DISCUSSION Since 1997, property owners who have been cited by Community Preservation for code violations have been offered mediation through hearing officer proceedings. As an alternative to court proceedings, hearings are conducted by the City pursuant to the Alternative Abatement Proceedings in accordance with Article VIII of Chapter 17 of the Santa Ana Municipal Code. For the past eight years, the City has utilized contracted services for nuisance abatement hearings for the Planning and Building Agency. Recently, our hearing officer notified the City that she will not be renewing her contract. In order to continue to provide the option of administrative hearing, it is recommended that the City contract with Ms. Barbara A. Echan of Coastal Mediation Services to provide these services. Ms. Echan, the sole proprietor of the company, has extensive experience as a mediator in areas that include code enforcement, civil matters, and community disputes, as well as District Attorney referred criminal cases. 25F-1 Agreement with Coastal Mediation Services November 15, 2004 Page 2 FISCAL IMPACT Funds in the amount of $20,000 are available in the account for other personnel services (account no. been allocated for this purpose in the Planning annual budget for FY 2004-05.
