SECOND AMENDMENT TO
CONSUL T ANT AGREEMENT
THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered
into on the 28th day of June 2004, by and between Bartel Associates, LLC ("Consultant")
and the City of Santa Ana ("City").
Recitals:
A. The parties entered into Consultant Agreement N-2003-134, dated September 17,
2003, (hereinafter "said Agreement") by which Consultant has provided actuarial
consulting services to the City.
B. The parties wish to extend the term of said Agreement for an additional one-year
term.
Wherefore, in consideration of the covenants contained in said Agreement, and subject
to all the terms and conditions of said Agreement, except those amended in this Second
Amendment to Consultant Agreement, the parties agree as follows:
1. Section 3, TERM, shall be amended to read as follows:
"This Agreement shall commence on September 17, 2003 and terminate on June 30,
2005, unless terminated earlier in accordance with Section 12, below. The term of
this Agreement may be extended upon a writing executed by the Executive Director
of the Community Development Agency and the City Attorney."
IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to
Consultant Agreement on the date and year first written above.
