Patterson at 2:15 P.M. in the Council Chambers of the City Hall, 22 Civic Center Plaza, with the following Councilmen present: John Garthe, Lorin Griset, Vernon S. Evans, J. Ogden Markel, James E. Ward, Harry K. Yamamoto, and Mayor Jerry M. Patterson. Also present were City Manager Bruce C. Spragg, City Attorney James A. Withers, Assistant Director of Planning Bill Daugherty, Director of Public Works Ronald Wolford, and Assistant Clerk of the Council Wanda M. Schwarze. INVOCATION PLEDGE OF ALLEGIANCE man Griset. Following the Pledge of Allegiance to the Flag, the Invocation was given by Council- MINUTES The Minutes of the Regular Meeting of August 5, 1974, and the Adjourned Regular Meeting of August 12, 1974 were approved as submitted, on motion of Councilman Evans, seconded by Councilman Yamamoto, and unanimously carried. HOUSING AUTHORITY At 2:20 P.M., Council recessed to convene the Housing Authority. The meeting reconvened at 2:25 P.M. with all Councilmen present. CONSENT CALENDAR The following Agenda items were removed from the Consent Calendar: Item 10 B requested by Councilman Griset; Item 9 requested by Councilman Ward; Items 1 F and 7 B requested by Councilman Evans; Item 5 D requested by Councilman Yamamoto; Items 3 C and 3 D requested by Council- man Gaythe; and Item 4 requested by Councilman Markel. On motion of Councilman Evans, seconded by Councilman Yamamoto, and unanimously carried, Council affirmed the recommended action on the following Consent Calendar items: BID CALLS nent for bids on the following: Approved plans and specifications, and authorized advertise- PROJECT 1344 - Construct MacArthur Boulevard from Greenville Street to Bear Street - and - PROJECT 4024 - Construct K-3 Storm Drain in Greenville Street from Orion Street to MacArthur Boulevard. ORDINANCE NO. NS-1231 TAX RATE motion of Councilman Griset, The following ordinance was placed on second reading and adopted, on the unanimously carried seconded by Councilman Evans: ORDINANCE NO. NS-1231 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, FIXING THE AMOUNT OF MONEY ASCERTAINED TO FINANCE OPERATING AND CAPITAL EXPENDITURE COSTS OF THE VARIOUS DEPARTMENTS OF THE CITY, AND TO PAY THE BONDED INDEBTEDNESS FALLING DUE FOR THE CURRENT FISCAL YEAR 1974-75 FIXING THE RATE OF TAXATION FOR SAID CURRENT FISCAL YEAR, AND DESIGNATING THE NUMBER OF CENTS OF TAX ON EACH $100 OF ASSESSED VALUE FOR THE VARIOUS FUNDS OF SAID CITY HEREBY LEVIED ON THE WHOLE OF THE TAXABLE PROPERTY IN SAID CITY. (CA 12) HR 15361 Council considered letter HUD GRANT APPLICATION dated August 7, 1974 from DEADLINES Chairman of Legislative Liaison Advisory Committee of the Intergovernmental Coordinating Council of Orange County requesting support for the ICC recommendation that language allowing grant application filing "in advance of the end of the fiscal year 1975-76" be retained in HR 1S361 (the Housing and Urban Development Act of 1974), and opposing application deadlines by regulation. CITY COUNCIL MINUTES 307 AUGUST 19, 1974 On motion of Councilman Griset, seconded by Mayor Patterson, and carried with dissenting vote by Councilman Markel, Council approved and endorsed the recommendation of the ICC to retain existing language of HR 15361, and oppose application deadlines by regulation. (CA 57) STATE GENERAL PLAN Council received and GUIDELINES ordered filed letter dated August 2, 1974 from the Director of Planning and Research, Governor's Office, Sacramento, requesting comments on General Plan Guidelines adopted by the California Council on Intergovernmental Relations, on motion of Councilman Griset, seconded by Councilman Evans, and carried unanimously. (CA 113) LATE CLAIM The Application for KATHLEEN ABEL Leave to Present Late Claim filed by Nancy Bunn, Attorney at Law, dated July 18, 1974, on behalf of Kathleen Abel, was denied on the unanimously carried motion of Councilman Griset, seconded by Councilman Evans. (CA 65.7) PETITION POLICE PROBLEMS LOW-PENT HOUSING Kiddie, Santa Ana resident, improved Police protection Council