Ward. The following Council members were present: Harry K. Yamamoto, David L. Brandt, John Garthe, and Vice Mayor Ward. Mayor Vernon S. Evans and Councilman Gordon Bricken were absent. Councilman David Ortiz arrived follow- ing approval of Consent Calendar recommendations. Also present were the following members of Staff: City Manager Bruce C. Spragg, City Attorney Keith L. Gow, Assistant City Manager Ronald Wolford, Director of Public Works John E. Stevens, Planning Director Charles C. Zimmerman, and Clerk of the Council Florence I. Malone. CA 47; CA 65.6 RESOLUTION 77-52 A RESOLUTION OF THE CITY DEPUTIES - ATTORNEY & ENGINEER COUNCIL OF THE CITY OF ADOPTED SANTA ANA APPOINTING DEPUTIES OF THE CITY ATTORNEY AND THE CITY ENGINEER was adopted unanimously 5:0, on the motion of Councilman Brandt, seconded by Councilman Garthe. CA 50.1 RESOLUTION 77-53 A RESOLUTION OF THE CITY UNIFORM FEE SCHEDULE COUNCIL OF THE CITY OF ADOPTED SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF FEES AND REPEALING RESOLUTION NOS. ?5-24, ?S-66, ?5-74, 75-115, ?6-50, 76-126, 76-127 AND 76-139 was adopted on the unanimously carried S:O motion of Councilman Yamamoto, seconded by Council- man Brandt. CA 65 SMITH-TUTHILL-LAMB BUILDING On the motion of Councilman 518 NORTH BROADWAY Brandt, seconded by Council- REFERRED man Garthe, and carried 5:0 unanimously, two letters received urging the preservation of the Smith-Tuthill-Lamb Mor- tuary building were referred to the Community Redevelopment Commission for review. One letter dated April 14, 1977 was signed by Mrs. Thomas G. Schauwecker, President of the San Juan Capistrano Historical Society, and favored County use of the property. The second letter dated April 20, 1977 was signed by Florence M. Winkler, President of the Santa Ana Historical Preser- vation Society, and suggested the building be shared by the City and the County, possibly as an information office. CA 85.1f AGENDA ORDER Discussion of the Orange LEAGUE OF CITIES BUDGET County Division, League POSTPONED TO EVENING AGENDA of Cities Budget was post- poned until the arrival of Councilman Bricken, on the unanimously carried 5:0 motion of Councilman Yamamoto, seconded by Councilman Garthe. Prior to the above motion, Councilman Brandt stated that it seems to be the feeling of League representatives that the three cent per capita assessment is excessive, and that it was, CITY COUNCIL MINUTES 145 MAY 2, 1977 in fact, voted down at the last League meeting; that some com- promise might be worked out (i.e. 2-1/8¢, 2-1/4¢) to give the Director of the Orange County Division a reasonable cost of living increase, but that there does not seem to be a need for a full time Director. Councilman Garthe suggested that the Division designate the items that could be cut or reduced to trim the budget to 2-1/2¢ or less. Councilman Brandt's motion, seconded by Councilman Ward, to approve the budget based on an assessment of 2¢ per capita, with instruc- tions that a reasonable cost of living and expense reimbursement increase for the Executive Director would be entertained by this Council, failed on a 3:2 vote, with Councilmen Garthe and Ortiz dissenting. Councilman Garthe's motion that the Council approve an assessment not to exceed 2-1/2¢ per capita, failed for lack of a second. CA 148.1 STATUS REPORT A status report prepared REFUSE COLLECTION CONTRACT by Ronald E. Wolford, FILED Assistant City Manager, on March 1, 1977, and the draft Request for Proposal for consultant services, were received and filed on the motion of Councilman Ortiz, seconded by Council- man Garthe, and carried unanimously 5:0. CA 11.1 A-76-42 REORGANIZATION - RECREATION & The interim report on the PARKS DEPARTMENT reorganization of the INTERIM REPORT - FILED Recreation and Parks Department prepared by Director of Recreation and Parks Robert E. Gresham and dated April 26, 1977 was received and filed on the motion of Council- man Brandt, seconded by Councilman Ortiz, and carried 4:1, with Councilman Yamamoto dissenting. CA 52 THORNTON PARK LAKE DEVELOPMENT On the motion of Council- REFERRAL ITEM 7-77 man Brandt, seconded by