RESOLUTION OF THE HOUSING AUTHORIT1 OF THE
CITY OF SANTA ANA APPROVING SUPERSEDING PART I
AND NEW PART II OF THE SECTION 8 HOUSING VOUCHER
PROGRAM ANNUAL CONTRIBUTION CONTRACT NUMBER
SF-503 AND AUTHORIZING EXECUTION TO THE
UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
INCLUDING PROJECT NUMBERS CA16-V093-005/006

WHEREAS, the Housing Authority of the City of
Santa Ana is authorized to administer the "Housing Assistance
Program for Section 8 Housing Voucher Program" for the united
States Department of Housing and Urban Development ("BUD");
and
WHEREAS, the Housing Authority of the City of
Santa Ana ("PHA") entered into a Section 8 Annual Contributions
Contract ("ACC") on June 30, 1975 as amended, with the United
States of America ("Government"): and

WHEREAS, the Section 8 ACC must be revised so that
it will consist of the following counterparts:
a.
Superseding Part I of the ACC, HUD 52520D
(6/85), applicable to the Section 8 Existing
Housing Voucher Program.
b,
New Part II of the ACC, HUD
applicable to the Section 8
Voucher Program.

NOW, THEREFORE, BE IT RESOLVED by the PHA as follows:
1, The Superseding Part I Section 8 ACC and the
new Part II of the ACC for the Housing Voucher Program are
hereby approved and accepted.
2. The Housing Authority of the

reduction, pursuant to section 2.3.1'. of the icc, in
the amount of the annual contributions payable'for any
project or for the Pcogc.., and shall state any
reduction in the amount of contract authority reserved
by nUD for a project. The notice aay specify a
revised unit distribution. BOD notice of reduction or
revision shall constitute an amendment of the ACC.

USE OF PROGRAM RECEIPTS.
A.
The POA shall use Program Receipts to provide decent,
safe and sanitary housing for eligible famll10 in
~o.pliance with tbe u.s. DOusing Act of 1937 and &11
DOD requirements. Program Receipts aay only be used
to pay Program Expenditures.
The PHA shall not aake any prograa Expenditures except
in accordance witb the annual contribution estiaate
and supporting data for such estiaate as approved by
BOD.
B.
c.
The PHA shall maintain an Operating Reserve account
tbat shall be credited with the amount by which the
total of administrative fees earned and laterest
earned on the operating Reserve exceed PBA
administrative expenses during a piscal Year. In
subsequent years, the PBA aust use funds in the
operating ReserVe to pay administrative espense. in
excess of program Receipts. Notwithstanding tbe
provisions of section 2.4.1'., if there reaain funds in
the operating Reserve, the PDAaay use sucb funds for
other bousing purposes consistent with State and local
law. Dowever, BUD aay probibit use of funds in the
operating Reserve for other bousing purposes if tbe
PM is not adequately administer ing its Dousing
Certificate program or its Dousing Voucber prograa.or
has failed to coaply with any of its obligations under
the ACC.

A.

and statistical reports, records, stateaents, and

by such supporting data as required by BOD.

BUD and tÞe comptroller General of tÞe United States,
or their duly authorized representaUves, shall have
full and free access to all PBAoffices and
facilities, and to all the books, documents, papers,
and records of the PDA that are pertinent to opera;ion
and aanage.ent of the prograa, including the rigbt to
audi t, and to aake e:lcerpts and traJ)scrIpts frC18 the
books and records.
D.
The PBA sÞall be responsible for engaging and paying
an independent public accountant for the aating. of
audits as required bt BOD. The cost of audits
required by BOD ..y be charged against prograa
Receipts.
DEPOSITARY.
A.

are collectively called the -Depositary Agreeaent,-