received and ordered filed petition containing eighteen signatures from Louise dated July 15, 1974, requesting and clean, decent, low-rent hous- ing for elderly and disabled; and Mayor Patterson's response to Mrs. Kiddie dated July 26, 1974, outlining recent Council action implementing Police and Housing programs; on the unanimously carried motion of Councilman Ward, seconded by Councilman Evans. (CA 151.5) LOGAN AREA STUDY Councilman Evans' motion, seconded by Councilman Garthe, to receive and file the Logan Area Study Status Report from the Director of Planning dated August 8, 1974, until the Planning Director could be present, was amended by Councilman Evans, seconded by Councilman Garthe to set the matter for Redevelopment Agency Study Session on August 28, 1974, at 4:00 P.M. in Room 831, City Hall. The amended motion carried unanimously. (CA 78.6) PERFORMANCE BOND Council accepted the GREAT WESTERN RECLAMATION Great Western Reclama- tion, Inc. Performance Bond No. 400 EB 8110, issued by St. Paul Fire and Marine Insurance Company, in the amount of $100,000 and exonerated Bond No. SC 710 53 35, issued by Firemen's Fund Insurance, on the unanimously carried motion of Councilman Evans, seconded by Councilman Garthe. (A-73-56) USE OF PUBLIC Consideration of the PROPERTY Application for Use of CASA Public Property submitted by CASA (Centro Accion Social Anonimo) dated July 22, 1974, which was referred to Staff on August 5, 1974, was deferred to Executive Session on the unanimously carried motion of Councilman Ward, seconded by Councilman Evans. CITY COUNCIL MINUTES 308 AUGUST 19, 1974 Prior to the motion, the City Attorney announced that the CASA application was a subject of litigation, and therefore would not be a proper subject for discussion at this point. (CA 45.1) WATER RATE STUDY Council set for Public Hearing on September 9, 1974 the proposed water rate increase and water main and service installation fees averaging 35% and an increase in water rates averaging 17.2%, all to be effective October 1, 1974, contained in the Public Works Director's Report dated August 8, 1974, entitled Water Rate Study, on the unanimously carried motion of Councilman Evans, seconded by Councilman Yamamoto. (CA 12) 911 EMERGBNCY Following Council PHONE SYSTEM consideration of the City Manager's Report dated August 13, 1974 concerning 911 Emergency Phone System, and attached Plan B, Councilman Griset's motion, seconded by Councilman Garthe, to approve "Plan B" as recommended by the Orange County 911 Task Force, with a single receiving location in the Santa Aha Police Facility, and to instruct Staff to so advise the Board of Supervisors and the telephone company, carried unanimously. It was the general consensus of Council that implementation of Plan B will present serious problems because of relay or transfer of emergency calls, which could result in addi- tional errors and delays in emergency response. The City Manager pointed out that State law requires a Tentative Plan be filed by January 31, 1975, that Plan B is the better of the two alternatives, and that the Task Force will have two years to work out the design and techno- logical problems. (CA 47.6) DISSOLUTION OF On motion of Councilman NEWPORT DRAINAGE Griset, seconded by DISTRICT Councilman Evans, and carried unanimously, Council received and ordered filed the report of the Director of Public Works, dated August 13, 1974, entitled Dissolution of the Newport Drainage District, which recommended periodic Staff review of the extent of urban development of agricul- tural land with the general objective being dissolution of the District. (CA 70) RELOCATION BENEFIT Councilman Griset's ALFRED SANTANA motion, seconded by Councilman Yamamoto, to approve payment of $3,500 to Alfred Santana, displaced tenant because of the widening of Flower Street, as a Downpayment Benefit under the Relocation Assistance Program, carried with Councilman Markel dissenting. (CA 29.8) CITY COUNCIL MINUTES 309 AUGUST 19, 1974 TRAFFIC The Public Works Director reported