RESOLUTION NO. 97-8
A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF
SANTA ANA APPROVING THE DISPOSITION AND DEVELOPMENT AGREMENT
BETWEEN THE AGENCY AND AMERICAN LODGING FOR THE SALE OF PROPERTY
LOCATED AT 1115-1117 NORTH BUSH STREET; AUTHORIZING THE EXECUTIVE
DIRECTOR TO EXECUTE, ON BEHALF OF THE AGENCY, THE AGREEMENT AND
RELATED DOCUMENTS AS NECESSARY; AND MAKING CERTAIN FINDINGS WITH
RESPECT THERETO.
THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF SANTA ANA
HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
WHEREAS, the city Council of the city of Santa Ana has
heretofore adopted the Redevelopment Plan for the Santa Ana South
Main Street Redevelopment Project on July 6, 1982 by Ordinance
NS1639 (the "Redevelopment Project"); and

WHEREAS, pursuant to sections 33334.2(a) and 33334.6(c) of
the California community Redevelopment Law (California Health and
Safety Code section 33000 et ~.) not less than 20 percent of
all taxes which are allocated to the community Redevelopment
Agency of the City of Santa Ana ("Agency") are set aside by the
Agency in a Low- and Moderate-Income Housing Fund and used by the
Agency for the purpose of increasing, improving and preserving
the community's supply of low and moderate housing available at
affordable housing costs to persons and families of low- and
moderate-income, including very-low-income persons; and
WHEREAS, pursuant to section 33334.2(e) of the Community
Redevelopment LaW, the Agency may exercise any and all of its
powers to carry out this purpose; and
WHEREAS, pursuant to section 33334.6(a) of the Community
Redevelopment Law, the California State Legislature has found and
declared that the provision of affordable housing outside of
redevelopment project areas can be of direct benefit to those
projects in assisting the accomplishment of project objectives;
and
WHEREAS, in connection with the Redevelopment Plan, the
Agency has established a Low and Moderate Income Housing Fund in
accordance with California Health and Safety Code section 33334.2
et~. (the "Housing Funds"), to provide funding for housing
within the City of Santa Ana that is affordable to persons and
families of very-low, low- or moderate-income; and

WHEREAS, pursuant to section 33334.2(g) of the community
Redevelopment LaW, the Agency may use Housing Funds to assist in
the provision of housing for low- or moderate-income households
outside the Redevelopment Project area if such use will be of
benefit to the Redevelopment project; and

WHEREAS, the Agency has used Housing Funds to purchase
certain real property located at 1115-1117 North Bush street (the
~Property"), which is located outside the Redevelopment Project
area; and
WHEREAS, the Agency proposes to sell the Property to Shelter
for the Homeless, A California nonprofit corporation, dab
American Lodging, for rehabilitation and use in accordance with a
proposed Disposition and Development Agreement (the ~DDA"); and
WHEREAS, pursuant to the DDA, American Lodging will use the
Property exclusively as a small housing project, as defined in
section 33013 of the Community Redevelopment LaW, consisting of
two units of affordable rental housing for very-low-income
families; and
WHEREAS, the use of Housing Funds as provided in the DDA is
of benefit to the Redevelopment Project; and
WHEREAS, the development of the Parcels pursuant to the
Agreement is an activity that is categorically exempt from the
California Environmental Quality Act (Class 3, CEQA Guidelines
/)15303); and

WHEREAS, THE Agency has duly considered all of the terms and
conditions of the proposed Agreement, and believes that the
proposed Agreement is in the best interests of the city and the
health, safety, morals and welfare of its residents, and in
accord with the public purposes and provisions of applicable
state and local laws and requirements; and
WHEREAS, this Agency has held a public hearing on the
proposed project and the Agreement as required for a small
housing project by Section 33433(c) of the Community
Redevelopment Law, after having duly provided notice of such
public hearing in accordance with state law.
NOW, THEREFORE, BE IT RESOLVED by the Community
Redevelopment Agency of the City of Santa Ana as follows:
1.
The Agency recognizes that it has received and heard
all oral and written objections to the proposed
Agreement, to the proposed financing of the Project
pursuant to the proposed Agreement, and to other
matters pertaining to this transactions, and that all
such oral and written objections are hereby overruled.
2.
The Agency hereby finds and determines that the
Recitals set forth above are true and correct.
3.
The Agency hereby finds and determines that the sale of
the Property in accordance with the Agreement will
provide housing for low- or moderate-income persons.

4.
The Agency hereby approves the sale of the Property and
the Agreement establishing the terms and conditions for
the sale and development of the Parcels, including all
attachments thereto.
5.
The Executive Director of the Agency or designee is
hereby authorized, on behalf of the Agency, to execute
the Agreement and each and every Attachment and Exhibit
thereto that is to be signed by the Agency, and to make
such changes of a non-substantive nature to such
documents as the Executive Director or designee shall
deem appropriate. A copy of the Agreement, Attachments
and Exhibits, when executed, shall be placed on file in
the office of the Secretary of the Agency.
6.
The Executive Director of the Agency of designee is
hereby authorized, on behalf of the Agency, to sign all
documents necessary and appropriate to carry out and
implement the Agreement and to administer the Agency's
obligations, responsibilities and duties to be
performed under said Agreement.
7.
The Agency finds and determines that the use of the
Housing Funds as authorized by this Resolution will be
of benefit to the Redevelopment Project.
