RESOLUTION NO. 85-01
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA AUTHORIZING
AND DIRECTING THE CONDEMNATION OF CERTAIN
REAL PROPERTY FOR REDEVELOPMENT PURPOSES
IN THE FASHION SQUARE EXPANSION DEVELOP-
MENT SITE IN THE CITY OF SANTA ANA, STATE OF
CALIFORNIA, AND DECLARING THE PUBLIC NECESSITY
THEREFOR
WHEREAS, pursuant to the redevelopment plan of this
Agency, it has become necessary to acquire certain real property
located at 2720-2760 North Main Street in the redevelopment project
area¡ and
WHEREAS, the Community Redevelopment Agency has made
an offer to the owner or owners of record to acquire the property
described herein at an amount not less than the Community
Redevelopment Agency's approved appraisal of the fair market value
of the property¡ and
WHEREAS, all persons whose names and addresses appear
on the last equalized assessment roll for the property described
herein and all persons whose names appear as record owners on the
litigation guarantee reports for said property, and all tenants were
given notice and an opportunity to be heard pursuant to the Code of
Civil Procedure Section l245.235¡ and
WHEREAS, a public hearing was held by the Community
Redevelopment Agency on those matters set forth in its Notices of
Intention to Adopt a Resolution of Necessity and referred to in
Section 1240.030, Code of Civil Procedure, which included the
following matters:
(a) Whether the public interest and necessity
require the proposed project¡
(b) Whether the project is planned and located in
the manner that will be most compatible with the greatest public
good and the least private injury¡ and
(c) Whether the property described herein is
necessary for the proposed project.
NOW, THEREFORE, BE IT RESOLVED by the Community
Redevelopment Agency of the City of Santa Ana that it finds and
determines as follows:

1. The Agency is specifically authorized by virture
of Health & Safety Code Section 33391 and Section 33342 to take
property by condemnation for Redevelopment purposes, namely
redevelopment of real property situated within the area described in
the first recital hereinabove.
2. The property described herein is located within
the Community Redevelopment project area of the City of Santa Ana as
depicted by the map attached hereto as Exhibit A, and incorporated
herein by reference, and is necessary for the proposed project.
Said property is more particularly described as follows:

THE LAND REFERRED TO IS SITUATED IN THE STATE OF CALIFORNIA, COUNTY
OF ORANGE, CITY OF SANTA ANA, AND IS DESCRIBED AS FOLLOWS:
THAT CERTAIN PARCEL OF LAND SHOWN AS 16.18 ACRES ON A MAP THEREOF
FILED IN BOOK 36, PAGE 1 OF RECORD OF SURVEYS IN THE OFFICE OF THE
COUNTY RECORDER OF SAID ORANGE COUNTY, BEING A PORTION OF THE LAND
ALLOTTED TO ABEL STEARNS, AS DESCRIBED IN THE FINAL DECREE OF
PARTITION OF THE RANCHO SANTIAGO DE SANTA ANA, WHICH WAS ENTERED
SEPTEMBER 12,1868 IN BOOK B, PAGE 415 OF JUDGMENTS OF THE DISTRICT
COURT OF THE 17TH JUDICIAL DISTRICT, IN AND FOR LOS ANGELES COUNTY,
CALIFORNIA, AND BEING A PORTION OF LOT 11 OF POTTS, BORDEN AND
SIDWELL TRACT, AS SHOWN ON A MAP RECORDED IN BOOK 4, PAGE 624 OF
MISCELLANEOUS RECORDS OF LOS ANGELES COUNTY, CALIFORNIA.
EXCEPT THAT PORTION OF SAID LAND LYING SOUTHWESTERLY AND WESTERLY OF
THE FOLLOWING DESCRIBED LINES:
BEGINNING AT A POINT IN THE CENTER LINE OF ROE DRIVE, AS SAID DRIVE
IS SHOWN ON A MAP OF TRACT NO. 512 RECORDED IN BOOK 19, PAGE 16 OF
MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY, DISTANT ALONG
SAID CENTER LINE, NORTH 71 DEGREES 21' 01" EAST 143.65 FEET FROM THE
INTERSECTION THEREOF WITH THE NORTHEASTERLY LINE OF THE SOUTHERN
PACIFIC RAILROAD COMPANY'S 100-FOOT RIGHT OF WAY¡ THENCE NORTH 33
DEGREES 10' 12" WEST TO THE SOUTHEASTERLY CORNER OF THE PARCEL OF
LAND DESCRIBED IN THAT CERTAIN DEED TO THE STATE OF CALIFORNIA
RECORDED IN BOOK 3016, PAGE 481 OF OFFICIAL RECORDS¡ THENCE NORTH 29
DEGREES 35' 32" WEST 207.69 FEET¡ THENCE NORTH 28 DEGREES 35' 30"
WEST 634.92 FEET¡ THENCE NORTH 0 DEGREES 57' 48" EAST 200.00 FEET.
ALSO EXCEPTING THEREFROM, THAT PORTION THEREOF DESCRIBED IN THE DEED
TO THE CITY OF SANTA ANA RECORDED MARCH 18,1974 IN BOOK 11096, PAGE
1683 OF OFFICIAL RECORDS.

Fashion Square expansion and redevelopment project.

4. The Fashion Square expansion and redevelopment

for the Fashion Square expansion and redevelopment project.
6. The offer required by Section 7267.2 of the
California Government Code has been made to the owners of record.