that the location of the driveway clearance zone referred to in the Report of Traffic Control Devices Removed or Installed from July 30 through August 13, 1974, is on Bristol Street, north of Hemlock Way in front of Mercy General Hospital, and the earlier motion (Minutes page 304) of Councilman Griset, seconded by Councilman Evans to receive and file the report carried unanimously. (CA 18.3a) USE OF PUBLIC Administrative approval PROPERTY of the Application DOREE ARKINSTALL for Use of Public Property dated August 15, 1974, submitted by Doree Arkinstall, to use Jack Fisher Park for a teeter-totter marathon from 10:00 A.M. August 20 to 10:00 A.M. August 26, 1974, was ratified, on motion of Councilman Evans, seconded by Councilman Garthe, and carried unanimously. (CA 4S. 1) RESOLUTION NO. 74-135 RESOLUTION NO. 74-135 REDEVELOPMENT DIRECTOR was considered by title SALARY only on motion of Council- man Ward, seconded by Councilman Evans, and carried with Councilman Markel voting NO. The title was read aloud by the Mayor, and Council adopted the following resolution on motion of Councilman Griset, seconded by Councilman Yamamoto and carried, with dissenting votes by Councilmen Evans and Markel: RESOLUTION 74-135 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SJaNTA ANA AMENDING SECTION 3 OF RESO- LUTION NO. 58-281 TO RBALLOCATE THE CLASSIFICATION OF EXECUTIVE DIRECTOR-REDEVELOPMENT AGENCY TO A MORE EQUITABLE SALARY RANGE. (CA 50.1; CA 82.4) BUILDING AND FIRE As requested in a CODE REQUIREMENTS letter dated August 15, 825 NORTH ROSS STREET 1974 from the appellant, Council set for Public Hearing on September 9, 1974 the Appeal of Robert Battin concerning Building and Fire Code requirements pertaining to occupancy of a building located at 825 North Ross Street, on motion of Councilman Griset, seconded by Councilman Ward, and carried with dissenting vote by Councilman Evans. (CA 87.1) ORAL COMMUNICATION Councilman Yamamoto FIREWORKS suggested a Staff study and report regarding prohibition of "safe and sane" fireworks in the City. Mayor Patterson suggested the subject be presented in the Santa Aha News Story with a request for public response,'~-~d~-F to o-~tain a sampling of public opinion. An informal poll of Council indicated four Councilmen were in favor of a Staff report and News Story article, and three Councilmen opposed both. (CA 145.1) CITY COUNCIL MINUTES 311 AUGUST 19, 1974 COMMUNITY SPOTLIGHT Bob. W., Chairman of ALCOHOLICS ANONYMOUS Intergroup Service Board of Alcoholics Anonymous, introduced Jack M., Office Manager, Johhny R. Institutional Committee Director, and members of the AA Service Board. Mr. W. described the AA program in Santa Aha and Orange County in terms of living proof that it works, and told of the volunteers who spend many hours each week carrying the AA message to the alcoholic who still suffers that he does have a choice. Mr. W. estimated that the new AA Center on South Grand Avenue, which has been open for a year, serves 2,500 to 3,000 alcoholics in Santa Ana; that there are about 6,000 members of AA in Orange County, approximately six per cent of the total alcoholic population in the County. Mayor Patterson presented a plaque to Mr. W. for AA, on behalf of the City Council, in appreciation for outstanding service to the community. (CA 9.3) PUBLIC HEARING The Mayor opened the ORDINANCE NO. NS-1210 Public Hearing on NONCONFORMING SIGNS ORDINANCE NO. NS-1210 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PERTAINING TO NONCON- FORMING SIGNS, AMENDING SECTIONS 41-619.13 AND 41-619.55 OF TH~ SANTA ANA MUNICIPAL CODE AND ADDING SECTIONS 41-619.14, 41-619.15, 41-619.16 AND 41-619.17 TO THE SANTA ANA MUNICIPAL CODE, and announced that Council had indicated earlier in the meeting (Minutes page 305) that it would continue the Public Hearing as requested by Jay Kingry, Attorney at Law representing Pacific Outdoor Signs. The Mayor called for testimony from the audience from anyone wishing to speak. Hearing none, Council continued the Public Hearing to