Direct the City Attorney to prepare and authorize the City Manager and the
Clerk of the Council to execute an amendment to the legal services
agreement with Gibbons & Conley increasing the hourly rate from $125 to
$175.
DISCUSSION
Under the direction of the City Attorney's Office, the law firm of Gibbons
& Conley has provided legal services to the City Attorney's Office and
Risk Management Divisions in the specialized area of insurance coverage,
involving both private insurance and the City's Big Independent Cities
Excess Pool (BICEP) joint powers authority. The City has utilized the
services of Gibbons & Conley for the last 15 years. They have the
necessary expertise and familiarity with BICEP, excess coverage, and
municipality issues to provide the City with competent legal services.
In 1998 the approved hourly rate was $125 per hour. Since then the firm
has informed us that their rates have increased to $175 per hour. This
rate remains highly competitive for a firm with Gibbon's background and
expertise.