MASTER PLAN AMENDED; DELETED Vice Mayor Ward, and carried 5:0, Staff was authorized to continue with the phased development of Thornton Park, to postpone development of the lake phase until either new or reclaimed water sources are made available; and to maintain continually the lake site to eliminate any safety hazards; Council Referral Item #7-77 was deleted from the Summary. CA 52 PROPOSED BARRIER - ROSS STREET A report dated April 27, REFERRAL ITEM 1-77 1977, prepared by Traffic FILED; DELETED Engineer Joe Foust analyz- ing the Ross Street Traf- fic problem was received and filed, and Council Referral Item No. 1-77 was deleted from the Summary, on the motion of Council- man Yamamoto, seconded by Councilman Garthe, and carried 5:0 unanimously. CA 29.1 APPROPRIATION ADJUSTMENT #219 Appropriation Adjustment REFUSE COLLECTION LABOR COSTS #219 transferring $3,200 APPROVED from the Street Lighting to the Refuse Collection account to fund unanticipated staff labor costs was approved on the unanimously carried 5:0 motion of Councilman Brandt, seconded by Councilman Garthe. CA 65.3 CITY COUNCIL MINUTES 146 MAY 2, 1977 APPROPRIATION ADJUSTMENT #220 On the unanimously approved WATER MAIN RELOCATIONS S:0 motion of Councilman APPROVED Yamamoto, seconded by Coun- cilman Brandt, Appropria- tion Adjustment #220 transferring $29,000 from Water Division Capital Extensions to Water Distribution Systems Maintenance for water main relocations to allow construction of new storm drain projects was approved. CA 6S.5 APPROPRIATION ADJUSTMENT #221 On the recommendation of ENGINEERING SALARIES John E. Stevens, Director APPROVED of Public Works, in his report dated April 26, 1977, Appropriation Adjustment #221 transferring $94,395 from Street Lighting to Administrative & Engineering was approved on the unanimously carried S:0 motion of Councilman Garthe, seconded by Councilman Brandt. CA 65.3 ABC LICENSE APPLICATION Council received and filed PATRICK N. MOREHEAD the Staff report of the REPORT FILED following Alcoholic Beverage License Application on the motion of Councilman Garthe, seconded by Councilman Ortiz, and carried 4:1, with Councilman Yamamoto dissenting: MOREHEAD, Patrick N. 1109 North Harbor Boulevard - Person to Person Transfer - Type "42" On Sale Beer & Wine (Public Premises). (Agenda Item 4B) CA 146 ORAL COMMUNICATION Councilman Harry K. Yama- REMOVAL OF CAMPAIGN SIGNS moto announced that members SACEA MEMBERS of the Santa Ana City Employees Association, on their own time, removed over 500 election campaign signs from the City streets. Councilman Bricken concurred with an expres- sion of appreciation for their time and effort to improve the City. CA 50.9 ORAL COMMUNICATION Councilman Garthe noted COOPERATION ASKED FOR that he had seen many WATER CONSERVATION instances of persons allowing water to run down the street during yard watering; he suggested that such citizens be reminded of water conservation efforts. Director of Public Works John E. Stevens stated that his department had mailed a number of such notices and that cooperation had been good. CA 12 RECESS At 2:40 P.M. the meeting EXECUTIVE SESSION was recessed for an execu- tive session to discuss legal matters; the meeting reconvened at 3:15 P.M. and immediately recessed for a dinner at 7:30 P.M. at La Fonda Restaurant for a Cinco de Mayo celebration with representatives of the Mexican-American community; the meet- ing reconvened at 7:30 P.M. with all Councilmen present except Mayor Evans. CITY COUNCIL MINUTES 147 MAY 2, 1977 INVOCATION Following the Pledge of PLEDGE OF ALLEGIANCE Allegiance to the Flag, the Invocation was given by Father Michael Mandala of the Episcopal Church of the Messiah. CA 80.17 AGENDA ORDER - BAKER SQUARE A letter received from Rowena Macias, represent- ing the "No on Baker Square" Committee (Santa Ana Sponsoring Committee), requested that Item #80 on the Coun- cil Agenda be considered before the scheduled public hearings because of the number of people in attendance on the matter. The request was granted by the motion of Councilman Bricken, seconded by Councilman Ortiz, and carried 6:0 