Said increase of service is considered additional services outside the scope of the contract and must therefore be authorized in writing by the City prior to commencement of such work. Section 2, the "Compensation" term of said Agreement is hereby amended to increase the maximum contract not to exceed amount to $293, 540.00 fee. Said increase of $50,000.00 is considered additional services outside the scope of the contract and must therefore be authorized in writing by the City prior to commencement of such work. 3. Section 3, the "Term" term of said Agreement is hereby amended to extend the termination date from September 30, 2004 to June 30, 2005. 4. DISCUSSION The California Regional Water Quality Control Board has adopted General Waste Discharge Requirements for .sewage collection agencies in Orange County. A major component of this program is a comprehensive fats, oils and grease (FOG) source control program to reduce the amounts of these substances discharged to the sewer collection system. The City is required to develop and implement a FOG source control program by December 30, 2004. On August 4, 2003, the City Council approved an agreement with Environmental Engineering and Contracting, Inc. (EEC) to perform a FOG characterization study. This study involved the inspection of approximately 500 of the 730 food service establishments (FSE's) in the City to determine the causes of grease accumulation in the sewer collection system. To date, approximately 375 FSE's have been inspected with completion scheduled for June 2004. Data gathered from these inspections also will be used to develop an effective grease control program. Prior to implementation of a FOG source control program, the City must update the municipal code to provide the necessary legal authority. The `legal authority must be adopted by July 30, 2004. ,5me.%_-i Amendment to Agreement with Environmental Engineering and Contracting Inc. April 19, 2004 Page 2 Staff recommends that the agreement with EEC be amended to provide assistance in the preparation of the required municipal code changes. EEC has extensive experience in the development of FOG programs throughout the Southern California region. Through the on-going FOG characterization study, they have developed a good understanding of Santa Ana's specific requirements. The services provided will be on an as - needed basis with an additional fee not to exceed $50,000. ENVIRONMENTAL IMPACT There is no environmental impact associated with this action.
