REL:adg-2l 10/16/85 RESOLUTION NO. 85- 43 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA APPROVING AN AMENDMENT TO AN AGREEMENT BETWEEN THE AGENCY AND URBATEC WHEREAS, the Community Redevelopment Agency of the City of Santa Ana is engaged in activities necessary to ex- ecute and implement the Redevelopment Plan for the Santa Ana Redevelopment Project and the Redevelopment Plan for the Santa Ana Inter City Commuter Station project¡ and WHEREAS, in order to implement the Redevelopment Plan, the Agency and Urbatec, on July 9,1984, entered into that certain "Disposition and Development Agreement" (the "Agreement"), which is on file in the office of the Executive Director of the Agency, WHEREAS, the Agency and Urbatec do now desire to amend the abovesaid Agreement in certain particulars which are set forth in that certain "Amendment to Disposition and Develop- ment Agreement" between the Agency and Urbatec, (the "Amendment"), which is on file in the office of the Executive Director of the Agency, the Agreement and the Amendment together being herein- after refered to as the "Amended Agreement." WHEREAS, pursuant to the terms and provisions of the Amended Agreement, the Agency proposes to sell certain real property in the Project Areas (hereinafter referred to as the "Site") to Urbatec, said Site being specifically described in the Amended Agreement¡ and WHEREAS, the proposed Amended Agreement contains all the provisions, terms conditions and obligations required by state and local law¡ and WHEREAS, Urbatec possesses the qualifications and financial resources necessary to acquire and insure development of the Site, in accordance with the purposes and objectives of the Redevelopment Plans¡ and WHEREAS, the Agency has prepared, reviewed and con- sidered a Summary Report setting forth the cost of the Amended Agreement to the Agency, the estimated value of the interests to be conveyed determined at the highest uses permitted under the Redevelopment Plans, and the purchase price, and made said Summary Report available for public inspection in accordance with the California Community Redevelopment Law¡ and . I I RESOLUTION NO. 85- 43 PAGE TWO WHEREAS, pursuant to the provisions of the California Redevelopment Law, the Agency and the City Council have held a duly noticed joint public hearing on the proposed sale of the Site and the proposed Amended Agreement¡ and WHEREAS, THE Community Redevelopment Agency of the City of Santa Ana has prepared an Initial Study of the environ- mental impact of the proposed Amended Agreement¡ and WHEREAS, the Agency has reviewed and considered the above said Initial Study and the final Environmental Impact Reports for the Santa Ana Redevelopment Plan and the Santa Ana Inter City Commuter Station Redevelopment Plan¡ and WHEREAS, said Initial Study conforms to the require- ments of the California Environmental Quality Act of 1970 (Public Resources Code, Section 21000 et ~.) the "Guide- lines for the Implementation of the California Environmental Quali ty Act of 1970, II as amended, adopted by the Secretary for Resources of the State of California, and procedures for implementation of the Environmental Quality Act of 1970 adopted by the Agency¡ NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS: 1. The Agency has considered all the terms and conditions of the proposed sale and hereby finds and determines that the redevelopment of the Property pursuant to the said Amended Agreement is in the best interest of the City and the health, safety and welfare of its residents, and is in accord with the public purposes and provisions of the applicable state and local laws. 2. The said Amendment is hereby approved, and the Chair- man of the Agency is hereby authorized to execute the said Amendment and the Grant Deed pertaining to the Amended Agreement. 3. The Executive Director is hereby authorized to take all steps, and to sign all documents and instruments necessary to implement and carry out the said Amended Agreement on behalf of the Agency. 4. The Agency finds and determines that the Environ- mental Impact Reports (EIR's) prepared for the Redevelopment Projects are adequate for approval of the Amended Agreement, and that preparation of an additional Environmental Impact Report is not necessary for the following reasons: (a) Implementation of the Amended Agreement does not represent any change in the Redevelopment Projects¡ nor does it involve any new significant environmental impacts other than those considered in the EIR's, . , , RESOLUTION NO. 85- 43 PAGE THREE (b) No substantial changes have occurred with respect to the circumstances under which the Redevelopment Projects are undertaken which involve any new significant environmental effects not covered in the E.I.R.'s. (c) No new information of substantial importance to the Redevelopment Projects has become available which shows that the Redevelopment Projects will have any significant effects not discussed in the E.I.R.'s for the Redevelopment projects¡ or that the significant effects previously examined will be substantially more severe than shown in the E.I.R.'s¡ or that any mitigation measures or alternatives exist which would be feasible and would substantially reduce any signif- icant effect of the Redevelopment projects but were either not considered in the E.I.R.'s or found not to be feasible. 5. The approval of the said Amended Agreement by the Agency, as hereinabove set forth, is conditional upon the approval of the sale of the Site upon the terms and conditions contained therein by the City Council of the City of Santa Ana.