unanimously. BAKER SQUARE - VA 76-57 City Attorney Keith Gow STAFF REPORT reported to the Council REFERRED FOR PUBLIC HEARING and the audience that he is satisfied that the factual determinations made in connection with the Council approval of Variance Application No. 76-57 for the Baker Square Development at its meeting of March 21, 1977 adequately support the findings made by the Council. Several speakers appeared to request a reconsideration of the approval of the Variance; they were: Jose Robles, 708 West Second Street Mike Andrade, 1042 North Logan Street Ruby Epps, 626 North Jackson Street Rowena Macias, 1243 West Sixth Street Ed Schmidt, 1402 West Seventh Street Karon Singleton, 804 North Louise D. R. Hench, 804 North Louise Street Herculano Ortiz, Jr. 812 North Louise Street Jess J. Araujo, Attorney at Law, 1140 West Santa Aha Blvd. In addition to a request for reconsideration the speakers stated that they were not notified of the hearing on the Variance application; that the Planning Commission Finding of Fact does not comply with Municipal Code Sections 41-638(2) and 41-639; that a rehearing is the most sensible way to resolve the problem between the Baker Square neighborhood and the City; that the General Plan specifies High Density Residential for the area, but that it is zoned Ri, R2, and R3H; that there is a discrepancy between the General Plan and the current zoning; that the variance procedure is being used to bring the area into con- formity with the General Plan; that the use of variances is intended for use in extraordinary circumstances; that the com- munity should be given a stronger voice and an opportunity to better respond to such changes; that the City is requested to clarify its intention to use the granting of variances to change the character of the neighborhood; that residents are still concerned about lack of sufficient parking and overcrowding of schools; and that there is concern that the apartments will rent to low income families, increasing problems of maintenance and vandalism. Lester Day, 9215 Paso Robles, Northridge, stated that the apart- ments are not subsidized, but are market rate; that the builder has made a great effort to provide parking, proper ingress and egress and safety factors. CITY COUNCIL MINUTES 148 MAY 2, 1977 Attorney Araujo asked for a copy of the plans that have been submitted to the City; he was advised by City Staff that the plans are available to him and that every effort will be made to answer any questions he might have concerning the property and its development. Planning Director Charles Zimmerman stated that the project is not low-income; that there will be 90 units on 3.2 acres of a density of 28.1 units per acre; that the General Plan designation allows 40 units per acre; and that the variance procedure allows the City to review more closely the development plans for the property; that 1-1/2 spaces for each dwelling unit are provided for parking; and that it is anticipated that the building permit will be issued the latter part of the week ending May 6. In answer to the question from Council, City Attorney Keith Gow responded that a reconsideration can be made at the same meeting as the original decision or at the following meeting; that Roberts Rules of Order are the rules of procedure that the Council has adopted; that Council may only reconsider the matter if it suspends its rules. Councilman Bricken's motion, seconded by Councilman Ortiz, to suspend the rules of procedure pertaining to reconsideration failed to carry on a 3:3 vote, with Councilmen Brandt, Garthe and Vice Mayor Ward dissenting. On the unanimously approved 6:0 motion of Councilman Bricken, seconded by Vice Mayor Ward, the Planning Department was in- structed to set a public hearing by the Planning Commission for the rezoning of the area bounded by First Street, Civic Center Drive, Bristol and Shelton Streets based on the Special Study of the corridor by Staff. CA 13.3a RECESS with the At 8:25 P.M. Vice Mayor Ward recessed the meet- ing; at 8:30 P.M. the meeting was reconvened, same Council members present. EIR & SPECIFIC