I . 8 " GCH/fm 10/19/77 " RESOLUTION 77-5 A RESOLUTION OF THE HOUSIN,; AUTHORITY OF THE CITY 01" SANTA ANA AUTHORIZING THE EXECUTION OF SECTION 8 HOUSING ASSISTANCE PAYMENTS PROGRAM, AGREEr1ENT TO ENTER INTO HOUSING ASSISTANCE PAYMENTS CONTRACT FOR PRIVATE-OWNER/PHA PROJECT NO. CA16-8023-054 AND LETTER AGREEMENT TERMINATING AGREErmNT TO ENTER INTO HOUSING ASSISTANCE PAYMENTS CONTRACT FOR PROJECT NO. CA-093-003 ~EREAS, Santa Ana Towers, Ltd., a Limited Partnership (herein called the "OWner") has previously submitted to the United States ot America, Department of Housing and Urban Development (herein called the "Govern- ment") a Final Proposal for the construction of 199 one-bedroom units specifically designed for elderly, handicapped or disabled, and WHEREAS, the Government has previously notified Santa Ana Towers, Ltd., a Limited Partnership that its Final Proposal has been approved for housing assistance under the Section 8 Housing Assistance Pa~ents Program New Construction, and WHEREAS, the Government and the Housing Authority of the City of Santa Ana (herein called the "Housing Authority") have previously entered into a Section 23 Housing Assistance Payments Program Annual Contri- bution Contract, Part I For New Construction Project No. CA-093-003, dated May 25, 1976, and WHEREAS, the HOUSING AUTHORITY OF THE CITY 01" SANTA ANA and NATIONAL HOUSING CONSULTANTS, INC. have previously entered into a Section 23 Housing Assistance Payments Program New Construction Agreement to Enter Into Housing Assistance Payments Contract for Project No. CA-093-003, dated June 25, 1976, and WHEREAS, the Government has forwarded to the Housing Authority for its consideration a proposed form of Section 8 Housing Assistance Payments Program Annual Contributions Contract, Part I for New Construc- tion Project No. CA16-8023-054, and WHEREAS, the Government has forwarded to the Housing Authority for its consideration a proposed form of Agreement to Enter Into Housing Assistance Payments Contract for Private-Owner/PllA Project No. CA16- 8023-054, and WHEREAS, the Government has forwarded to the Housing Authority for its consideration a proposed form of Letter Agreement Terminating Agreement to Enter Into Housing Assistance Payments Contract for Pro- ject No. CA-093-003, and WHEREAS, the Housing Authority now proposes to enter into the Agree- ment to Enter Into Housing Assistance Payments Contract for private- Owner/PHA Project No. CA16-8023-054 and Letter Agreement Terminating ..:Agreement to Enter Into Housing Assistance Payments Contract for Pro- ~ ject No. CA-093-003, in the form provided by the Government: NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY. OF THE CITY. OF SANTA ANA AS FOLLOWS: Section 1. The proposed Contract, designated "Section 8 Housing Assis- tance Payments Program Agreement To Enter Into Housing Assistance . Payments Contract For Private-Owner/PHA Project No. CA16-8023-054", pursuant to the United States Housing Act of 1937, as amended, is herebv approved and accepted both as to form and substance, and the Chairman is hereby authorized and directed to execute said Contract in four 4B ..1 . -... . ~.: ¡¥. , Resolution No. 77-5 . . counterparts on behalf of the Housing Authority and, following the execution of the Agreements by the OWner, to forward such executed counterparts to the Government together with such other documents evi- dencing the approval and authorizing the execution thereof as may be required by the Government. Section 2. The proposed Letter Agreement, designated "Letter Agree- ment Terminating Agreement to Enter Into Housing Assistance Payments Contract for Project No. CA-093-003", pursuant to the United States ~HOUSing Act of 1937, as amended, is hereby approved and accepted oth as to form and substance, and the Chairman is hereby authorized and directed to execute said Contract in four counterparts on behalf of the Housing Authority, and following the execution of the Letter Agreement by the Owner, to forward such executed counterparts to the Government together with sùch other documents evidencing the approval and authorizing the execution thereof as may be required by the CTÜvern- ment. Section 3. This Resolution shall take effect immediately. . .
