MEMORANDUM OF UNDERSTANDING
RENTAL REHABILITATION PROGRAM

This Memorandum of Understandinq ("Memorandum") is between the
citI of Santa Ana, a municipal corporation of the State of
Cal fornia ("Grantee"), and the Housinq Authority of the city of
Santa Ana ("PRA"), a public body corporate and politic. This
Memorandum set. forth the understandinqs of the parties
concerninq the Grantee's Rental Rehabilitation proqram
("Proqruh) approved by the U.S. Department of Housinq and Urban
Development ("BUD") pursuant to Section 17 of the United States
Housinq Act of ~937 (42 USC 1430). '
The Grantee contemplates recaivinq tunda in Federal Fiscal Year
1989-90 for its proqram to finance th_"rebabilitationof rental
properties for the benefit of 'lower incôme families. It is
anticipated that HUD will provide the,PBwith additional
housinq a.si.tance funda under the Section 8 Existinq Housinq
Certificate proqram and/or the Sectionu8 Housinq Voucher
Proqram. ' , '
The Grantee and the PHA hereby aqree as follows:
1.
The Grantee will carry out its Rental Rehabilitation proqram
in accordance with:
a.
section 17 and other applicable Federal laws; and
the requlations in 24 CFR, Part 511.

The PHA will administer the section. 8 Existinq Housinq
Certificate"Proqram and Housinq Voucher Proqram in
accordance with:
a.
Section 8 and other applicable Federal laws:
the'~qulations in 24 CFR, Part 882; Part 887

The Grantée;aqrees to cátry out its~Räntal Rehabilitation
Proqram in'accordance wt~ the scliëdUle in its proqram
DeScriptioÌ'l"submitted to,lànd'apprôved 'by HUD. The Grantee
will qive the PHA ninety (90) days of notice of the actual

need for issuance of Section 8 Certificates or Housinq Vouchers
for the Grantee's Proqram (or if less than this, the maximum
feasible notice for a Rental Rehabilitation project). The
notice will state the number of Section 8 Certificates and/or
Housinq Vouch~ needed and the approximate bedroom size. ,

The PHA aqrees, upon notice by the Grantee of the projects
approved for Rental Rehabilitation assistance, to determine
the eligibility for Section 8 Certificates or Housinq
Vouchers of the families residinq in the projects to be
rehabilitated.
5.
The PHA aqrees to issue a housinq voucher to any eligible
applicant family that is foroed to vacate a unit because of
physical construction, housinq overcrowdinq, or a chanqe in
use of the unit as a result of rental rehabilitation
activities.
6.
The PHA may provide a selection preference to a family
whose rent would be greater thah, 30 percent of its
adjusted income as a result of rental rehabilitation
activities. The PHA must exercise this discretionary
authority in a manner that is consistent with its
oblig'ât:ions with ralÌpect to thé Federal preferences.
If the PHA provides a housinq voucher to a family who
falls within this cateqory but is not eliqible for a
Federal preference, the family must be counted as part
of the not more than 10 percent of applicants that may
be issued housinq vouchers before applicants who
qualify for a Federal preference.
The Grantee will notify the PHA and HUD when its Rental
Rehabilitation funds have been expended and remaining
housin9' assistanoe funding is no lonqer needed for the
Grantee's proqram.

The PHA will not retain any fundinq for Section 8
Certificates in reserve because the PHA's turnover rate is
adequate tèmeet anticipated needs for the Grantee's
proqram.
8.
Before HUDind the PHA exec;:ute anACC for the housinq
assistance tundinq for Seotion 8 Certificates or Housinq
Vouchers !~ support of the Grantee's Proqram, the PHA shall
certify to HUD that the PHA and Grantee have entered into a
Memorandumôf Understan4inq, and ~a~ the Memorandum of
understandinq is consi8€erit with 1ffië 1!pHA' s HUD approved

understand that the Memorandum of Understandinq is not subject
~o HUD approval, and tha~if there i. an incon.i.tency be~ween
the PHA'. AdIIIinistrative Plan (includinq any BuD approved
amendments of the plan) and the Memorandum of Understandinq, the
Administrative Plan shall prevail.