September 9, 1974 at 7:30 P.M. in the Council Chambers, on the unanimously carried motion of Councilman Griset, seconded by Councilman Evans. (CA 34) PUBLIC HEARING The Mayor opened the APPEAL NO. 341 Public Hearing on MINOR EXCEPTION 74-17 Appeal No. 341 and HERMAN JOHNSON Determination of Exemption - Minor Exception 74-17, filed by Herman Johnson, to allow on sale liquor in an existing cafeteria which is located within 300' of residences. Dale Heinly, Attorney at Law, 838 North Van Ness Street, representing the appellant, stated there is no legal objec- tion to the serving of beer in a restaurant; that police problems in the area are not attributable to Mr. Johnson's restaurant and are not a valid reason for denial of the Minor Exception; that the City is discriminating against Mr. Johnson on the basis of color and guilt by association. Police Chief Raymond Davis reported that the Staff position opposing the Minor Exception does not specifically oppose Mr. Johnson as a licensee, but is based on continuing crime problems in the area which are aggravated by serving of alcohol, and the high concentration of alcoholic beverage licenses in the area. CITY COUNCIL MINUTES 312 AUGUST 19, 1974 Assistant Planning Director Bill Daugherty reviewed the Zoning Administrator's Finding of Fact dated August 6, 1974, and the two basic reasons for denial of the Minor Exception: 1) Police problems in the area; and 2) Noise complaints from area residents. Mr. Daugherty assured Council that there is no basis for Mr. Heinly's allegation that Mr. Johnson was being unfairly treated. Herman Johnson, 1305 West Fourth Street, stated that his restaurant has been open for a year without trouble; that serving beer with meals will not create additional Police problems; that he is willing to accept any conditions imposed by Council as to hours of operation; and suggested a one year time limit, with extension subject to Council approval. The Assistant Clerk read the following noise complaints from area residents: 1. Letter from Margarita de la Riva; 2. Letter from Mrs. Mary Ruiz. There were no other written communications, and no other proponents or opponents, and the Mayor closed the Public Hearing. Following Council discussion, the motion of Councilman Yamamoto, seconded by Councilman Griset, to receive and file the Determina- tion of Exemption and instruct the City Attorney to prepare a resolution upholding the decision of the Zoning Administrator to deny Minor Exception 74-17, carried with dissenting votes by Councilmen Evans and Garthe, and Mayor Patterson. Traffic Engineer Joe Foust reported orally to identify the problems; to summarize neighborhood response to a question- naire survey contained in the report dated July 29, 1974 from the Director of Public Works; and to recommend approval of the proposal. Councilman Griset's motion to instruct the City Attorney to prepare an ordinance restricting Poinsettia Street between Fourteenth Street and Washington Avenue to one-way south- bound movement only was seconded by Councilman Evans, and unanimously carried. (CA 18.4) PUBLIC HEARING BIKE LANES LINCOLN AVENUE The Public Hearing to consider bike lanes on Lincoln Avenue was opened by the Mayor. The Traffic Engineer orally presented highlights of the Public Works Director's Report to the City Manager dated July 29, 1974. The results of the survey of residents con- tained in the report indicated 65% of the residents in favor of some type of bike lane. The Assistant Clerk reported there were no written communica- tions. The following persons spoke in favor of the bike lanes: Mr. and Mrs. Jim Daily, 2436 North Lincoln; Jerry Thompson, 1018 Virginia Avenue. The proponents suggested reduction of speed limit and a four-way stop at Lincoln and Santa Clara Avenues to slow down traffic on Lincoln, and that heavy (wide) trucks be limited. The following persons spoke in opposition to the bike lanes: D. R. Klinger, 1014 Beechwood; Lyle Morrison, 2520 North Lincoln; Mr. and Mrs. Robert Hellwig, 2530 North Lincoln; Valerie