FIRST AMENDMENT TO AGREEMENT
BETWEEN
THE COUNTY OF ORANGE
AND
THE CITY OF SANTA ANA
FOR THE PROVISION OF
GANG VIOLENCE SUPPRESSION OVERTIME SERVICES
THIS FIRST AMENDMENT TO AGREEMENT, entered into this I iJ. ti. day of
ßB(!-e~, 2004, which date is enumerated for purposes of reference only, by
and between the COUNTY OF ORANGE, a political subdivision of the State of
California, hereinafter referred to as "COUNTY", and the CITY OF SANTA ANA, a
charter city and municipal corporation of the State of California, hereinafter referred to as
"CITY". This Amendment to Agreement shall be administered by the County of Orange
Chief Probation Officer, hereinafter referred to as "ADMINISTRATOR."
Recitals:
A. The parties entered into Agreement No. A-2003-273, dated June 8, 2004, (hereinafter
"said Agreement") by which COUNTY has provided Gang Violence Suppression
Services for a target population consisting of adults and minors on probation, residing
within CITY'S Weed & Seed Site IIII geographical limits.
B. The CITY has received additional Weed & Seed grant funding for 2004-2005 fiscal
year.
C. The CITY and the COUNTY wish to extend the term of said Agreement for an
additional nine month period.
Wherefore, in consideration ofthe covenants contained in said Agreement, and subject
to all the terms and conditions of said Agreement, except those amended in this First
Amendment to Agreement, the parties agree as follows:
I. Section 1.0, TERM, shall be amended in its entirety to read as follows:
"The term ofthis Agreement shall commence January 1,2004 and continue through
September 30, 2005 unless otherwise terminated pursuant to Section 20.0 of said
Agreement; provided, however, COUNTY shall be obligated to perform such duties
as would normally extend beyond that term, including but not limited to, obligations
with respect to confidentiality, indemnification, audits, reporting and accounting."
2. Except as hereinabove modified, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties have caused this First Amendment to Agreement
to be executed by their du1y authorized officers.
