FIRST AMENDMENT TO
CONSUL T ANT AGREEMENT
THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into
this 21 st day of June 2004, by and between C.J. Avery Building General Maintenance
("Consultant") and the City of Santa Ana ("City").
Recitals:
A. The parties entered into Agreement #N-2004-020, dated March 11, 2004, (hereinafter
"said Agreement") by which Consultant has provided board-up of unoccupied
buildings owned by the City.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
renew said Agreement for an additional one-year period and to increase compensation
to pay for services during the extended term
Wherefore, in consideration of the covenants contained in said Agreement, and subject
to all the terms and conditions of said Agreement, except those amended in this First
Amendment to Consultant Agreement, the parties agree as follows:
1. Section 2.a., COMPENSATION, shall be increased $10,000.00, to read as follows:
"City agrees to pay and Consultant agrees to accept as total payment for its services
the rates and charges identified in Exhibit A. The total sum to be expended under this
Agreement shall not exceed $10,000 per fiscal year, during the term of this
Agreement. "
2. Section 3, TERM, shall be amended to extend the termination date from June 30,
2004 to June 30, 2005.
3. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.

IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to
Consultant Agreement on the date and year first written above.