Richards, 1018 East Santa Clara. The following reasons were stated by the opponents: l) that Lincoln Avenue is a dangerous street with heavy, fast moving traffic; 2) that the width of Lincoln Avenue, the railway crossings at Santa Clara and Fairhaven, and the school bus stop at Grovemont, are additional hazards for bikers; 3) that on-street parking on Lincoln is necessary because of short driveways of residents and little space available on side streets for guest parking; 4) that the blacktop curbing is objectionable; 5) that the bike lanes will bring about a drop in property values; that there is no demonstrable need for bike lanes on Lincoln at this time; 7) that the bike lane on the east side of Lincoln is being used for passing; and 8) that there have been recent accidents on Lincoln. CITY COUNCIL MINUTES 314 AUGUST 19, 1974 Several of the opponents requested that the bike lanes be removed from Lincoln Avenue if they are not used by bicyclists. There were no other proponents or opponents, and the Mayor closed the Public Hearing. On motion of Councilman Ward, seconded by Councilman Yamamoto, and carried with dissenting vote by Councilman Evans, Council approved restriction of parking for a bike trail on the west side of Lincoln Avenue, from 7:00 A.M. to 7:00 P.M. daily, and instructed the City Attorney to prepare appropriate resolution as recommended by the Director of Public Works, to provide bike lane in accordance with the Council's Master Bike Route Plan. Prior to the motion, Council expressed interest in considering traffic safety measures to reduce speed on Lincoln Avenue. (CA 18.6) PUBLIC HEARING The Public Hearing to PEEP SHOW PERMIT consider the Appeal of JJM, INC. JJM, Inc. concerning Application for a Peep Show Permit was removed from the Agenda, on the unani- mously carried motion of Councilman Evans, seconded by Council- man Yamamoto. Prior to the motion the City Attorney informed Council that JJM, Inc. no longer exists as a Nevada corporation, and it would be premature for Council to consider the application at this time. (CA 149.1) ORAL REPORT Director of Public WAFFLE HOUSE Works Ronald Wolford presented an oral report regarding the status of the Waffle House, located on the northwest corner of Seventh and Bush Streets, as follows: 1) Status of Civic Center Drive Project - Bids will be opened in the latter part of September, 1974, with Bid Award scheduled for the first Council meeting in October. The Project specs provide for temporary relocation of the Waffle House on the northwest corner of French Street and Civic Center Drive East in December. 2) Status of Orange County Study of the Heritage Square Concept - No action has yet been taken by the County. Relocation of Present Waffle House Tenant Under the provisions of Relocation law, over 30 alternate locations have been presented by Staff to the tenants, all of which have been rejected, and eviction proceedings may be required. (CA 85.1d) EIR 74-5 Draft Environmental WIDENING OF Impact Report 74-5 NORTH MAIN STREET for the widening of North Main Street prepared by the Director of Public Works in connection with Project 1348, was adopted and certified as final EIR, on the unanimously carried motion of Councilman Griset, seconded by Councilman Evans. (CA 29.8) CITY COUNCIL MINUTES 315 AUGUST 19, 1974 ORAL REPORT Police Chief Davis TRAFFIC CONTROL GRANT presented a brief oral report concerning the approval by the State of City's application for Traffic Control Grant in the amount of $120,443. The grant will provide the City with a Traffic Accident Control Program, which will consist of four motorcycle officers, four motorcycles, and operation costs in the first year. It is anticipated that it will also provide 50% of operational costs in the second year, and 25% in the third year. A related grant in the amount of $10,000 was also approved, which will pay expenses to send a Police officer to North- western Traffic Institute in Illinois for nine months. Council approved acceptance of the grants by informal consent.