DEVELOPMENT PLAN Vice Mayor Ward announced SENIOR CITIZENS HOUSING PROJECT that this was the time and APPROVED; ORDINANCE ORDERED place for the public hear- ing of the Environmental Impact Report and plot plan, elevations and floor plans for the proposed Specific Development Plan for Senior Citizens Housing Project located between First and Third Streets, Ross and Van Ness Streets. Planning Director Charles Zimmerman stated that an ordinance was adopted by Council redesignating the subject site as High Density Residential and an SD (Specific Development) District on Decem- ber 28, 1976; that the plot plan, elevations and floor plans are now before Council for approval as the Specific Development Plan; that the Planning Commission unanimously recommended the approval of the Specific Development Plan following a public hearing held on March 28, 1977. The Clerk of the Council reported that no written communications had been received; Vice Mayor Ward closed the public hearing after determining that there were no speakers on the subject. CITY COUNCIL MINUTES 149 MAY 2, 1977 On the unanimously carried 6:0 motion of Councilman Brandt, seconded by Councilman Garthe, the Community Redevelopment Agency's Environmental Impact Report, adopted by the Agency on October 1976, by Agency Resolution No. 76-30, was received and filed; Specific Development Plan No. 2 was approved; and the City Attorney was directed to prepare the appropriate ordinance. CA 78.10 CA 157.8 PUBLIC HEARING - AMENDMENT APPLICATION 757 - SPECIFIC DEVELOPMENT PLAN #8 - APPROVED ORDINANCE NS-1360 - FIRST READING 757, and Specific Development Plan #8 located generally on the east side of Warner Avenue, bounded by the Newport Vic~ Mayor Ward announced that this was the time and place for the public hearing of Negative Declaration, Amendment Application No. for the rezoning of property Grand Avenue, south of Freeway on the east, from the Mi (Light Industrial) District to the SD (Specific Develop- ment) District, and a proposed Specific Development Plan. Planning Director Charles Zimmerman stated that the Brookhollow Office, Industrial and Commercial Park development is 50% com- plete; that it is being redesignated Specific Development to allow the City greater control to insure a quality development; that the development contains approximately 34 acres; and that the Planning Commission unanimously recommended approval of the rezoning and Specific Development Plan at its meeting of March 14, 1977. Jerry Oldenberg, 17782 Sky Park Blvd., Irvine, appeared to answer any questions Councilmen might have regarding the project. There were no written communications and no further speakers; Vice Mayor Ward closed the public hearing. On the motion of Councilman Bricken, seconded by Councilman Yamamoto, and carried 6:0 unanimously, the Negative Declaration was approved and filed; and ORDINANCE NO. NS-1360 - AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 757 TO REZONE PROPERTY LOCATED AT WARNER AND GRAND AVENUE FROM THE M1 (LIGHT INDUSTRIAL) DISTRICT TO THE SD (SPECIFIC DEVELOP- MENT) DISTRICT, AMENDING SECTIONAL DISTRICT MAP 29-5-9, AND ADOPTING SPECIFIC DEVELOPMENT PLAN #8 was placed on first read- ing. CA 10 ORANGE COUNTY LEAGUE OF CITIES After Council discussion BUDGET - 2~ PER CAPITA ASSESSMENT and on the motion of APPROVED Councilman Yamamoto, seconded by Vice Mayor Ward, and carried 5:1, with Councilman Ortiz dissenting, approval was given to an Orange County Division Budget pro- posed by the Executive Director based upon a two cent per capita assessment, with the assurance that this Council would review and consider a somewhat higher budget if one is pro- posed by the Director. A prior motion made by Councilman Brandt, seconded by Council- man Garthe, to approve the proposed budget based on a two cent per capita assessment with the understanding that a larger budget could be negotiated upwards, but not to exceed a 25% increase, failed to carry on a 3:3 vote, with Councilmen Yamamoto, Ortiz and Bricken dissenting. Councilman Bricken stated that he could support a budget reflect- ing a 5% increase in assessment.
