1970 - June 9, 1970 was ordered filed, on motion of Council- seconded by Councilman Yamamoto and unanimously carried. MINOR EXCEPTIONS filed the following Minor Exceptions: On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, Council ordered EX 70-2, DELUNA - construct room addition within 8'2" from /he rear property line in the R 1 District at 2042 W. 10th Street - APPROVED; EX 70-3, RED CROSS - waive the required 6' high masonry wall along the easterly property line in the LP District at 601 N. Golden Circle Dr. - APPROVED. PARCEL MAP 663 Parcel Map 663, filed by National Land Development Company, creating two (2) A 1 parcels on the southwest corner of Fairhaven and Grand Avenue, was approved subject to conditions in CITY COUNCIL -163- June 15, 1970 PARCEL MAP 663 - (Continued) Planning Director's report dated June 3, 1970, and alley requirement was waived, on motion of Councilman Evans, seconded by Councilman Patterson and unanimously carried. PARCEL MAP 664 Parcel Map 664, filed by Donald H. and Helen Kay, creating four (4) M 1 parcels on the northeast corner of St. Gertrude Place and Grand Avenue, was approved subject to conditions in Planning Director's report dated June 10, 1970, and alley requirement was waived, on motion of Councilman Evans, seconded by Councilman Patterson and unanimously carried. SURPLUS BUILDING - SPR 70-11 After considering Surplus Property Report 70-11 regarding residence at 123 West 17th Street, Council declared the building surplus and authorized demolition, on motion of Councilman Patterson~ seconded by Councilman Evans and unanimously carried. MEMORIAL PARK The City Manager's report on the petition requesting improvements at Memorial Park, referred to staff by Council on June 1, was ordered filed and the Clerk was instructed to inform the interested parties, on motion of Councilman Patterson, seconded by Council- man Yamamoto and unanimously carried. PROPOSED PARK NAMES AND The Manager's report on recommendations STADIUM USE from the Board of Recreation and Parks regarding the naming of two parks and a proposed use of the Municipal Stadium was continued to the July 6 Council meeting when the full Council is present, on motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried. DEEDS On motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried, Council ordered filed the Report of No-Cash Deeds accepted by the City Manager, pursuant to Resolution No. 69-156, from May 28, 1970 through June 10, 1970, inclusive; authorized execution of No-Cash Deed by the Mayor and Clerk to various owners of record, west side of Bristol, south side of Segerstrom, for vehicular access rights; and approved and authorized execution of escrow by the Mayor for Deed with cash to the City, Fortune, east side of Harbor, south of First Street, for drainage purposes. RECESS At 4:40 P.M., the meeting was recessed to 7:30 P.M., at which time it was reconvened with the same Council members present. Following the Pledge of Allegiance to the Flag, the Invocation was delivered by Chaplain Baerg of the Orange County Medical Cenler. CITY COUNCIL ~164- June 15, 1970 SPECIAL AWARD Fire Chief William Puffer introduced BRYAN FRANCIS and commended Bryan Francis, age 12, who had heroically rescued a man from a house aflame at 1522 South Oak Street. He then introduced Jim MacLean, of KWIZ Radio Station, who presented a new award, a perpetual trophy, the KWIZ Kool Head Award, to the City of Santa Ana, with Bryan's name engraved as the first name on the trophy. Bryan was presented with the trophy in miniature, a savings bond and an Award of Merit from the District Attorney's office. Vice Mayor Herrin expressed the Council's congratulations to Bryan and explained that when the full Council is present, the decision will be made for the location where the trophy will be kept. PUBLIC HEARING Hearing was opened on Appeal No. 236, APPEAL 236 - VA 70-24 filed by Rockwell Farms, Inc., appealing ROCKWELL FARMS, INC. the Zoning Administrator's decision of May 25, 1970 denying Variance Application 70-24, filed by Rockwell Farms, Inc., to permit an auto repair shop in the C 1 District at 112 West St. Gertrude Place. Charles Rockwell, Rockwell Farms, Inc., owner of the property, spoke in favor of the appeal. He explained that a variance was granted in 1966 for an auto repair shop on the property which remained there until 1969, at which time a furniture repair shop went in. Mr. Rockwell stated that he put $1700 in improvements on the property when variance was granted in 1966 and that he was not aware the variance expired when the furniture repair shop went in. He explained that when the property was rented, it was kept in good maintenance and that he was presently putting in new blacktop paving. Bob Mason, Tustin, the previous renter who had operated the furniture repair shop, also spoke in favor of the appeal. M.E. Treadgold, 2070 