RESOLUTION NO. 92-2
A RESOLUTION OF THE COMMUNITY REDEVE-
LOPMENT AGENCY OF THE CITY OF SANTA ANA
APPROVING A THIRD AMENDMENT TO THE
PARTICIPATION AGREEMENT WITH SANTA ANA
VENTURE AND MAKING CERTAIN FINDINGS WITH
RESPECT THERETO
WHEREAS, this Redevelopment Agency and Santa Ana Venture
entered into an agreement, entitled "Fashion Square Commercial
Center site Participation Agreement," dated May 15, 1984, for the
redevelopment by Santa Ana Venture of a site located on the west
side of Main street, south of the Garden Grove Freeway; and
WHEREAS, the approval of the said agreement followed
certification by this Redevelopment Agency of an environmental
impact report, entitled "Fashion Square Commercial Center Final
Environmental Impact Report," prepared in accordance with the
requirements of the California Environmental Quality Act with
regard to the proposed redevelopment of the subject site in
accordance with the said agreement (the "Fashion Square EIR"); and

WHEREAS, the Department of Transportation of the State of
California ("CaITrans") is undertaking a project to widen the
Interstate 5 ("Santa Ana") Freeway, and as part of this project
intends to construct certain freeway ramps in the vicinity of the
Santa Ana Venture site; and
WHEREAS, CalTrans and the Federal Highway Administration have
prepared and certified a supplemental environmental impact
report/environmental impact statement in accordance with the
requirements of the California Environmental Quality Act which
addresses the environmental effects of the said freeway ramps,
which ramps are referenced therein as the "H-3 Alternative" (the
"CalTrans SEIR"); and
WHEREAS, this Redevelopment Agency and Santa Ana Venture do
now desire to amend their agreement to provide for the payment of
transportation improvement fees, to provide for the substitution of
the H-3 Alternative ramps for certain ramps specified in the
agreement, to provide for the funding of the H-3 Alternative ramps,
and to revise the freeway ramp development limit applicable to the
subject site; and
WHEREAS, the environmental staff of the city of Santa Ana
have, on behalf of this Redevelopment Agency, reviewed the Fashion
Square EIR and the CalTrans EIR and the proposed amendment to the
agreement to determine if any subsequent or supplemental
environmental impact report is required to be prepared prior to the

approval of the amendment under the standards set forth in the
California Environmental Quality Act and the state CEQA Guidelines,
and have concluded because the Fashion Square EIR and the CalTrans
SEIR analyze the effects of the proposed amendment to the extent
they may be significant, that no such subsequent or supplemental
environmental impact report is necessary;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT
AGENCY OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That certain "Third Amendment to Fashion square
Commercial Center Participation Agreement," in the form set forth
in Exhibit A, attached hereto and incorporated herein by reference,
is hereby approved, and the Chairman is authorized to execute the
same on behalf of this Redevelopment Agency.
2 . In approving the said amendment,
Agency finds and determines as follows:

The subject amendment does not change the "Fashion square
Commercial Center" project in a way which involves any
new significant environmental impacts which were not
considered in the Fashion Square EIR or the CalTrans
SEIR.
The subject amendment does not change the circumstances
under which the "Fashion square Commercial Center"
project is undertaken in a way which would involve new
significant environmental impacts which were not covered
in the Fashion Square EIR or the CalTrans SEIR.
No new information, not available at the time of
certification of the Fashion Square EIR or the CalTrans
SEIR, has become available, which shows any of the
following:

That the "Fashion Square Commercial Center" project
will have any significant effect not discussed in
the Fashion Square EIR or the CalTrans SEIR.
That any of the significant effects of the "Fashion
Square Commercial Center" project will be
substantially more severe than shown in the Fashion
Square EIR or the CalTrans SEIR.
That mitigation measures or alternatives which were
previously found not to be feasible for the
"Fashion Square Commercial Center" project would in
fact be feasible.
That there
alternatives
are any mitigation measures or
to the project which were not

considered in the Fashion Square EIR or the
CalTrans SEIR which would substantially lessen one
or more significant effects on the environment.

The Fashion Square EIR and the CalTrans SEIR are adequate
for the purpose of approving the subject amendment, and
no subsequent or supplemental EIR is required under
section 21666 of the California Environmental Quality
Act.
3. Staff is instructed to file a Notice of Determination
with the clerk of the county within five working days following the
date of this resolution, to provide notice of the approval of the
subject amendment in accordance with section 21152 of the Cali-
fornia Environmental Quality Act.
