CALL TO ORDER PLEDGE OF ALLEGIANCE TO THE FLAG ROLL CALL CONSENT CALENDAR NOTICE: All matters listed under Consent Calendar will be acted upon by one motion affirming the action recommended on the Agenda. There will be no separate discussion of these items prior to voting unless members of the Agency, staff or the public request specific items to be removed from the Consent Calendar for separate action. 1. MINUTES Recommendation: Approve Minutes of Regular Meeting held on December 15,1981. 2. LETTERS OF DISCLOSURE A. LETTERS OF DISCLOSURE FROM AGENCY MEMBERS ACOTSA AND MARKEL Recommendation: 1. Receive and file the letter dated December 1, 1981 from Agency member John Acosta disclosing interest in real property located at 1705 South Main Street, Santa Ana, California. 2. Receive and file the letter dated December 28, 1981 from Agency member J. Ogden Markel dis- closing interest in real property as follows: Lots 9 and 10 in Tract 827, and Lots 7, 8, 9 and 10 in Tract 1265. Commission Recommendation: Not applicable. . . . 3. DEVELOPER AGREEMENTS A. DISPOSITION AND DEVELOPMENT AGREEMENT WITH CIVIC CENTER DEVELOPMENT Recommendation: Authorize continuation of the public hear1ng for the adoption of a Disposition and Develop- ment Agreement with Civic Center Development set for 5:30 P.M. on January 19, 1982 until 5:30 P.M. on February 16, 1982. Commission Recommendation: Not applicable. B. D & B DEVELOPMENT PROPOSAL FOR OLD COURTHOUSE PLAZA Recommendation: Receive and file. Commission Recommendation: Not applicable. END OF CONSENT CALENDAR 4. EXECUTIVE SESSION -- to discuss legal matters. 5. REPORTS A. MAJOR COMMERCIAL REHABILITATION - STATUS REPORT Recommendation: Receive and file. Commission Recommendation: Not applicable. 6. RESOLUTIONS A. DEVELOPER SELECTION FOR A-2 SITE (FORMERLY BURKES) Recommendation: Adopt Resolution 82-1: A RESOLU- TION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AUTHORIZING THE CHAIRMAN OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA TO EXECUTE AN EXCLUSIVE NEGOTIATION AGREEMENT WITH SANTA ANA PLAZA ASSOCIATES FOR PROPERTY KNOWN AS THE "A-2 SITE". Commission Recommendation: Recommend that the Agency grant a 90-day Exclusive Right to Campeau/Goldrich, Kest and Stern for development of the A-2 Site sub- ject to the following conditions: -2- . . B. . 1. That within 30 days of the 90-day period, the developer re-submit a pro forma for their project using an assumed land cost of approximately $15 per square foot. If such a pro forma is not submitted the exclusive right will be subject to termination by the Agency. 2. The developer must submit specific details in the physical plans on the phasing of the park- ,ing garage and agree to build the garage to allow for phasing. 3. The provision of Fourth street retail must remain as an integral part of future plans. 4. The developer agrees to start construction within nine months of signing the exclusive right to negotiate agreement. The agreed dis- position price will have an adjustment clause if construction is not started within six months after signing the Disposition and Development Agreement. DEVELOPER RECOMMENDATION FOR B-1 SITE (FORMERLY JONES) Recommendation: Adopt Resolution 82-2: A RESOLU- TION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AUTHORIZING THE CHAIRMAN OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA TO EXECUTE AN EXCLUSIVE NEGOTIATION AGREEMENT WITH ROBERT FERRANTE AND JULES WALDER FOR PROPERTY KNOWN AS THE "B-1 SITE". Commission Recommendation: Recommend that the Agency grant a 90-day Exclusive Right to Negotiate to the Ferrante/Walder Company for development of the B-1 site subject to the following conditions: 1. The developer must proceed immediately with plan refinement that insures that each devel- opment phase is self contained. 2. The developer agrees to start construction within nine months of signing the exclusive right to ne~otiate agreement. The agreed dis- position prlce will have an adjustment clause if construction is not started within six months after signing the Disposition and Development Agreement. -3- . . . C. DELEGATION OF CLAIMS PROCESSING PROCEDURE Recommendation: Adopt Resolution 82-3: A RESOLU- TION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA AUTHORIZING THE CITY ATTORNEY OF THE CITY OF SANTA ANA TO PERFORM CLAIMS FUNCTIONS AS PERMITTED BY CALIFORNIA GOVERNMENT CODE SECTIONS 935.4 AND 949.