S. Sycamore, representing the surrounding property owners, spoke in opposition to the appeal. He explained that most of the people in the neighborhood are elderly people who had planned on living and retiring there and had put much effort and money into their property and until recently, it was a very nice residential district. He stated that when the former auto repair shop was located there, the neighboring residents were subjected to loud noise from morning until late at night, odors from the oil and grease, accumulated trash; and that the noise and odors affected the health of the people and lowered their property values. Mr. Treadgold also stated that repairs of autos were going on at the location now before the variance was granted, and that there were not enough parking stalls. Mrs. Rutt, 2115 S. Sycamore, and Dan Detweiler, 2116 S. Sycamore, also spoke against the appeal. The hearing was closed. After discussion by Council, it was moved by Councilman Patterson, seconded by Councilman Evans, to uphold the action of the Zoning Administrator, deny the appeal, and instruct the City Attorney to prepare a resolution denying Variance Application 70-24. The motion was adopted on the following roll call vote: AYES: Evans, Patterson, Herrin NOES: Yamamoto ABSENT: Markel, Villa, Griset CITY COUNCIL -165- June 15, 1970 DAIRY PROBLEMS Council considered the petition containing approximately 55 signatures of residents in the area of the Fountain Valley Dairy, 10800 Edinger, Fountain Valley, requesting an effective method of eliminating the flies and odors in the area. The City Attorney explained that there were provisions in the Municipal Code pertaining to these matters and that the Orange County Health Department is the enforcement agency for these provisions. The City Manager explained that all of the cities in Orange County had adopted a uniform ordinance in 1962 regarding this subject and that the level of enforcement was the same in all Orange County cities. Don Lake, 5124 Lenhart, Santa Ana, spokesman for a group of people at the Council meeting in regard to the matter, explained that the people on the north side of the dairy lived in Santa Ana, and the conditions were very bad, especially in regard to flies; that they were _asking both the Cities of Santa Ana and Fountain Valley for help. Jayne Shockey, 5426 W. Lenhart, complained about the severity of the fly problem at her home, and Harriett Bridge, 5422 W. Lenl~rt, also spoke. On motion of Councilman Patterson, seconded by Councilman Yamamoto and unanimously carried, the staff was instructed to coatact the Orange County Health Department at the earliest possible time in regard to the fly problem and to communicate with the City of Fountain Valley in an attempt to resolve the fly and the health problem in the area of the Fountain Valley Dairy. 1970-71 BUDGET On motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried, the City Council set the 1970-71 Budget for public hearing on July 20, 1970, at 7:30 P.M., in the Council Chambers, City Hall Annex, 500 West Sixth Street, and instructed the Clerk of the Council to suggest to the absent Council members the dates of June 29 and July 13, 1970 at 7:00 P.M., in the Mayor's office, City Hall, for study sessions of the Budget. ABORTION CLINIC Robert Sassone, attorney, 615 West Civic Center Drive, addressed the Council, stating he was the spokesman for approximately 1000 Santa Aha citizens who objected to the operation of an abortion clinic at 1856 West 17th Street in Santa Ana, requesting that the City find a cause to close this clinic, as the citizens are very concerned about it. The City Attorney explained that the matter is being handled by the District Attorney and is before the Court at this time; that there are probably no grounds which the City could pursue in the matter; and the City Manager explained that the City is usurped by the State in these matters. Ken Nielsen, 700 West 8th Street, and Jane Hittinger, 1504 W. Ebony Drive, Anaheim, also requested the Council or the City to take some action to stop the doctor from practicing. The matter was referred to the City Attorney for report back to the Council, on motion of Councilman Patterson, seconded by Councilman Evans and unanimously carried. CITY COUNCIL -167- June 15, 1970 TOPLESS BARS Anthony Nieto, 10692 Kern, Garden Grove, addressed the Council, requesting that something be done to get rid of the topless bars in the City. It was explained to Mr. Nieto that the City is preempted by the State in these matters also; that the City Attorney is currently preparing a report for Council on zoning for beer bars to see if the City can't regulate to keep them a specific distance from residential and school zones; but that the Judiciary has protected the activities in which these people are engaged and have ruled such conduct permissible under the First Amendment to the Constitution.
